해양경찰 무기사용의 몇 가지 쟁점에 대한 소고 (A Study on Issues of Using Firearms by the Korea Coast Guard)

초록

2016년 10월 서해 상에서 발생한 중국어선의 해양경찰 고속단정 고의충돌ㆍ침몰사고 이후, 해양경찰은 『해양경비법』의 일부 규정을 개정하여, 단속 과정에서 개인화기 이외에 공용화기를 사용할 수 있도록 법적 근거를 보완하였다.
해양에서 해양경찰의 집행력과 행정의 실효성을 확보하기 위한 방편의 하나로서 가장 강력한 실력행사를 보일 수 있는 무기를 사용함에 있어 육상의 공권력 집행과 구별되는 해양경찰만의 절차적인 단계와 법적 근거가 중요한 요소로 부각되게 되었다. 특히 국민적인 관심을 모으고 있는 불법 중국어선의 단속이나 해적에 대한 대응에서 무기의 사용은 그 필요성과 함께 절차의 준수가 고려되어야 한다.
2017년 7월 해양경찰청은 해양수산부 소속의 독립 외청으로 제자리를 찾게 되었다. 해양에 대한 의존도가 다른 어떤 나라보다도 훨씬 높은 우리나라에서 해양안전에 대한 가치가 더 중요해진 이때에 해양경찰 조직 전체에 영향을 미칠 수 있는 무기사용에 대한 법적 근거를 살피는 작업은 매우 중요하다.
본 논문에서는 해양경찰의 무기사용에 대한 개관과 법적 근거를 살펴보고, 해양경찰관이 무기를 사용함에 있어 확신을 가질 수 있는 객관적인 법률적 근거의 명시와 해상검문검색의 처벌내용을 보완하는 것이 필요함과 현장상황에 맞는 반복적인 무기사용 훈련과 무기사용 시 증거의 확보 및 관리가 중요함을 강조하였다.

영어초록

Following the sinking of and intentional collision with a high-speed boat of the Korea Coast Guard by a Chinese fishing boat in October 2016 on the Western Sea, the Korea Coast Guard amended some regulations of the Maritime Policing Act and supplemented the legal basis of allowing the use of personal and crew-served firearms during the process of undertaking patrols.
Through the use of firearms as one of the strongest means of presenting force in order to secure the effectiveness of enforcement and administration by the Korea Coast Guard in the oceans, the importance of the protocol and legal basis for using firearms separated from cases of enforcing public authority on land, has become recognized of its importance. In particular, as the process of law enforcement activities against illegal Chinese fishing boats or responding to pirate attacks are gathering national interest, the use of firearms in those situations, the necessity of using, and the strictness of protocol during the use of firearms must be taken into consideration.
In July 2017, the Korea Coast Guard was reorganized as an independent government body affiliated with the Ministry of Maritime Affairs and Fisheries. In light of the Republic of Korea’s dependence on maritime affairs more so than any other country and during a time in which the value of maritime safety has become ever important, the process of exploring the legal basis of using firearms, a subject having the potential to greatly affect the entirety of the Korea Coast Guard, has become very important.
This study examined the legal basis and background regarding the use of firearms by the Korea Coast Guard, specified objective legal grounds regarding the certainty with which coast guard officers may use firearms, and suggested the need to supplement penalties directed from maritime search and inspection. Moreover, this study emphasized the importance of undertaking repeated firearms training in preparation for different site conditions, and underscored the importance of managing as well as securing evidence after the discharge of weapons.
