동아시아의 시민사회 비교 연구: 시민단체(NGOs) 관련 법과 현황을 중심으로 (Comparative Study of Civil Society in East Asia: Focusing on the laws and current status of NGOs)

초록

본 연구는 그동안 연구의 사각지대였던 동아시아 3국의 시민사회에 대한 체계적인 비교 분석을 시도하였다. 먼저, 본 연구는 세 나라의 시민단체(NGO)의 형성과 발전에 중대한 영향을 미치는 법률, 즉 한국의 <비영리민간단체지원법>(2000), 중국의 <사회단체등기관리조례>(1998), 일본의 <특정비영리활동촉진법>(1998)의 주요 내용과 특징, 시민사회에 미치는 영향력을 설명하였다. 또한, 해당 법률이 포괄하는, 정부에 의해 등록·인증된 단체의 현황(한국은 15,460개, 중국은 894,162개, 일본은 50,860개)과 분포, 활동 분야 등을 살펴보았다. 이를 통해 발견된 사실은 다음과 같다. 첫째, 세 나라 모두 비슷한 시기에 시민단체(NGO) 관련 법률이 제정되었는데, 한국과 일본은 시민단체의 ‘아래로부터의 요구’가, 중국은 개혁개방 이후 증가해 온 시민단체에 대한 정부의 체계적인 관리 및 규제라는 ‘위로부터의 필요’가 법 제정의 동인(動因)이었다. 또 다른 공통점으로는 관련 법률 제정 이후 시민단체의 가파른 양적 성장과 제도화의 효과, 그리고 지난 20년 동안 절차의 간소화와 투명화라는 행정개혁의 일치된 방향을 확인할 수 있었다. 한편 행정 규제의 차이점 역시 작지 않은데, 일본은 정부의 개입 수준이 상대적으로 낮은 인증·인가제를, 중국은 엄격한 허가제를 채택하고 있다. 한국은 그 중간수준인 인증제와 공익법인에 대한 허가제를 병용하고 있다. 본 연구는 단일한 지표와 방법론에 의한 국가별· 지역별 시민사회 비교연구를 위한 기초 작업으로서의 의의가 있다.

영어초록

This study attempted a systematic comparative analysis of the civil society of the three East Asian countries, which had been a blind spot for research. First, this study examines the laws that have a significant impact on the formation and development of NGOs in the three countries, <Nonprofit-Nongovernmental Organization Support Act(2000)> in South Korea, <Regulations on the Registration and Management of Social Organizations(1998)> in China, and <law to promote specified nonprofit activities(1998)> in Japan. In addition, the current status of organizations registered and certified by the government (15,460 in Korea, 894,162 in China, and 50,860 in Japan) covered by the related law, distribution, and field of activity were examined. The facts discovered through this study are as follows. First, laws related to NGOs were enacted in all three countries around the same time. In South Korea and Japan, the ‘pressure from below’ of civic groups was the primary cause of legislation.
On the other hand, in China, the “need from above” of the government’s systematic management and regulation of civic groups, which has increased since reform and opening up, was an important driving force. Another common feature was the rapid quantitative growth of civic groups and the effect of institutionalization after the enactment of related laws, and the consistent direction of administrative reform over the past 20 years of simplification and transparency of procedures. Differences in administrative regulations are also evident. Japan adopts a certification/accreditation system with a relatively low level of government intervention, while China adopts a strict permit system. On the other hand, Korea is at an intermediate level between the two countries, and uses both the certification system and the permit system for public interest corporations.
This study is meaningful as a basic work for a comparative study of civil society by country and region using a single indicator and methodology.
