제20대 국회에서 발의된 법원조직법 개정안에 대한 헌법적 분석 - 대법원장의 사법행정권을 중심으로 - (A constitutional analysis on the revised bills of the Court Organization proposed during the 20th National Assembly - Focusing on the judicial administrative authority of the Chief Justice -)

초록

현행 제6공화국 헌법은 통치구조의 조직과 구성 면에서 권력분립의 원리가 비교적 잘 반영되어 있는 민주법치국가 헌법으로 평가를 받는다. 현행 헌법이 시행된 이후 정치 영역인 입법부와 행정부 부문에서는 민주주의 원리를 구현하기 위한 다양한 노력이 꾸준히 전개되었고 상당한 성과도 거두었다. 정치 영역에서 일정한 성과를 달성하게 되자 사법부의 민주개혁을 갈망하는 국민의 여론이 높아졌다. 국민의 사법부 민주개혁 여론은 대법원장의 권한을 합리적으로 조정하는데 초점이 맞추어졌다. 현행 헌법 아래에서 대법원장은 주권자인 국민의 직선으로 선출되지 않아 민주적 정당성이 미약함에도 불구하고 과도한 권한이 대법원장에게 집중되어 있기 때문이다. 그래서 제20대 국회에서도 대법원장의 사법행정에 관한 권한을 제한 내지 축소하는 것을 목적으로 다수의 법률안이 발의되었다. 발의된 법률안은 크게 현행 대법관후보추천위원회의 위원 구성을 다양화하는 것을 내용으로 하는 법률안과 현행 사법행정체제를 뛰어넘어서 새로운 사법행정기구를 신설하여 대법원장의 사법행정권한을 이 기구로 이관하는 것을 내용으로 하는 법률안으로 구분할 수 있다. 이러한 법률안들은 민주적 정당성에 비례하여 대법원장의 사법행정권을 제한하는 것을 내용으로 하는 것인데 사법권 독립의 원칙과 현행 헌법 규정과 조화를 이루는지는 의문이다. 대법원장의 사법행정권한을 민주적 정당성에 비례하여 합리적으로 조정하는 것도 물론 민주주의 원리에 비추어 요청되는 작업이지만 헌법상의 기본원리인 사법권 독립의 원칙 및 헌법 조항과 조화를 이루어야 헌법적 정당성이 인정된다.

영어초록

The Constitution of the Sixth Republic is evaluated as a democratic constitution whose principle of separation of powers is relatively well reflected in the organization and composition of the governing structure. Since the implementation of the current Constitution, various efforts to embody democratic principles in the legislative and administrative sectors, both political areas, have been steadily developed and have been quite effective. With certain achievements achieved in the political arena, public opinion has risen that yearning for democratic reform in the judiciary. The people's opinion of democratic reform in the judiciary was focused on rationalizing the power of the Chief Justice. It is because the excessive authority is concentrated on the Chief Justice despite his weak democratic legitimacy. Thus, a number of bills were proposed in the 20th National Assembly with the aim of limiting or reducing the Chief Justice's authority over judicial administration. The proposed bill can be divided into one that calls for diversifying the composition of Justice nomination committee and another that calls for the creation of a new judicial administrative body beyond the current judicial administrative system. These bills are intended to limit the judicial administrative authority of the Chief Justice in proportion to democratic legitimacy, which is questionable whether they harmonize with the principle of judicial independence and current constitutional articles. Rational adjustment of the judicial administrative authority of the Chief Justice in proportion to democratic legitimacy is of course a request in light of democratic principles, but constitutional legitimacy is recognized only when it is harmonized with the basic principles and provisions of the Constitution.
