초등 사회과 교육과정과 교과서에서 묘사하는 인권과 법의 관계 : ‘인권존중과 정의로운 사회’ 단원을 중심으로 (Relationship between Human Rights and Laws in Elementary Social Studies Curriculum and Textbooks : Focused on "Respect for Human Rights and Righteous Society”Unit)

초록

이 연구의 목적은 2015 개정 초등 사회과 교육과정과 교과서에서 인권과 법을 가르치도록 되어 있는 단원에서 인권과 법의 관계를 어떻게 묘사하고 있는지를 분석하는 것이다. 이에 교육과정과 초등 사회 5-1 교과서 ‘인권존중과 정의로운 사회’단원의 내용체계와 성취기준, 그리고 교과서 내용을 분석하였다. 분석결과는 다음과 같다. 첫째, 교육과정의 내용체계를 보면 인권은 법의 하위 영역으로 구성되어 있다. 둘째, 교육과정의 성취기준에서는 법과 인권이 헌법의 기본권에 의해 연결되도록 내용을 구성하고 있다. 셋째, 교과서 내용을 보면 권리 측면에서 인권과 법이 연결되도록 내용을 구성하고 있다. 넷째, 교과서 내용에서 법과 인권을 강조하는 각 단원은 법과 인권 모두 인간의 권리라는 점과 권리문제에 국가와 개인들이 연계되어 있다고 설명하는 점에서 공통점을 보인다. 다섯째, 교과서 내용에서 법과 인권을 강조하는 각 단원에서는 권리 주장의 근거가 되는 문서 제시와 권리 사례의 권리 침해자 제시 부분에서는 차이를 보인다. 이런 결과를 고려하면 현재 초등 사회교육과정과 교과서에서 설명하고 있는 인권과 법의 관계는 다양한 측면에서 불일치 양상을 보이며, 이로 인해 둘의 관계 설명 내용 또한 모호하게 제시되고 있다. 이러한 문제를 해결하기 위해서는 법과 인권이 사회과교육의 내용으로서 갖는 의미를 고려하면서 두 내용을 잘 연계할 수 있는 방안을 검토할 필요가 있다.

영어초록

The purpose of this study is to analyze how the relationship between human rights and law is described in the unit that is supposed to teach human rights and law in the 2015 revised elementary social studies curriculum and textbooks. Accordingly, the content system and achievement standards in 2015 revised elementary social studies curriculum and contents of elementary social studies textbook(5-1) unit(Respect for Human Rights and Righteous Society) were analyzed. The results of the analysis are as follows. First, as a result of analyzing the content system of the curriculum, human rights are presented as the content of the sub-domain of the law. Second, it suggests that the relationship between law and human rights is linked by the basic rights of the Constitution according to the achievement standards of the curriculum. Third, looking at the results of the analysis of the composition of textbook units, human rights and laws show a structure that is related to the concept of rights. Fourth, each unit emphasizing law and human rights in the textbook contents has a common point in the explanation that humans have rights and that states and individuals are linked to the issue of rights. Fifth, each unit emphasizing law and human rights in the textbook contents reveals differences in presenting documents that are the basis for claiming rights and presenting victims of cases of rights. Considering these results, the relationship between human rights and law in the elementary social studies curriculum and textbooks shows a disagreement in various aspects, and the explanation of the relationship between the two is also ambiguous. In order to solve these problems, it is necessary to consider the consistent means of constructing new educational contents while considering the meaning of law and human rights as the contents of social studies education.
