파업과 불법행위책임 - 정당성 면책론에서 불법행위책임 발생 근거론으로 - (Strike and Tort Liability - From Justness Immunity Theory to Tort Liability Grounds Theory -)

초록

이 논문은 우리나라 쟁의행위 법리가 정당성 면책법리 중심의 전개, 다양한 유형별 법리 전개의 부족이라는 문제점에 대응하기 위한 것이다. 쟁의행위 법리의 핵심인 파업(집단적 노무제공 거부)과 불법행위책임 영역에서 책임 발생 근거 내지 위법성 근거 법리로의 변경을 모색하였다.
우선 파업에 대한 외국의 불법행위책임 발생 근거론을 정리하였다. 전제로서 불법행위 성립 부정론을 다루었고, 불법행위 성립 긍정론을 제삼자 채권침해론, 파업목적 평가론, 영업권 침해론, 세 가지로 나누어 다루었다. 연혁적 관점에 초점을 맞추어 법리의 변화과정을 추적하였고, 우리나라 법리에 주는 시사점에 주목하였다.
대법원 판례를 비판적으로 검토하면서 우리나라 법리 상황을 재구성하였다. 불법행위책임의 발생 근거 내지 위법성 근거 법리와 불법행위책임 귀속 내지 분배법리로 나누어 다루었는데, 책임 귀속 내지 분배법리에 책임 발생 근거 내지 위법성 근거에 관한 관점이 숨어 있음을 논증하였다. 영업권 침해론이 지배적인 상황 속에서 제삼자 채권침해론으로의 변화가 모색되고 있음을 밝혔다.
결론으로 제삼자 채권침해론으로의 전환을 주장하였다. 민사법 판례상 제삼자 채권침해론 동향을 제시하고, 이를 통해서 면책법리 관점에서 책임 발생 근거 법리 관점으로 기본 프레임을 바꿀 수 있다는 것을 내용적으로 제시하였다. 정당성 면책법리의 배제와 발생 근거 법리 대안을 제시하였다. 체계적 입법과 판례 법리의 균형적 발전이 필요함을 주장하였다.

영어초록

This thesis is intended to respond to the problems of the development concentrated on the legal theories for the justness immunity and the lack of legal theories for various types of industrial action in Korea. In the areas of strikes (collective refusal to provide labor) and tort liability, which are the core of industrial action legal theories, changes to legal theories for the liability or illegality grounds were sought.
First of all, the theories on the grounds for tort liability in foreign countries for the strike were summarized. As a premise, the theory of negation of tort was dealt with, and the theory of affirmation of tort was dealt with by dividing it into three categories: third-party claim infringement theory, strike purpose evaluation theory, and business activities infringement theory. Focusing on the historical point of view, the process of change in legal theories were traced, and their implications on Korean legal theories were paid attention to.
By critically reviewing Supreme Court precedents, I have reinterpreted the legal theory situation in Korea. The legal theory for ground of tort liability or illegality and the legal theory for attribution or distribution of tort liability were dealt with separately, and it was argued that the viewpoints on the grounds for liability or grounds for illegality are hidden in the viewpoints on attribution or distribution of liability. In a situation where business activities infringement theory is dominant, it was revealed that a change to third party claim infringement theory is being sought.
As a conclusion, I insisted on switching to the third-party claim infringement theory. In the cases of civil law, the trend of third party claim infringement theory was presented, and through this, it was suggested that the basic frame could be changed from the point of view of the legal theory of immunity to the point of view of the legal theory for the grounds for liability. Exclusion of the legal theory of immunity of justness and an alternative to the legal theory for grounds for liabilty were presented. I insisted on the need for balanced development of systematic legislation and jurisprudence.
