우리나라 성매매정책에 대한 인식조사 : 유흥업소 내 여성종업원들의 인식조사 및 업주들의 심층면접을 중심으로 (Investigation of Recognition on Domestic Policies on Sex Trafficking : Centered on Recognition Investigation of Women in Merrymaking Places and In-depth Interviews with Owners)

초록

2004년 성매매특별법이 시행된 후 집창촌에 대한 집중적인 단속이 벌어지면서 성매매는 더욱 음성화되는 양상으로 변질되었을 뿐 근절의 기미는 보이지 않고 있다. 인신매매나 선불금 등의 이유로 어쩔 수 없이 성매매를 하였던 여성들은 피해자로서 보호받고 국가의 지원을 받게 되었지만, 여전히 많은 수의 성매매여성들은 성매매특별법의 보호대상인 ‘피해자’가 아니라 불법적으로 성을 매매하는 여성일 이들의 인권은 여전히 사각지대에 놓여있다.
이 연구는 특정 페미니즘 시각이나 형사정책적 논쟁을 뛰어 넘어 보다 합리적인 성매매 정책 및 성매매여성의 인권향상이라는 현실적인 문제에 초점을 두고 성매매 합법화에 대한 가능성을 살펴보고자 시작되었다. 이에 성매매 합법화와 관련된 문제들에 대하여 유흥업소 내 여성종업원을 대상으로 인식조사를 실시하였고, 업주들을 대상으로 심층면접을 실시하였다.
인식조사 결과, 성매매 합법화가 바람직하다는 비율이 86%로 높게 나타나 합법화에 대한 그들의 열망을 엿볼 수 있었다. 또한 합법화 이후 성매매에 종사하게 된다,
그들에게 주어질 의무로서의 세금징수 및 근로자등록절차를 이행할 것인가에 대해 긍정적인 대답이 각각 71%와 49%로 나타났다. 업주들에 대한 심층면접 결과, 성매매 합법화가 성매매여성들의 근로환경이나 권익신장에 이로울 것이라고 응답하였으며, 업주들 역시 세금을 내고 몇 가지 의무사항을 이행하면서 합법적으로 영업하는것이 더 낫다는 반응을 보였다.
이와 같은 결과는 국가가 제대로 된 성매매정책을 마련하고 적절하게 관리․감독한다면, 성매매 합법화가 우리사회에서 성공을 거둘 가능성이 있음을 보여주고 있다. 성매매 합법화가 야기할 악영향을 도외시 할 수는 없지만, 현재의 성매매정책이 성매매근절을 가져올 수 없다면 보다 합리적인 성매매정책 마련에 고심하여야 할 것이다.

영어초록

Since the Acts on the Punishment of Procuring Prostitution was enforced in 2004 and intensive control was performed on red-light districts, sex trafficking has gotten even more negative without any sign of eradication. Prostitutes who had to do sex trafficking because of human traffics or advance payment were protected as victims and supported by the nation, but still many women are not ‘victims’ as the subject of protection by the Acts on the Punishment of Procuring Prostitution. A majority of women are only prostitutes illegally doing sex trafficking and therefore, their human rights are still in a blind spot.
The purpose of this study is to identify the possibility of legalization of sex trafficking when focused on real problems including more reasonable policies on sex trafficking and improvement of the human rights of prostitutes rather than specific feministic views or discussions of criminal policies. For doing this, the author investigated the recognition of women in merry-making places and performed in-depth interviews with the owners on problems related to the legalization of sex trafficking.
The results of the recognition investigation, 86% said the legalization of sex trafficking is reasonable, which indicating their desire for the legalization. Also, 71% and 49%, respectively, answered positively when asked of their duty performance including tax and employee registration procedure, if they may be engage in sex trafficking after the legalization.
The results of the in-depth interviews with the owners showed that they said the legalization would be beneficial to improve the working environments or rights and interests of prostitutes, answering that it would be better to legally run their places with paying taxes and performing several duties.
Such results indicate that the legalization of sex trafficking might be successful in our society when the government prepares satisfactory polices and performs appropriate management and surveillance. The mischief of the legalization of sex trafficking cannot be ignored, but it is needed to make an effort to prepare more reasonable policies on sex trafficking when the existing policies fail to eradicate sex trafficking.
