선박소유자의 총체적 책임제한의 요건에 관한 검토 - 대법원 2012. 4. 17. 자 2010마222 결정을 중심으로 - (A Study on Prerequisite of Limitation of Liability for Maritime Claims)

초록

상법 제769조 단서의 책임제한배제사유의 해석과 적용에 있어서는 법조문의 문리적 해석에 더해 위 조문 탄생의 입법적 연혁과 국제적 운용현황 등을 다각적으로 고찰할 필요가 있다. 특히 책임제한절차 운용의 국제적 통일성을 제고하고, 선박소유자들로부터 신뢰할 수 있는 법정이라는 평가를 받아 대한민국의 해사법정이 활성화되기 위해서도 책임제한절차와 관련한 국내 입법과 판례는 국제적 보편성을 따라야 한다. 그러나 우리의 현실은 과연 위와 같은 국제적 조류를 충실히 반영하고 있는지 의문이다. 우리나라는 1976년 책임제한조약의 주요 조항들을 상법에 조문화하였지만, 우리 상법과 1976년 책임제한조약은 세부적인 면에서 완전히 동일하지 않음으로 인한 법률적 문제점들을 노정시키고 있다. 법리적 관점에서 볼 때, 책임제한배제사유의 주관적 요건에 관한 이 사건 대법원 판시는 1976년 책임제한조약 제4조의 해석에 관한 국제적 조류와 맥을 같이 하는 것으로서 적절하다. 다만 대법원 판시 중 책임제한절차법 제18조 제2호의 해석과 관련하여, 상법 제769조 단서의 책임제한배제사유의 부존재에 대한 소명책임을 선박소유자에게 부담시킨 점은 이에 관한 국제적 논의와 상이한 것으로, 책임제한제도 운영에 관한 대한민국 법률과 법정의 신뢰성에 관한 국제적 의구심을 키울 수 있다. 해상법의 주요 특징은 국제성과 통일성을 들 수 있고, 선박소유자 책임제한제도 역시 이러한 특징을 충실히 반영하여야 한다. 우리의 입법과 사법제도의 운용 역시 이러한 국제적 추세를 적절히 반영하는 것이 우리 국익을 보호하는 시금석이 된다는 점을 인식할 필요가 있다.

영어초록

Upon construction and application of limitation of liability for maritime claims which is stipulated in Article 756 of the Korean Commercial Code, it is reasonable to review the legislative history and international legislations of limitation of liability as well as interpretation of provisions themselves. In order for Korea to become as a competitive forum for limitation of liability, domestic legislation and court rulings should be brought into line with the rest of world. However, it is still doubtful whether Korea keeps steps with the international trend on those matters. Although Korea is one of the nations which have not signed up to 「the Convention on Limitation of Liability for Maritime Claims 1976(hereunder 'LLMC 1976')」along with the United States and codified most of major provisions of the LLMC 1976 to the Korean Commercial Code(hereunder 'KCC'), the LLMC 1976 and the KCC have discrepancies in details. Above mentioned differences between the two legal regimes expose legal problems for the matters concerning limitation of liability in Korea. From the legal point of view, however, the Korean Supreme Court's rulings regarding the deprivation of the right of limitation of liability for the shipowner's subjective reasons, are in line with generally accepted international trends to the interpretation of Article 4 of the LLMC 1976. In the meantime, the Korean Supreme Court ruled that the onus of proof is on applicants whether there were reasons to exempt shipowner's right of limitation of liability. However, the said rulings are not match other nations' courts' rulings which explicitly rest the burden of proof on creditors, and it can reach distrust of Korean courts as a forum for limitation of liability. The particulars of the Maritime Law can be described as internationality and uniformity, and it should be stressed that a states's legal system on issues of limitation of liability shall respect the said natures of the Maritime Law. Therefore, to protect our national interest as a world trade power, the legislation and judiciary proceeding on matters of limitation of liability shall match up with international trends.
