집합건물 법제에서 인공지능 등 디지털기술의 응용 (Legal Issues of Digital Technology in the Condominium Buildings)

초록

오늘날 주거와 상거래에서 집합건물은 주된 인프라로 자리 잡고 있고, 향후 미래에서도 인공지능기술이 탑재된 고도화되고 스마트화된 집합물이 주를 이룰 것이다. 이를 위해 집합건물 법제도 더욱 고도화되고스마트화될 필요가 있어서 그에 관한 쟁점을 간략히 살펴본다. 제4차 산업혁명의 디지털 기술(빅데이터, AI, 블록체인 등)은 생활 방식(lifestyle)의 변화를 가져와 주거용 집합건물과 상업용 집합건물에도 적지 않은 변화를 만들 것이다. 이는 기회일 수도 있고 위협일 수도 있어서 관련된 법적 쟁점을 해결하기 위한 다각적이고 혁신적인 접근이 필요한 것이다. 디지털기술이 집합건물에 응용된다면 생활이 편리해지고, 상거래에 도움이 되는 등 유익한 점이 많겠지만, 이렇게 밝은 면만 있는 것은 아니며 어두운 면도 있을 것이다. 예를 들어 스마트빌딩에서인공지능 기술에 의한 오작동으로 사고 재난이 발생하거나 개인정보 침해. 알고리즘에 의한 안면인식 편향성이나 집합건물 의사결정에서 오류가 드러날 수 있다. 인공지능기술에 의한 미래 예측 기술은 과거의 데이터를 기반으로 한 것이므로 과거의 잘못된 관행이나 오류가 반복 답습될 우려가 크다. 이 경우 부정적 알고리즘이나 데이터에 의한 피해규모는 천문학적일 수 있다. 제4차 산업혁명 시대의 집합건물 법제에서도 디지털 과학기술과 인간이라는 양자 사이에서 휴머니티를 극대화하는 디지털 혁명, 로마법에서 그러하였듯이 선(善)과 형평(衡平)을 모색하려는 노력이 필요할 것이다. 그것은 온전히 집합건물법 학계가 집단지성을 발휘하여 추구해야 할 몫으로 본다.

영어초록

Recently condominium buildings are positioned in residential and commercial transactions as the main infrastructure, and in the future, advanced and smart collective buildings equipped with artificial intelligence technology will dominate. To this end, the collective building law system needs to be further advanced and smart, so we briefly review the issues related to it.
The technologies of the 4th industrial revolution (big data, AI, block chain, etc.) will bring about a change in lifestyle, which will also make considerable changes in residential and commercial buildings. This can be both an opportunity and a threat, requiring a multifaceted and innovative approach to resolving related legal issues. If artificial intelligence technology is applied to a collective building, there will be many benefits such as convenience in life and help in commerce, but there will be a dark side as well as such a bright side. For example, in a smart building, an accident or disaster occurs due to a malfunction caused by artificial intelligence technology or personal information is violated.
Algorithmic facial recognition bias or bias in collective building decision-making may be revealed. Since the future prediction technology by artificial intelligence technology is based on past data, there is a high risk of repeating wrong practices or errors of the past. In this case, the damage caused by negative algorithms or data can be astronomical.
Even in the collective building legislation system in the era of the 4th industrial revolution, efforts will be needed to seek goodness and equity, just as it was in the Roman law, a digital revolution that maximizes humanity between digital science and technology and human beings. I see it as the role that the collective building law academia should pursue by exerting its collective intelligence.
