법과 사회 40년의 흐름, 그 초심과 비전 (“Law & Society” Studies Movement in Korea since 1984)

초록

한국에서 ‘법과 사회’ 연구는 법과사회이론연구회(학회)에 의해 본격화되었다. 학회는 1987년 창립되었고, 그 학회지 <법과 사회>는 1989년부터 반연간 잡지로 발행되었다. 2024년 현재는 연3회 발간되고 지금까지 통권 76호까지 발행되고 있다. 이 글은 지난 40년간의 ‘법과사회’운동을 개관하면서, 특히 초창기의 형성사에 대한 체험적 증언을 기초로 하고 있다.
한국에서 ‘법과사회’연구는 하나의 지적 운동이라 할 만하다. 이 운동은, 종전의 법학 및 법실무의 동향에 대해 비판적으로 접근했다. 그들이 비판했던 전통법학적 경향은 법률과 판례의 테두리에 갇혀 있는 법도그마틱이었고, 독재권력을 정당화하거나 군사정권의 폭압성에 대한 비판을 회피하는 권력추수형 법학이었다. 그에 반해 ‘법과사회’운동은 우리의 구체적 법현실에서 문제점을 찾아내어 해결하는 법학, 억압적이고 권위적인 법문화를 청산하고 민주적이고 정의로운 규범질서를 모색하는 민주법학, 전문가적 틀을 벗어나 대중친화성을 갖춘 법학을 지향했다. 출범 당시에 반민주적 법률의 개폐, 시민사회의 요구에 부응하는 법적 실천을 지향했고, 이후에는 사법개혁 및 법조인양성체제의 개혁에 역점을 쏟아 왔다. 특히 방법론 면에서는 사회과학의 지적 자원을 대폭 활용하는 종합사회과학의 일환으로서의 법학을 지향하고, 사회개혁을 위한 법적 개혁을 적극 추진하였다. 초창기엔 비판법학, 급진적 법현실주의, 민주주의법학에 대한 비교법적 연구를 이론적 자원으로 탐구했다.
‘법과사회’운동은 당시 소장층 학자들이 중심이 되었고, 법학의 개별분야를 두루 포괄하였다. 이들은 자주 한국법학의 제3세대로 일컬어졌다. 40여년을 경과한 현시점에서 볼 때, 계승해야 할 부분도 있고 극복해야 할 부분도 있다. 앞으로 제4세대 법학자들은, 보다 폭넓은 지적 시야를 갖고, 사회과학 및 자연과학과도 연계된 법학을 하고, 보다 진취적이고 개척적인 연구의 확산을 계속하기를 바란다.

영어초록

In Korea, the study of ‘law and society’ was activated by the Law & Society Studies Association (LSSA). LASS was founded in 1987, and its journal <Law and Society> has been published as a semi-annual magazine since 1989. As of 2024, it is published three times a year and has published 76 issues to date. This paper provides an overview of the ‘law and society’ movement in Korea over the past 40 years, especially based on the author’s involvement in its early formative history.
In Korea, the ‘Law and Society’ study can be considered an intellectual movement in the field of law. This movement approached the trends of previous law and legal practice critically. The conventional legal academism they criticized were legal dogmatics confined within the framework of present law and precedents, and power-seeking legal studies that justified dictatorial power or avoided criticism of the tyranny of the military regime. In contrast, the ‘Law and Society’ movement aimed at critical legal studies that diagnosed and solved problems in our specific legal reality, democratic legal studies that liquidated authoritarian legal culture and sought democratic and just normative order, and civic legal studies that went beyond professional frameworks and were friendly to the public.
At the time of its launch, it aimed at the revision of anti-democratic laws and legal practices that responded to the demands of civil society. It then focused on judicial reform and the introduction of a Korean-style law school system. In particular, in terms of methodology, it aimed at legal studies as part of comprehensive social science that makes extensive use of the intellectual resources of social science, and actively promoted legal reform for social reform. In the early days, they had an affinity for comparative legal studies on critical jurisprudence, radical legal realism, and democratic jurisprudence.
The ‘Law and Society’ movement was centered around young scholars at the time, and encompassed individual fields of law. They were often referred to as the third generation of Korean jurisprudence. Looking back at the present time, after 40 years, there are some parts that need to be inherited and some that need to be innovated. I hope that in the future, the fourth generation of law scholars will have a broader intellectual perspective, conduct legal studies that is linked to social and natural sciences, and continue to spread more progressive and pioneering research.
