초록

유치권에 기한 경매에 있어서 인수주의에 의할 경우 매각의 실효성이 없으므로 가급적 소멸주의를 채택함이 타당하고, 다른 담보물권자 등에 대해서도 손해가 발생할 염려가 없고, 유치권에 기한 경매도 민사집행법으로 환가를 하는 이상 강제경매 또는 담보물권 등의 실행을 위한 경매 등과 같이소멸주의를 따라야 할 것이다.
따라서 부동산유치권이 가져오는 폐단을 입법적으로 해결하는 방법은 부동산유치권을 부정하는 것이 아니라, 유치권의 경우에도 물권의 우선적 효력이라는 원칙이 적용된다는 것을 전제로 유치권자가 경매절차에서 우선변제를 받을 수 있고 경매에 의해서 유치권이 소멸하도록 하는 방법일 것이다.
그렇게 된다면 유치권이 가져오는 폐해는 상당 부분 해결될 수 있을 것이다.
유치권은 물권이지만 우선변제권이 없어서 배당을 받지 못하지만 유치권자가 ‘유치권에 기한 경매’를 실행하여 그 부동산에서 가장 먼저 배당받을권리를 부여하므로 실무에서는 사실상의 우선변제권을 인정하는 것과 유사한 것으로 보고 있다.
그렇다면, 유치권은 실질적경매에서 우선변제권을 부여하여 그 성립순위가 보장되어야 할 것이다. 특히 ‘유치권에 기한 경매’에서도 판례의 태도와같이 소멸주의를 적용하여 다른 담보권자 등에게 우선변제권을 인정해 주어야 할 것이다. 그러므로 유치권이 집행권원 등의 방법으로 입증되면 유치권경매는 ‘담보권 실행을 위한 경매절차에 관한 규정’을 준용하는 것이 타당하다고 생각한다.
