伯夷論, 조선 사대부의 정의론 (Boyi Theory(伯夷論), Justice Theory of The Noblemenin Joseon Nobles)

초록

본고는 伯夷論을 통해 조선 사대부들이 구축했던 ‘부정의의 부재’로서의 정의관의 한 양상을 살펴보고, 이를 자유주의 정의론자의 대표격인 존 롤스의 정의관과 연계하여 차이를 드러내고 그 현대적 의미를 찾아보는 데 주된 목적이 있다. 이를 위해 본고에서는 먼저 백이론의 근간이 되는 유교의 정의관을 먼저 점검하고, 그 토대 위에서 백이론에 투영된 정의론의 실체를 파악하였다. 나아가 조선 시대 백이론의 대표격인 김시습의 「伯夷叔齊贊」을 중심으로 서양의 정의관과 구분되는 차이를 구체적으로 드러내고 그 의미를 추출하고자 하였다.
본고에서 분석한 바에 따르면, 백이론은 유교의 仁義에 바탕을 둔 조선 사대부의 정의론이 가장 잘 구현된 텍스트이다. 김시습의 경우처럼, 단순히 논변 차원에만 머물지 않고 각자의 삶 속에 깊이 녹아든 살아 있는 정의론이다. 인의에 바탕을 둔 조선 사대부의 정의론은 관계 속에서 책임과 의무를 강조하는 방향으로 작동하여, 개인의 자유와 권리의 문제에 둔감하며 분배 정의나 사법 정의와 동떨어져 있는 것처럼 보인다. 더구나 관계 밖에서 보편적으로 요구되는 정의와 충돌할 수 있는 가능성이 늘 내포되어 있고, 합의된 절차 없이 제도와 관습 안에서 주어지는 것이기에 시대 변화에 따른 정당성 문제도 여전히 남아 있다.
그러나 개인의 자유와 권리보다 공동체의 공동선과 화합을 중시해 온 우리 사회의 윤리전통을 고려해 볼 때, 존 롤스를 비롯한 자유주의 정의론자들의 주장을 맹목적으로 따를 수만은 없다. 더욱이 존 롤즈의 정의론은 구체적인 사회경제적 조건과 관련시킬 경우 형식주의에 빠질 우려가 있다. 자유주의 정의가 문제의 대상으로 삼고 있는 불평등의 근본 원인이 분배의 문제로만 귀결되지 않으며, 공정성과 절차성을 확보한다고 해서 사회의 부정의가 일소되는 것도 아니기 때문이다.
우리가 실질적인 규범적 정의론을 구축하기 위해서는 자유주의 정의론자들이 말하는 추상적인 합리성을 통해 포착할 수 없는 수준의 부정의를 진지하게 고려할 필요가 있는데, 유교의 인의에 바탕을 둔 조선시대 사대부의 정의관은 이런 점에서 유의미한 가치를 지닌다. 특히 타인의 고통에 무관심한 자유주의 정의론의 한계를 극복하는 데 있어서 유의미한 정보를 제공할 수 있다. 자유주의 정의론의 한 대안으로서 백이론에 투영된 조선 사대부의 정의론을 다시 점검할 필요가 있는데, 특히 정의 실현에서 윤리의 역할과 가치를 이해하는 데 의미 있는 정보를 제공할 수 있다.

영어초록

This paper looks at ‘absence of injustice’ as an aspect of justice system built by Joseon nobles through Boyi theory(伯夷論), then it primarily aims at revealing differences and finding out their modern meanings in conjunction with the definition of John Rolls, a representative figure of liberal justice. For this purpose, this paper first examines the justice system of Confucianism underlying the Boyi theory and identified the substance of the justice system projected on the Boyi theory in the foundation. Furthermore, this paper tries to clarify differences and extract meanings between the Western justice system and focusd on Kim Siseup’s “Baekyisukjechan(伯夷叔齊贊)” a representative of the Boyi theory of the Joseon Dynasty.
According to the analysis of this paper, the Boyi theory is the best text realized justice system of Joseon nobles based on benevolence(仁義) of Confucianism. It is a theory of justice that has been deeply embedded in each person's life, not just in an argument like Kim Siseup’s case. Joseon nobles’ justice system based on benevolence operates to direction which emphasizes on responsibilities and duties in relationship, so this seems to separate from distribution justice or regal justice unconcerned about the issues of personal freedom and rights. Moreover, there is always the potential to conflict with the universally required justice outside of a relationship, and the question of justification as it is given within the system and customs without an agreed process still remains.
However, considering the ethical tradition of our society, which has placed importance on community coordination and harmony over individual freedom and rights, we cannot blindly follow the arguments of liberal justiceists including John Rolls. Moreover, John Rolls’s justice theory may fall into formalism when it relates to specific socioeconomic conditions. This is because the root cause of inequality as an object problem of liberalism justice is not just about distribution, and securing fairness and procedurality does not eliminate social injustice.
To build a practical normative justice system, we need to seriously consider the level of injustice that cannot be captured through abstract rationality which said by liberal justiceists. The justice system of Joseon nobles based on benevolence of Confucianism has significant value in this point. In particular, significant information can be provided in overcoming the limitations of liberalist justice, which is irrelevant to the suffering of others. As an alternative to liberal justice theory, it is necessary to recheck the justice theory of Joseon nobles projected on the Boyi theory, particularly to provide meaningful information in understanding the role and value of ethics in the realization of justice.
