‘양심적 병역거부’에 대한 헌법재판소 결정의 의미와 남은 과제— ‘헌재 2018. 6. 28. 2011헌바379 등’을 중심으로 — (Implications of the Constitutional Court's Decision on Conscientious Objection to the Military Service and Remaining Tasks)

초록

양심적 병역거부는 종교적･윤리적･도덕적･철학적 또는 이와 유사한 동기에서 형성된 양심상 결정을 이유로 집총이나 군사훈련을 수반하는 병역의무의 이행을 거부하는 행위를 말한다. 양심을 포기하지 않고서는 집총이나 군사훈련을 수반하는 병역의무를 이행할 수 없고 병역의무의 이행이 자신의 인격적 존재가치를 스스로 파멸시키는 것이기 때문에 병역의무의 이행을 거부한다는 것이다.
2018년 6월 28일 헌법재판소는 그동안의 결정과는 달리, 병역의 종류를 현역, 예비역, 보충역, 병역준비역 및 전시근로역으로 한정하여 규정하고 헌법 제19조에 따른 양심의 자유에 따른 병역거부자를 위한 대체복무제도를 규정하지 아니한 「병역법」 제5조 제1항 등에 대하여 헌법에 합치되지 아니한다는 결정을 내리면서 개정시한을 2019년 12월 31일로 정하였다. 앞으로 국회는 병역법을 개정하고, 대체복무를 위한 새로운 법률을 제정해야 한다.
대체복무의 기간과 분야와 관련하여 헌법재판소의 결정과 국제인권기준을 종합할 때, 복무기간은 현역복무기간의 1.5배가 적절하며, 복무분야는 노인･장애인･중증환자 등의 보호･치료･요양 등 사회복지 관련 업무 또는 소방･보건･의료･방재･구호 등 공익 관련 업무가 바람직하다. 양심적 병역거부자의 판단 과정에서는 신청인의 가정환경, 성장과정, 학교생활, 사회경험 등 삶의 전체적인 맥락에서 확고한 신념을 가지고 있었다면 양심적 병역거부로 인정할 수 있을 것이다. 대체복무제 시행을 앞두고 양심을 이유로 한 병역기피자가 많으리라는 우려가 크지만 이미 대체복무를 실시했던 나라들의 예를 보면 충분히 예방이 가능하다고 본다.
국제사회에서 양심적 병역거부가 인간의 기본권으로 받아들여지고 있음에도 한국 사회에서는 최근까지 법적 처벌의 대상이 된 가장 큰 이유는 분단의 산물인 국가주의와 군사문화의 영향 때문일 것이다. 적잖은 국민들이 대체복무제가 병역 기피의 수단이 될 가능성을 우려하고, 종교적 신념과 양심이 국가안보보다 우위일 수 있는지, 소수자에 대한 관용 때문에 병역의무를 치르는 다수의 존재성은 무시해도 되는지에 강한 의문을 갖는 이유를 분단의 토양에서 찾을 수밖에 없다. 양심적 병역거부로 인한 사회적 갈등을 해소하기 위해 중요한 것은 군대 안 가는 사람에게 군대에서 겪는 어려움을 겪도록 하는 것이 아니라, 군대를 갔다 온 것이 더 이상 억울한 일이 되지 않도록 복무환경과 병영문화를 개선함으로써 인권친화적인 군대로 탈바꿈하는 것이다.
이번 헌법재판소의 결정은, 그 동안의 다분히 감정적이고 비생산적인 개념 논쟁에서 벗어나 대체복무제의 내용과 기간 등 그 내용에 관한 생산적인 논의로 나아가게 된 것에서 의미를 찾을 수 있으며, 소수자에 대한 관용을 통해 한국사회의 민주주의가 한층 성숙하는 계기가 될 것으로 기대한다.

Conscientious objection refers to the refusal to fulfill military obligations involving handguns or military training on the grounds of conscientious decisions formed from religious, ethical, moral, philosophical or similar motives. Without giving up the conscience, he cannot fulfill the military duty involving the gun or military training, and refuses to fulfill the military duty because fulfillment of the military duty destroys the value of his or her personal existence.
Unlike the previous decision, the Constitutional Court on June 28, 2018 restricts the types of military service to active duty, reserve service, supplementary service, military service preparation and wartime labor, and conscientious objectors based on freedom of conscience under Article 19 of the Constitution. The deadline for amendment was set as December 31, 2019, with the decision not to conform to the Constitution with respect to Article 5, paragraph 1, etc. of the Military Service Act, which does not provide an alternative service system for the public. In the future, Congress should amend the Military Service Law and enact new laws for alternative service.
When combining the decision of the Constitutional Court and international human rights standards with respect to the duration and field of alternative service, the service period is 1.5 times longer than the active service period. Social welfare related work, or public welfare related work such as fire fighting, health care, medical care, disaster prevention, and relief are desirable. In conscientious objectors' judgment, conscientious objection will be recognized if they have firm beliefs in the overall context of life, including the applicant's home environment, growth process, school life, and social experience. There is a great concern that many conscientious objectors will be avoided due to conscience before the implementation of alternative service, but the examples of countries that have already provided alternative service are sufficiently preventable.
Although conscientious objection is accepted as a basic human right in the international community, the biggest reason for legal punishment until recently in Korea is the influence of nationalism and military culture, the product of division. Many people are concerned about the possibility of alternative military service as a means of avoiding military service, and the strong question of whether religious beliefs and conscience can outweigh national security, and whether the majority of military service due to tolerance of minorities can be ignored. The reason for having it is found in the soil of division. The key to resolving the social conflict caused by conscientious objection to military service is not to make it difficult for non-military people to suffer in the military, but to improve human rights by improving service conditions and English translation so that it is no longer unfair To turn into a friendly army.
The decision of the Constitutional Court can be found in the process of moving away from the much emotional and unproductive conception debate in the past and into a productive discussion of the contents and duration of the alternative service system. It is hoped that democracy in society will become an opportunity for further maturity.
