동의대 사건 등 희생자의 명예회복 및 보상에 관한 연구 (The Study on The Draft of The Law on Dong-eui University Case Victim's Honor-restoration and Compensation)

초록

경찰은 사회공공의 안전과 질서를 유지하기 위하여 명령ㆍ강제 등의 권력적 수단을 사용하여, 경찰위반상태가 발생한 경우 강제력에 의하여 사회공공의 안녕과 질서를 확립하는 것이다. 그러나 경찰은 직무의 특성상 위험한 상황에 놓일 개연성이 크고 피해를 입을 수 있는 빈도 또한 매우 높다고 보아야 할 것이다. 그럼에도 불구하고 사회질서유지와 국민들의 재산 및 신체를 보호하는 직무를 수행하는 과정에서 피해를 입은 경찰관이나 그 유족들에 대한 구제제도는 상대적으로 미흡하고 소극적인 것이 사실이다. 이런 맥락에서 보면 1989년 5월 3일에 발생한 부산 동의대 사건이 대표적인 한 예가 될 것이다.
1989년 5월 3일 발생한 부산 동의대 사건은 학내 입시부정에 대한 진상규명을 요구하며 과격시위를 벌이던 학생들이, 전경 5명을 강제 납치하여 감금하였고 이를 구출하려는 경찰에게 신나를 뿌리고 화염병을 던져 경찰관 7명이 사망하고, 10명이 부상을 당한 사건을 말한다. 대법원은 이 사건과 관련된 31명에 대하여 방화치사죄 등을 적용하여 징역 2년에서부터 무기징역까지를 선고하였다.
2000년 1월 12일 민주화운동 관련자 명예회복 및 보상에 관한 법률이 공포되고 2000년 8월 9일 국무총리 산하 보상심의위원회가 설치되었다. 그 후 2002년 4월 27일 민주화운동 관련자 명예회복 및 보상심의위원회는 이 사건 시위관련자 46명을 민주화 운동으로 인정하고, 그 중 39명에 대해서는 최대 6억 원 등 1인당 평균 약 2,500만원의 보상금을 지급하였다. 반면 동의대 사건 당시 순직경찰관에 대해서는 근무연수에 따라 1인당 최저 1,479만원에서 최고 3,192만원, 순직 전의경에 대해서는 1인당 430만의 유족보상금이 지급되었다. 이처럼 2000년대에 들어서기까지 이렇다 할 순직ㆍ공상경찰공무원에 대한 구제제도 없이 일반 공무원에 준하는 보상제도가 행하여지고 있었다. 이에 정부차원에서 동의대 사건 당시 순직하거나 부상을 당한 경찰관과 그 유족의 명예를 회복하고, 당시 손해전보체계상으로 미흡했던 유족과 부상자 등에 대한 특별보상금 등을 지급하기 위하여 한나라당 이인기 의원이 2009. 7. 10 “동의대사건등희생자의명예회복및보상에관한법률안”을 발의하였다. 본 연구는 한나라당 이인기 의원이 발의한 동 제정안에 대하여첫째, 동의대 사건 관련자 민주화운동 인정경위와 유족측이 헌법소원 제기 등 불복경위과정을 살펴보고,둘째, 이에 대한 헌법재판소의 결정요지에 대한 타당성 여부와셋째, 동 법률안(案)의 주요내용에 대하여 구체적으로 검토하여 입법취지의 타당성과 당위성을 고찰해보고자 하는 것이 주목적이다.

영어초록

The police use the authorized measures in order to maintain public safety and order through commands and compulsions, when offensive conditions occurs. It is obvious that the professional nature of the police has high possibility to be in dangerous situation and damaged. Nevertheless, it is true that the relief system for damaged police officers and their families is relatively insufficient and passive, even though the police get damaged to maintain public order and protect people's property and safety. In this context, "The Busan Dong-eui University Case" which happened on May 3rd, 1989 would be the typical example.
"The Busan Dong-eui University Case" which happened on May 3rd, 1989 is that the violent protesters forcibly kidnapped and illegally confined five riot police officers and then killed seven police officers and gave damage to ten riot police officers who tried to save detained riot police. They used paint thinner and firebombs against police. The Korean Supreme Court sentenced thirty-one criminals involved with the case from two years in prison to life in prison in accordance with the arson homicide charge.
The Commission for the Democratization Movement Activist's Honor-restoration and Compensation were established under the Prime Minister's office on August 9th, 2000, since <The Law on the Democratization Movement Activist's Honor-restoration and Compensation> had been published on January 12th, 2000. After that, the commission accepted forty-six people related to "the Dong-eui University Case" as the activists for democratization movement. Thirty-nine people of them were provided with compensation of approximately 25 million won each person. The highest compensation was 600 million won. On the other hand, the families of the killed police officers were provided whit the compensation from 14,79 million won to 31.92 million won under the working period, and also the families of the killed riot police officers were given 4.3 million won per person. The police officers who died in duty had been compensated in accordance with government officer's compensation system without proper relief system for police officers until the year 2000s. For this reason, the Nation Assembly member Lee, In-ki from the Grand National party submitted <The Law on Dong-eui University Case Victim's Honor-restoration and Compensation> in order to regain the honor of the police casualties and pay special compensation to their families. The purpose of this study is to consider the law launched by Mr. Lee, In-ki with following three points.
First, this study examines the reason why "The Dong-eui University Case" subjects were accepted as the activities of democratization movement, and how come the families sued the constitutional appeal.
Second, it reviews the appropriateness of the decision decided by the Constitutional Court of Korea.
Third, this study scrutinizes the main contents of the law and inquires into the appropriateness and justification of legislative purpose.
