전자감독제도 시행 10년의 성과와 향후 과제 (Outcomes and Future Challenges of the 10 years of electronic supervision system)

초록

우리나라에 전자감독제도가 도입된 지 10년을 맞이하여, 본 논문은 지난 10년간의 전자감독제도의 시행 및 그 성과와 관련된 통계와 설문조사 자료에 기반해서 전자감독제도의 성과를 평가해보고 향후 효율적인 운영과 성과향상을 위한 개선방안을 제시하는 데 연구목적이 있다. 이러한 연구목적을 달성하기 위해서 본 논문은 네 부분으로 구성하였다. 첫 번째 부분은 전자감독제도의 성과에 관한 것으로 전자감독의 특별예방효과에 초점을 맞춰 지난 10년간 전자감독의 성과를 평가하였다. 두 번째 부분은 전자감독제도의 성과를 균형적인 시각에서 평가하기 위해서 전자감독의 의도치 않은 결과인 전자감독이 대상자의 일상생활 및 심리·정서에 미치는 부정적인 영향을 평가하였다. 세 번째 부분에서는 전자감독제도의 운영과정에서 나타난 여러 쟁점과 이러한 쟁점들이 성과에 미칠 영향을 분석하였다. 마지막부분에서는 전자감독제도의 효율적이고 효과적인 운영을 위한 개선방안을 제시하였다.
구체적인 개선방안으로는 첫째, 대상자의 특성과 위험도를 고려한 다양한 전자감독 기술의 활용을 제안하였다. 구체적으로 처분단계와 각 처분단계의 목적에 적합한 전자감독 도입(예 : 재택감독, 단속적 GPS, 하이브리드 GPS방식), 알코올 중독자나 알코올 문제가 있는 대상자에게 음주측정기 기능이 결합된 부착장치개발 및 활용, 피해자 보호기능 강화를 쌍방향 전자기술 개발 및 활용 등을 제시하였다. 둘째, 여성대상자 및 정신장애 진단을 받은 대상자의 증가 등을 고려해 이들 대상자의 필요와 욕구에 대응하는 처우프로그램을 제공할 것을 제안하였다. 셋째, 전자감독이 대상자의 사회통합 및 사회복귀에 장애요소로 작용하지 않도록 너무 민감하게 반응하도록 규정되어 있는 경보관련 지침을 합리적으로 조정할 것을 제안하였다. 넷째, 지난 10년간 전자장치의 개선이 주로 대상자에 대한 통제적 관점에서 이루어져 왔으나, 향후에는 장기간 착용해야하는 대상자의 편의성 관점에서 기술개발과 예산투자가 필요함을 제시하였다. 넷째, 부착기간을 법개정 이전으로 단축하고, 보안처분이라는 목적에 적합하게 부착명령 결정 시점을 형종료시점으로 변경하고, 부착명령 결정시 재범위험성과 더불어 집행에 영향을 미칠 수 있는 요인(예: 알코올 문제나 정신장애 등)도 함께 고려해야 함을 제시하였다. 다섯째, 2% 미만의 재범률이라는 유례없는 성과를 지속적으로 유지하기 위해서는 전자감독 전담인력을 확충하고, 이들이 직무과정에 받게 되는 스트레스 관리를 위한 조직적 차원에서 노력이 필요하다는 점을 제안하였다. 마지막으로 전자감독제도에 대한 정례적인 평가연구의 필요성을 제안하였다.

영어초록

Ten years have passed since the introduction of electronic supervision system in Korea. At this point, this study analyze and evaluate the outcome of the electronic supervision system in the past 10 years, using the official statistics and the results of the surveys that have been published, related to electronic supervision. For this study purpose, this paper consists of four major parts. In the first part, this study evaluate the outcome of electronic supervision systems, especially in focus of the special deterrence effect for the past 10 years. In the second part, in order to evaluate the outcome of electronic supervision systems from a balanced perspective, this study would like to discuss the negative consequences of electronic supervision on criminals' daily lives and psychological and emotional states. In the third part, this study look at various issues raised during the operation of the electronic supervision system and evaluate its impact on the outcome of the electronic supervision system. In the fourth part, this study suggests alternatives to be improved for the effective operation of electronic supervision system in the future.
As a future task, this study proposed various electronic supervision technologies according to the characteristics and risk of target. Depending on the disposal stage to which electronic supervision is applied and the personality and risk of the target person, it is necessary to utilize various electronic monitoring methods such as restriction of going out via a voice recognition device, home detention by RF method, passive GPS, active GPS, hybrid GPS. In addition, this study proposed the introduction of an interactive electronic monitoring system for the protection of victims and the use of electronic monitoring equipment with drinking measurement function. Second, the necessity of electronic device improvement considering the convenience of the subject was suggested. Third, this study proposed a downward adjustment of the prolonged attachment period and the activation of a temporary release measure for sex offenders. Fourth, this study proposed to consider the characteristics of the target person who influence the electronic supervision enforcement when deciding the attachment order and to make the attachment order decision at the end of the sentence. In addition, this study argued about the need to expand the number of electronic supervision personnel and manage stress from their work, and emphasized the importance of regular evaluation studies of electronic supervision systems.
