마약류 사용자 치료⋅재활 체계 개선을 위한 해외 사례 비교연구: 미국, 일본, 싱가포르를 중심으로 (A Comparative Study on Improving the Treatment and Rehabilitation System for People with Drug Addiction: Focusing on the United States, Japan, and Singapore)

초록

본 연구의 목적은 국내 마약류 사용자의 치료· 재활에 관한 제도적 개선방안을 고안하기위하여 해외 사례를 비교하고 국내 상황에 적절한 시사점을 도출하는 것이다. 우리나라의 마약류 사용자에 대한 대응은 치료나 재활보다 처벌 위주로 이루어지고 있으며, 처벌위주의 접근만으로는 증가하는 마약류 접근성과 범죄 및 높은 재발률 등에 효과적으로 대응하기 어렵다. 마약류 사용자 대응 정책에 대한 주요 성과를 이루고 있는 미국, 일본, 싱가포르마약류의공급 뿐 아니라 수요를 차단하기 위한 치료⋅재활과 관련한 법과 제도를 발전시켜 왔다. 미국은 오랜 마약 대응 정책의 역사를 가지고 있으며, 근거를 기반으로 한 다양한 방면의 정책을 마련하고 있고, 일본은 「약물남용방지 5개년 전략」을 통해 치료 및 재활 정책을 강조하고있다. 싱가포르는 교정체계와 치료⋅재활의 유기적인 연결을 도모하고 있다. 시사점 도출을위해 마약류 관련 법과 정책, 사법 및 치료·재활 서비스를 우리나라와 비교하였다. 국가별비교분석의 틀로 제도주의 접근법을 활용하였다. 국내외 사례 비교 분석결과, 마약류 사용자 치료․재활 정책을 위한 제언은 다음과 같다. 첫째, 처벌위주의 정책에서 치료․재활 위주의정책을 위한 제도적 마련이 필요하며, 둘째, 정책의 근거마련을 위한 연구기관 수립이 필요하다. 셋째, 치료․재활 정책을 주도하는 컨트롤 타워 기관을 설립을 통해 일관성 있는 정책을추진해야 한다. 넷째, 사법, 교정, 치료, 사회복귀를 재범방지 전략을 유기적으로 연결하며, 다섯째, 치료 및 재활의 연속성을 확보해야 한다.

영어초록

The purpose of this study is to devise institutional improvements for domestic treatment and rehabilitation system for people with drug addiction by comparing overseas cases and deriving relevant insights for the domestic situation. In South Korea, the response to drug users has been primarily focused on punishment rather than treatment or rehabilitation.However, addressing the increasing accessibility of drugs, crime, and high rates of recidivism effectively cannot be achieved through a punitive approach alone. The United States, Japan, and Singapore, which have achieved significant success in drug user response policies, have developed laws and systems related to treatment and rehabilitation in addition to supply control. The United States has a long history of drug response policies and has developed various policies based on evidence. Japan emphasizes treatment and rehabilitation policies through its national-led strategy. Singapore promotes an organic connection between its correctional system and treatment and rehabilitation.
To achieve this, the drug-related laws, policies, judicial systems, and treatment rehabilitation services of the United States, Japan, and Singapore were compared with those in Korea. The comparative analysis framework used institutionalism approach. Based on the domestic and international case comparison analysis, the following recommendations for drug user treatment and rehabilitation policies are as follows: First, there is a need to establish systemic arrangements for treatment and rehabilitation-oriented policies, shifting away from a punitive approach. Second, the establishment of research institutions to provide the foundation for policy development is necessary. Third, through the establishment of a control tower agency that leads treatment and rehabilitation policies, a consistent policy should be pursued. Fourth, a seamless connection between the judicial system, correctional system, treatment, and social reintegration should be established as a recidivism prevention strategy. Fifth, continuity in treatment and rehabilitation must be ensured.
