주권 개념의 본질과 근대주권론에 대한 비판적 고찰 - 법철학적 주권론을 향하여 - (Critical Study on The Nature of Sovereignty and Modern Theory of Sovereignty- Towards a Jurisprudential Theory of Sovereignty -)

초록

소위 ‘탈-주권’과 ‘주권 과잉’의 모순적 공존 현상 속에 주권의 문제는 오늘날 여러 차원에서 또 다시 중요한 주제로 부상한다. 근대법질서와 공법학의 근본개념인 주권은 근대국가형성기에 특수한 시대적, 정치사회적 필요에 의해 만들어진 사회적 구성물이다. 근대적 산물로서 주권 개념은 최고성, 절대성, 최종성, 영속성 등을 특징으로 하며 ‘항구적인 최고 지배 권력’으로 정의되어왔다. 하지만 오늘날 전지구적 차원에서 이러한 절대주의적 주권관에 도전하는 다양한 현상들이 출현하였고 이에 따라 주권 개념과 근대 주권론의 운명을 두고 열띤 논쟁이 전개된다. 그런데 주권 논쟁은 대부분 근대적 주권관이 여전히 타당하고 유용한 것인지에 주안점을 두고 있다. 그러나 필자는 이에 더하여 주권 개념을 갖는다는 것 자체가 갖는 잠재적 위험성이나 해악에도 주목해야한다고 주장한다. 이러한 배경과 문제의식 하에 본고는 다음과 같이 구성된다.
우선 본격적인 논의에 앞서 제2장에서는 ‘주권’이 ‘본질적으로 다투어지는 개념’이자 ‘군집 개념’이기에 그 자체로 모호성을 갖는다는 점을 규명한다. 이를 통해 주권 논쟁은 사실 주권 개념에 대한 상이한 의미에 기반하거나 잘못 겨냥되어 ‘애매성의 오류’를 범할 수 있음을 지적하면서, 그 해법도 복합적일 수밖에 없음을 밝힌다. 제3장에서는 주권 개념을 정치적 사실로 바라보는 입장과 오롯이 법률적 개념으로 다루려는 법규주의적 입장 양극단의 환원주의를 논하면서, 결론적으로 주권은 정치적-법적인 복합 개념이라고 주장한다. 제4장에서는 근대 주권론에 대한 비판적 검토를 수행한다. 그 과정에서 ‘주권의 역설’과 ‘주권론의 역설’을 제기하면서, ‘주권자 없는 주권론’의 가능성과 필요성을 논구한다. 대안 모색의 차원에서 주권론의 세 가지 이론 모델-전통적 이해방식을 대변하는 ‘주권 실체설’, 그에 대항하는 ‘통치 정당화 원리설’, 그리고 관계적 접근을 결합한 ‘주권 신탁설’-을 제시한다. 결론적으로 필자는 주권에 대한 가치-관계론적 접근의 중요성을 강조하면서, 이런 문제의식을 담아내기 위한 또 하나의 틀로 ‘상징적 형식으로서 주권’을 제안한다. 이는 주권 개념과 근대주권론에는 근본적으로 지배-복종관계와 부정의 문제가 잠재되어 있음을 보여줄 수 있을 뿐만 아니라 ‘주권 개념의 사유화’ 현상까지도 포괄할 수 있는 유용한 관점이다. 제5장에서는 오늘날 주권 논쟁의 양상이 결국 근대 주권 개념과 이론에 대한 수정주의적 변용의 틀 안에 갇혀있음을 지적하면서 이런 현상을 ‘주권주의의 독침’이라고 부른다. 요컨대, 본고에서 필자는 주권의 본질에 관하여 ‘정치적-법적 개념으로서 주권’(논제1), ‘가치-관계적 함수로서 주권’(논제2), ‘상징적 형식으로서 주권’(논제3) 테제를 제안한다. 마지막으로 완전하고 대안적인 주권론은 ‘법철학적 주권론’으로 발전되어야 함을 강조하고 그 주제와 범위를 제시하면서 글을 맺는다.

영어초록

Among the contradictory coexistence phenomenon of so-called “post-sovereignty” and “sovereignty surplus”, the issue of sovereignty emerges as a significant topic from various perspectives these days. Sovereignty, the fundamental concept of modern legal order and public law, is a social composition created by political and social needs in a specific period during the formation of the modern state. As a modern product, the concept of sovereignty has been defined as ‘permanent supreme ruling power’, characterized by supremacy, absoluteness, finality, and permanence. However, various phenomena that challenge this absolutist view of sovereignty have emerged around the world, and accordingly, there is an active debate over the concept of sovereignty and the fate of the modern theory of sovereignty. Most of the sovereignty debates focus on whether the modern view of sovereignty is still valid and its utility. In addition, the author insists on focusing on the potential dangers or harms of having the concept of sovereignty. This article consists of the background and awareness of the problem as follows.
First of all, chapter #2 clarifies that “sovereignty” is “essentially contested concept” and “cluster concept” and has vagueness in itself. Through this, it is pointed out that the sovereignty debate can be based on different meanings of the concept of sovereignty or commit an “error of ambiguity”, and the solution is also complex. Chapter #3 discusses the extreme reductionism of the legalist position, which treats the concept of sovereignty as a political fact, and argues that sovereignty is a political-legal complex concept. Chapter #4 deals with an objective review of modern sovereignty theory. Through the process, we discuss the possibility and necessity of the ‘theory of sovereignty’ while dealing with the ‘paradox of sovereignty’ and the ‘paradox of sovereignty theory’. In terms of exploring alternatives, three theoretical models of sovereignty theory; ‘substantial theory of sovereignty’, ‘justification theory of governance’, and ‘fiduciary theory of sovereignty’ are proposed. In conclusion, the author proposes ‘sovereignty as a symbolic form’ as another way to raise this problem, emphasizing the importance of a value-relational approach to sovereignty. This is a valuable perspective that can show that the concept of sovereignty and modern sovereignty fundamentally have problems of dominance-submission and injustice, as well as cover the phenomenon of ‘privatization of the concept of sovereignty’. Chapter #5 points out that the aspect of the recent sovereignty debate is eventually trapped in the frame of revisionist transformation of modern sovereignty concepts and theories, and calls this phenomenon the “sovereignty sting”. In this article, the author proposes the theme of ‘sovereignty as a political-legal concept’ (Thesis 1) ‘sovereignty as a value-relational function’ (Thesis 2) and ‘sovereignty as symbolic form’ (Thesis 3). Through these three thsis on sovereignty, the author discussed the essence and limitations of the concept of sovereignty and modern sovereignty theory in a multidimensional way. Finally, it concludes by emphasizing that a complete and alternative theory of sovereignty should be developed into a ‘jurisprudential theory of sovereignty’.
