적극행정에 대한 일고찰 - 국가재난을 소재로 하여 - (Study on Active Administration - Based on National disaster -)

초록

현대의 모든 법치국가는 행정에 대한 실효적 통제에 대해 계속 고민하고, 보다 나은 통제방안을 마련하고자 애써왔다. 우리나라에서는 「행정기본법」에 행정의 행위의무로 적극행정 조항이 들어감으로써 적극행정에 대한 본격적인 논의가 시작되었다. 아쉽게도 현재 적극행정에 대한 입법적 구체화는 주로 공무원의 책임을 묻고, 공무원에 대한 책임을 제한하거나 면책하는 등 공무원법 분야에 머무르고 있다. 적극행정을 공무원법 분야에 한정하여 전개해 나갈 경우의 한계는 최근 국가재난 사태에서 여실히 드러났다. 「적극행정 운영규정」과 「감사원 감사사무 처리규칙」이 모두 마련되어 있던 상태에서 이 글의 첫 부분에서 소개한 초량 지하차도 사건이 발생하였다. 능동적이고 적극적으로 임무를 수행했더라면 징계책임을 면할 수도 있고, 소극행정에 따른 징계를 피할 수도 있었을 것이며, 적극행정 우수공무원으로 선발되었을 수도 있다. 그런데, 반복되는 유사한 형태의 재난 앞에서 공무원법상 징계책임을 중심으로 구축된 적극행정 규정은 무력했다.
분명하게도, 「행정기본법」 제4조 제1항에서 적극행정의 주체는 공무원이 아닌 행정이다. 동조 2항에서도 공무원의 의무 이전에 국가와 지방자치단체가 공무원의 적극행정을 위한 제반 여건을 조성하고, 관련 시책과 조치를 추진해야 한다고 규정한다. 그런데 그 위임을 받은 「적극행정 운영규정」에서는 적극행정을 위한 구체적 사항을 공무원법의 틀 안에서 규정하고 있다. 그러나 적극행정 사례 일부에 대해 상을 주고, 적극행정시 일정한 요건 하에 책임을 면제해주고, 소극행정에 대해선 징계를 하는 것과 같은 단편적 수단으로는 결코 행정기본법이 예정하는 적극행정을 달성하기 어렵다.
향후 적극행정이 성공적으로 이루어지기 위해서는 다음과 같은 고려에 기초한 관점의 전환이 필요하다.
첫째, 적극행정이 잘 이루어지지 않는 근본적 원인에 대한 다차원적 분석이 선행된 후, 그 원인을 대응하는 해법을 찾아야 할 것이다. 단순한 징계 위협이나, 징계 면책 등은 적극행정에 대한 동기부여를 하지 못한다.
둘째, 적극행정에 대한 컨트롤타워가 인사혁신처, 감사원, 권익위원회 등으로 분산되어 있는데, 막상 적극행정을 유도하는 구체적 방법은 큰 차이가 없다. 모든 부처가 각각의 위치와 권한 범위 내에서 적극행정을 지원해나갈 수 있겠지만, 그 방법이 사실상 같다면 혼란을 실효성도 떨어뜨리고 혼란을 야기할 가능성이 높다.
셋째, 행정이 법상 주어진 권한을 스스로의 권한으로 인식하고, 책임 있게 행사할 수 있도록 행정조직법적 대응이 필요하다. 특히 행정 개별법령 안에 들어가 있는 위원회 제도가 행정의 책임성을 강화하는 방향으로 운영되도록 제도적 개선이 필요하다. 위원회의 자문내용은 행정에게 어떠한 법적 구속력을 가지는 것이 아니므로 행정은 스스로 책임있게 권한 행사를 해나갈 수 있어야 하며 이를 위해 절차와 제도가 마련되어야 할 것이다. 그래야만 개개 공무원도 보다 적극적으로 임무를 수행할 수 있다.

영어초록

All modern rule-of-law countries have been continuously thinking about the effective control of public administration and trying to come up with better control measures. In Korea, a full-scale discussion on proactive administration was initiated by the inclusion of the proactive administration clause in the general act on public administration as an obligation of public administration. However, at present, the legislative embodiment of proactive administration is mainly in the field of civil service law, such as holding public officials accountable and limiting or exempting them from liability. With both the Operating Regulations and the Rules of the Inspectorate in place, the Choryang underpass case introduced in the first part of the article occurred. If he had been proactive and actively carried out his duties, he could have avoided disciplinary liability, avoided discipline for passive administration, and been selected as an outstanding civil servant for active administration. However, in the face of repeated similar disasters, the active administration regulations built around disciplinary liability under the Civil Service Act were powerless.
Clearly, Article 4(1) of the general act on public administration states that the subject of active management is the administration, not the civil service. Article 4, paragraph 2, also stipulates that the state and local governments should create conditions for the active management of public servants and promote related measures and actions prior to the duties of public servants. However, the delegated operating regulations stipulate the specifics of active management within the framework of the Civil Service Act. Piecemeal measures such as rewarding some cases of active administration (Article 14 of the Operating Regulations), exempting liability under certain requirements for active administration, and disciplining passive administration are unlikely to achieve the active administration envisioned by the general act on public administration.
In order for active administration to be successful in the future, a shift in perspective is needed based on the following considerations.
First, a multidimensional analysis of the underlying causes of the lack of active administration should be conducted, and then solutions should be found to counteract the causes. Simple threats of discipline or immunity from discipline do not motivate proactive behavior at all.
Second, the control tower for proactive management is dispersed among the Ministry of Personnel and Innovation, the National Audit Office, and the Rights and Interests Committee, but the specific methods of inducing proactive management do not differ much. All ministries can support active administration within their respective positions and scope of authority, but if the methods are virtually the same, it is likely to cause confusion and reduce effectiveness.
Third, it is necessary to respond to the administrative organization law so that the administration can recognize the authority given by law as its own and exercise it responsibly. In particular, the committee system in individual administrative laws needs to be improved so that it operates in a way that strengthens administrative accountability. Since the advice of the committee is not legally binding on the administration, the administration should be able to exercise its authority responsibly, and procedures and systems should be in place for this. Only then will individual public servants be able to fulfill their duties more actively.
