초록

일제하 조선의 예기･창기･작부 소개업(자)은 각도에서 공포한 <소개영업취체규칙> 등에 의해 경찰서장의 허가를 받아 운영되었다. 1939년 <조선직업소개령> 실시에 즈음하여 소관기관을 도지사로 높여 감독을 강화한다는 언론 보도도 있었으나, 실제는 1940년 <조선직업소개령>이 실시된 이후에도 이전처럼 도령으로 제정된 <소개영업취체규칙> 등에 의거하여 경찰서장의 허가와 감독을 받는 형태로 운영되었다. 조선의 예기･창기･작부 소개업은 일본과 달리 여타 인사 소개업의 겸업 금지, 관외 취업 시의 부모동의서 경찰 제출 의무화, 옥외 간판 및 광고 금지 등을 시행하지 않았는데, 이것은 식민지 행정의 비인도성, 여성 인권 의식 희박, 폭력성, 식민지에 대한 제도적･일상적 차별을 드러내는 것이다.
이처럼 1931년 아시아로 파견되었던 국제연맹 조사단이 비인도적이라고 비판했던 일본의 창기 소개업보다 더 열악했던 조선 소개업의 실태는 조선인 일본군‘위안부’ 피해자들의 고통을 초래한 일차적인 요인으로 간주되기도 한다. 조선에는 속임수의 역사가 있는 대규모 모집업자가 있었지만 일본군은 사기꾼 업자와 협력하지 않았다는 램지어의 주장도 그 일환이라고 할 수 있다. 그러나 램지어가 말한 대규모 조선인 모집업자의 90% 이상은 토지･가옥 등의 중개업자이고, 조선 주둔 일본군과 경찰이 선정한 위안소 업주가 버마와 만주로 동원해 간 여성들이 사기로, 속아서 갔다는 사실은 피해자 증언은 물론 연합군과 만주국 경찰 문서에서도 나타나고 있다. 램지어의 주장은 역사적 사실과 일치하지 않는다.

영어초록

In Joseon, during the Japanese colonial period, agents who dispatched geisha, prostitutes and barmaids operated under the authorization of the Police Chief as per the Regulations on the Control of Referral Services, proclaimed by each province. There had been some media reporting in 1939 that supervision will be enhanced by having Governors oversee the agents and their services, in the run up to the implementation of the Employment Agencies Act of Joseon. These agents, however, continued to operate under the authorization and supervision of the Police Chief in accordance with the Regulations on the Control of Referral Services, which had been enacted by the relevant provincial ordinances, even after the implementation of the Employment Agencies Act in 1940. The referral services for geisha, prostitutes and barmaids in Joseon, unlike those in Japan, were not subject to the prohibition of concurrent operation of other job placement services, the mandatory submission of parental consent to the police for employment outside the respective jurisdiction, the ban on outdoor signage and advertising, etc. This reveals the inhumanity of colonial administration, the lack of awareness on women's human rights, violence, and institutional and everyday discrimination against the colony.
Joseon's prostitute agency business was even more brutal than that of Japan, which was condemned as inhuman by the fact-finding mission to Asia of the League of Nations in 1931, and such reality is sometimes considered a primary factor that caused the suffering of the Korean victims of the Japanese military "comfort women" system. What also emerges from this narrative is Ramseyer's claim that the Japanese Army did not work with fraudulent recruiters even though Joseon had a large corps of recruiters with history of deception. However, over 90 percent of these Korean recruiters, that Ramseyer mentioned, were real estate agents who engaged in land and housing transactions. Further, not only the victims' testimonies but also the documents of the Manchukuo police and the Allied Forces show that women were taken by deception and fraud to Burma and to Manchuria, by the brothel owners whom the Japanese Army and police in Joseon had chosen. Ramseyer's claim does not correspond to the historical facts.
