초록

이 글은 2022년도 상법 보험편의 대법원 판결들 중 중요한 판결을 엄선하여 분석하였다. 다음이 이 글의 주요한 내용이다.
첫째, 대상판결은 사기적 보험금청구 조항에 대한 유효성을 인정하면서도, 그 조항을 문리 그대로 해석하여 곧바로 보험금청구권 전부를 상실시키는 것이 아니라, 보험금청구권자의 청구와 그 부당행위의 정도, 그리고 보험의 사회적 효용 등을 교량하여 종합적으로 판단하여 한정하였고, 이는 타당하다.
둘째, 중증 재생불량성빈혈은 외과적 수술 등의 과정에서 부작용·합병증 등으로 인하여 발생한 손해이므로 "의료처리 과정의 부작용으로 인한 장해는 보상하지 않는다."는 약관상 면책사유에 해당되고, 이러한 약관은 상해보험 표준약관에 포함되어 시행되는 것이어서 보험계약자에게 보험자가 별도의 설명의무를 부담하지 않는다고 주장한 사건에서, 대법원은 ‘다른 약관에서 일반적으로 사용한다’고 하여 보험자의 설명의무가 면제되지는 않는다고 하였다. 이러한 대법원 판례의 태도는 옳다고 생각된다.
셋째, 손해방지비용의 범위는 보험사고 발생한 이후임을 원칙으로 하면서, 그 보험사고의 원인과 직접적인 것으로 한정한 대상판결도 타당하다. 현행 상법은 보험자의 지시가 없는 경우에도 보험금액을 초과한 손해방지비용마저 보험자가 부담(상법 제680조 단서)하기 때문에 제한적 해석이 필요하다.
넷째, 자동차상해보험특약이 자기신체사고와는 구별되는 것이며, 당사자의 약정이 있는 경우 보험자대위가 가능하다고 한 대상판결도 이중이득을 금지하는 보험자대위의 취지에서 볼 때 옳다.
다섯째, 책임보험자의 책임범위는 약관과 법령에 의하여 제한되고, 각 용어에 관한 문리해석도 규범적으로 판단하여야 한다는 판결도 지극히 타당하다.

This article carefully selected and analyzed important rulings among the Supreme Court rulings on the insurance side of the commercial law in 2022. Next comes the conclusion.
First, while recognizing the validity of the fraudulent insurance claim clause, the target judgment does not immediately lose the entire insurance claim right by interpreting the clause as it is, The bridge was comprehensively judged and limited, and this is reasonable.
Second, the target judgment is also correct, saying that the insurer is not exempt from the duty of explanation just because it is ‘generally used in other terms and conditions’.
Third, it is reasonable to limit the scope of damage prevention costs to the cause and direct cause of the insured event, as a rule, after the occurrence of the insured event.
