수사 단서로서 고소ㆍ고발의 지위에 관한 고찰 (On the Position of ‘Filing a Criminal Complaint’ as the Clue of the Criminal Investigation)

초록

수사의 단서 중 고소ㆍ고발ㆍ자수는 형사절차상 다른 수사의 단서와 달리 취급되고 있다. 다른 수사의 단서는 수사기관이 단서를 통해 범죄의 존재 여부를 확인하는 절차를 거쳐 범죄혐의가 있다고 사료하는 때에 인지하여 수사가 개시되지만, 고소ㆍ고발ㆍ자수는 즉시 수사가 개시된다. 즉 내사의 단계를 거치지 않는 것이다. 이 중 고소ㆍ고발의 경우, 고소ㆍ고발이 있게 되면 내사단계를 거치지 않고즉시 수사를 개시하게 된다는 점 때문에 이를 악용하여 순수한 피의자 처벌의 목적보다는 채권변제 등 다른 민사적 목적을 위하여 고소를 남발하게 되는 ‘고소남용 현상’이 발생하고 또한 억울한 피의자를 양산하고 있다. 이는 형사절차 및실무상 많은 문제점을 야기한다. 이에 대해 선행연구는 고소남용 현상을 해결하기 위해 여러 개선방안을 제시하여 왔고, 수사기관에서도 몇몇 제도를 시행하고있다. 그러나 고소남용과 억울한 피의자 양산 현상을 막기 위해서는 수사의 단서로서 고소ㆍ고발의 지위에 대한 보다 근원적인 고찰이 필요하다. 생각건대, 고소ㆍ고발이 다른 수사의 단서보다 특별히 취급될 이유는 전혀 없어 보인다. 고소또는 고소인의 개념은 범죄를 전제로 한 개념이고 이러한 범죄에 대해 혐의유무를 확인하는 것은 수사기관의 역할이므로 고소ㆍ고발 또한 그것이 고소ㆍ고발의개념을 충족하는 것인지를 수사기관에서 먼저 확인하는 절차가 필요한 것이다.
이것은 다른 수사단서들이 내사단계를 거치는 것과 동일하다. 따라서 고소ㆍ고발은 다른 수사의 단서와 같은 차원에서 다루어져야 한다. 이것을 전제로 한다면고소를 한 고소인과 고소를 하지 않은 피해자도 같은 피해자로서 형사절차상 동일한 지위를 누릴 수 있는 것이다.

영어초록

Among the clues of the investigation, the victim’s complaint is treated differently from other clues in the criminal procedure. The clues of other investigations are recognized and investigated when the investigative agency determines that there is a suspicion of a crime after going through a procedure to check the existence of a crime through the clues, but in the victim’s complaint the investigation begins immediately. In other words, it does not go through the step of internal investigation. The fact that the investigation is initiated immediately without going through the internal investigation stage, has led to a "overuse of complaints" for other civil purposes such as repayment of claims rather than pure punishment. This causes many problems in criminal proceedings and practice.
In this regard, prior studies have suggested various improvement measures to resolve this phenomenon of abuse of accusations, and investigation agencies are also implementing some systems. However, in order to prevent the phenomenon of overuse of complaints, a more fundamental consideration of victim’s complaints as a clue to the investigation is necessary. I think, there seems to be no reason why victim’s complaints are treated more specifically than other investigation clues. In particular, we cannot agree on the view that victim’s complaints should be treated specially to protect victims. This is because, in criminal procedure, it is more rational that both victims who file a complaint and victims who have not filed a complaint should be protected to the same level. In comparative law, there are more legislative examples that do not specifically treat complaints and accusations than other investigation clues.
Therefore, if the Criminal Procedure Act is revised in the direction of putting the charges and accusations in the same position as the clues of other investigations according to such legislation, a complicated logical structure centered on the screening system will not be necessary
