주택재개발사업구역 토지등소유자의 서면동의에 관한 인식연구 (A Study on Landowners' Understanding of Written Consent in the Housing Redevelopment Project District)

초록

본 연구의 목적은 주택재개발사업구역 토지등소유자의 서면동의에 관한 인식을 이해하는 것이다. 이에 본 연구는 부천시 원미재정비촉진지구 내 원미 6B구역과 춘의 주택재개발사업구역의 토지등소유자를 중심으로 추진위원회 및 조합구성 시 서면동의제도에 대한 인식을 연구하였다. 그 결과 서면동의제도에 대한 인식조사에서 40대와 고학력, 월 소득이 많을수록 잘 알고 있었으나 저소득층과 저학력 그리고 다른 연령층의 경우 이에 대한 인식정도가 매우 낮은 것으로 나타났다. 또한 서면동의서는 OS요원의 권유로 대부분 제출했으며 제출 시 일반적 내용(청산금, 무상지분율 부담) 등의 설명을 듣지 못한 응답자가 많은 것으로 나타났다. 서면동의서 제출 시 적정한 징구율은 응답자의 대부분이 20%에서 40%정도가 적당하다고 응답하였다. 따라서 서면동의서 징구 시 조합이나 전문가, OS요원을 통한 사전 사업설명이나 단체 및 그룹별 교육이 필요하며 토지등소유자가 직접참석 할 수 있도록 서면동의서 징구율역시 40% 이하로 제한하는 법 제도 개정이 필요하다. 그리고 서면동의서를 징구하는 OS요원의 자격제한이 없어 이들에 대한 철저한 사전교육과 충분한 실력배양을 통한 의무교육실시 후 자격자에 한하여OS요원이 될 수 있도록 법 제도를 개선해야 한다.

영어초록

The purpose of this study was to understand Landowners' awareness of Written Consent in the Housing Redevelopment Project District. This study attempted to investigate the awareness of the written consent system at the time of establishing the promotion committee and the association among landowners within the Wonmi 6B district within the Bucheon City Wonmi regeneration promotion district and Chuneui housing redevelopment project district. As a result, the residents, who were in their 40s and had the high educational level and monthly income level, had a good awareness of the written consent system. But the residents, who had the low monthly income and educational level and belonged to the other age groups, had a very low awareness of it. And it was found that most of the respondents submitted the written consent by the recommendation of the OS member, when the member did not explain its general contents(liquidation money, burden of the gratuitous share rate) to many of the. Most of the respondents said that the proper request rate of the written consent is 20%～40% at the time of submitting the written consent. It was found that it is desirable to put a restriction on the request of the written request. So it is necessary to provide landowners with prior project presentation or collective or group education through the association, specialist or OS member at the time of requesting them to submit the written consent. And it is necessary to amend laws and systems which restrict the request rate of the written consent to below 40% for landowners to take personal part in it. And there are no restrictions on qualifications for the OS personnels requesting for the written consent. So it is necessary to improve laws and systems for only qualified persons to become the OS personnel after the provision of compulsory education through their thorough prior education and sufficient ability improvement.
