권한쟁의심판에서 권한침해확인 결정의 기속력 (The Binding Force of the Constitutional Court’s Affirmation Decision of Authority Infringement)

초록

국회의 법률안 변칙 처리는 입법절차의 하자로서 헌법적 통제의 대상이 되는지가 문제된다. 헌법재판소는 그동안 이에 대해 주로 권한쟁의심판을 통해 판단해왔다. 헌법재판소 설립 이후 현재까지 국회의 의안 변칙 처리와 관련된 권한쟁의심판 사건들은 총 12건에 이른다. 본 논문은 위와 같은 헌법재판소의 권한쟁의심판 사건들 중에서 제2차 미디어법안 사건(2009헌라12)을 중점적으로 분석함으로써 권한침해확인 결정의 기속력에 대한 타당성을 논증하였다. 그리고 이러한 분석을 바탕으로 국회의 입법절차의 하자에 대하여 헌법재판소가 향후 어떤 방향으로 통제해나가는 것이 타당한지에 대하여 몇 가지 대안을 제시하였다. 이를 간략히 정리해보면 다음과 같다.
첫째, 권한침해확인결정의 기속력으로서 피청구인에게 처분의 위헌·위법성을 제거하는 작위의무가 발생하는지에 대해서는 제2차 미디어법안 사건(2009헌라12)에서 과반수인 5인이 작위의무를 긍정하였다. 그러나 그 중 1인이 기속력의 구체적 실현의 한계를 이유로 기각의견을 개진하면서 법정의견으로 기각결정이 내려졌다. 이에 대하여 필자는 권한침해확인결정의 실효성을 확보하는 측면에서 피청구인에게 적극적 작위의무를 부과하는 것이 타당하며, 다만 그 방법에 있어서만 재량을 부과하는 것이 타당하다고 본다.
둘째, 필자는 입법절차의 하자를 헌법적으로 통제함과 동시에 국회의 자율권을 존중하는 측면에서 헌법재판소가 변형결정으로서 ‘잠정 유효확인’ 결정을 하는 대안을 제시하였다. 잠정 유효확인 결정은 잠정적용 헌법불합치 결정에서 착안한 새로운 개념이다. 즉 법적 안정성을 고려하여 잠정적으로 법률안 가결선포행위의 효력을 유지시키지만 피청구인에게 입법절차상 위헌·위법성을 스스로 제거하도록 일정한 개선기한을 부여하는 변형결정의 형태이다. 이를 통해 궁극적으로 국회의 의안 변칙처리 관행을 종식시키고 헌법질서를 수호하고자 한다.
셋째, 입법절차의 하자를 ‘사전적’으로 통제하기 위한 방안으로서 권한침해확인 청구와 함께 이루어지는 법률안 가결선포행위의 효력정지 가처분 제도를 활성화하는 것이 필요하다. 헌법재판소는 효력정지 가처분 신청에 대하여 신속히 판단함으로써 입법절차상 하자가 문제되는 법률이 공포·시행되기 이전에 절차적 하자를 심사해야 한다. 이러한 효력정지 가처분 제도의 활성화는 국회의 법률안 변칙 처리를 예방하는 부수적인 기능도 수행할 것이다.
넷째, 이제는 우리나라에도 독일의 추상적 규범통제 제도 또는 프랑스의 사전적·예방적 규범통제 제도를 도입하여 입법절차의 하자를 통제할 수 있는 다양한 통로를 마련해야 한다.
헌법재판소는 이러한 대안들을 통해 권한쟁의심판에서 권한침해확인 결정의 실효성을 담보할 수 있고, 국회 입법절차의 하자를 보다 효과적으로 통제하여 헌법의 최후 수호자 역할을 수행해 나갈 수 있을 것이다.

영어초록

The Constitutional Court has dealt with the defects of the legislative process of the National Assembly mainly by competence dispute adjudications. Since the Constitutional Court was established, there have been twelve constitutional reviews on the defects of the legislative process. This thesis studied the Constitutional Court's reviews and argued the validity of the binding force of the constitutional court's affirmation decision of infringement on the plaintiff's right, as analyzing 2009 Hun-Ra 12 decisions. Also, Based on this study, this thesis suggests an alternative to the foregoing constitutional review on the defects of legislative process. It may be summarized as follows: First, in 2009 Hun-Ra 12, where the Constitutional Court judged whether the respondent have an obligation to remove the unconstitutionality and unlawful elements by the binding force of the constitutional court's affirmation decision of infringement on the plaintiff's right prescribed under Article 66 section 1 of the Constitutional Court Act, Five justices decided that the respondent have a duty to remove the unconstitutional and unlawful elements caused by himself or herself. But one of them concluded that the plaintiffs' petition of the instant case shall be denied due to the lack of merits for the reasons of a ceratin limitation on the binding effect of the Constitutional Court's decision of infringement on the right or the authority. Consequently, the Constitutional Court held that the plaintiffs' petition for the competence dispute adjudications should be denied.
In my opinion, the decision of admission, which imposed a duty to remove the unconstitutional and unlawful elements caused by himself or herself on respondents, should be regarded as a reasonable opinion for the security of the effectiveness of the Constitutional Court's declaratory decision of authority infringement. But it is only reasonable when the respondents were given the discretion in the way that they remove the unconstitutional elements.
Second, this thesis suggests an alternative concept of the constitutional court's declaratory decision, ‘The decision of temporary valid’, which is a new concept of ‘Variable Decision(Constitutional Court's unique decisions neither constitutional nor unconstitutional)’. ‘The decision of temporary valid’ is a decision that requests the National Assembly to remove the procedural defects by a certain period of time while having the announcement of the passage of the bills remain effective until that time for the legal stability. Through this decision, it can be possible to respect both the Constitutional Court's declaratory decision on the defects of the legislative process and the discretionary authority of National Assembly at the same time.
Third, as a way to control the defects of legislative procedure ‘in advance’, it is necessary to vitalize the Constitutional Court's preliminary injunction of banning the effects of the bills that have the defects of legislative process.
Fourth, from now on, we should introduce the systems of Germany's abstract control of norms and French's proactive and preventive norm control. Through these, we would find various ways to control the defects of legislative process.
Ultimately, the foregoing ways can make the Constitutional Court be able to function as a guardian of the Constitution by reviewing the defects of legislative process more effectively.
