한국 지방 분권･치리･정책의 70년 집대성 (Local Autonomy in Korea : Decentralization, Governance and Policy)

초록

행정학은 국민의 생활과 가장 밀접한 주제에 관해 분석하고 처방하기 위한 이론과 실천 모두를 지향하는 학문이다. 무엇보다도 국민에게 필요한 공공재를 적절히 공급하는 일이 핵심 사항이다. 미국 행정학의 아버지로 불리는 우드로 윌슨의 ‘정치-행정 이원론’을 토대로 현대 국가들은 강하고 능력 있는 관료제의 발전을 지향해 왔다. 그래서 현대 행정학은 정책 기획과 집행의 방법론, 조직이론, 다양한 관리 방법 등을 연구하고 교육하고 현실에 적용한다. 행정법 등 법학의 범주를 벗어나 관료제의 정책관리를 중심으로 행정학이 발전해 온 것이다. 그런데 이 책에 수록된 논문들이 법 규정을 넘어 현대 행정관리론을 적용함에 있어 다소 소홀한 측면이 있다는 아쉬움이 있다. 치리는 기존 관료제에 민간 영역의 자원봉사조직이나 종교단체 등이 참여함으로써 정책 형성과 집행의 영역을 넓혀가는 창조적 관리의 의미도 있다. 그러나 이와 같은 의미에서의 치리에 관해 분석한 논문은 없는 것 같다. 행정에서 기능주의 접근방법도 유용하다. 미국의 경우, 환경, 지방교육, 재해･곤충관리 등 기능에 따라 독립적으로 구성된 지방자치단체들이 존재한다. 기능주의 시각은 전통적인 지역적 분권 개념에서 기능적 특성에 따라 행정을 조직화하는 방식을 생각해 낼 수 있게 해준다. 그런데 이 책에서는 ‘기능’이라는 재목의 논문조차도 주로 법적 접근방법에서의 기능에 관해 논하고 있다.
이 책에 실린 논문들은 대개 지방자치가 ‘풀뿌리 민주주의’ 발전에 필요조건이라고 전제하는 듯하다. 그러나 연방제 혹은 ‘느슨한 연방제’를 채택하는 나라들이 규범에 의해서가 아니라 단순히 지리적인 조건 때문에 그렇게 하고 있다는 사실을 눈여겨볼 필요가 있다. 미국, 구(舊)소련, 중국, 남미, 호주 등 넓은 영토를 지닌 국가들이 예다. 영토 면에서 작은 나라가 굳이 이념적 명분을 충족하기 위해 지방 분권과 자치를 강조한다면 일정한 한계가 있을 수 있다. 미국을 예로 들면, 연방정부가 생기기 이전에 이미 주(state)정부들이 존재했었다. 영국으로부터 독립한 이후에도 이들은 기존의 세력에 위협이 되지 않는 범위 내에서 느슨한 수준의 연맹(confederacy)을 9년 동안이나 시행했었다. 이 기간에 이 나라의 전반적인 국정 능력은 극히 저급한 수준의 것이었다. 1787년 오늘날의 연방제(federalism) 정부를 타협의 산물로 채택하게 된 이유다. 따라서 지방자치와 분권의 필요성과 성과를 보다 현실주의의 시각에서 평가할 필요가 있다. 지난 30여 년간의 지방자치제 시행이 과연 한국 민주주의에 얼마나 기여했는지도 흥미로운 주제가 될 것이다. 1995년부터 지방자치단체장의 직선이 시행되고, 2007년에는 직접민주주의의 상징인 ‘주민소환법’도 도입되었다. 이러한 제도화가 ― 제20대 대통령 선거에서도 나타났듯이 ― ‘지역 정서’를 비롯하여 한국의 정치발전에 과연 얼마나 기여했는지 의문이다. 지방자치 시행이 주민들의 정치 성향 변화에 미친 영향에 대한 실증적 연구가 필요한 대목이다.
이 책의 저자들이 일관되게 의거하는 또 다른 규범적 전제는 지방자치가 주민의 행복과 복지안녕을 위한 제도라는 것이다. 그런 점에서 주민들이 지방정부에 바라는 정책 수요의 변화를 실증적으로 분석할 필요가 있을 것이다. 아마도 대부분의 주민들은 공원에 새로 설치된 테니스코트가 어느 수준 정부의 지원에 의한 것인지 개의치 않을지도 모른다. 한국의 지방자치가 주민의 실질적인 필요에 부응하면서 운영되는 것인지, 아니면 정치 엘리트들이 관념적이고 이념적으로 상의하달식 접근방법에 의해 이루어지는 것인지 궁금하다.
‘위기는 기회’라고 하듯이, 우리나라가 당면하고 있는 각종의 위기 상황에 대처할 과감한 정책 비전을 제시하기 위한 연구도 앞으로 필요한 연구주제인 것으로 생각한다. ‘저출산’으로 인한 인구감소 문제를 극복하기 위해 이민과 다문화 정책 등에 관한 연구가 예다. 조세권 공유와 자치경찰제는 지방자치제의 상징이다. 최근 중앙정부가 경찰 권한의 일부를 시도지사 휘하로 이양함에 따라 실제 운영되는 모습에 대한 경험적 연구도 필요할 것으로 보인다. 그리고 ‘통일한국’의 지방자치제를 설계하는 연구도 기대한다.

영어초록

Public Administration is a discipline that aims for both theory and practice to analyze and prescribe topics most closely related to people's lives. Above all, it is a key issue to adequately supply the public goods needed by the people. Based on the 'political-administrative dualism' of Woodrow Wilson, who is called the father of American public administration, modern countries have been aiming for the development of a strong and capable bureaucracy. Therefore, modern public administration studies, educates, and applies the methodologies of policy planning and execution, organizational theories, and various management methods to reality. Public administration has developed centered on policy management in the bureaucratic system beyond the scope of jurisprudence such as administrative law. However, it is regrettable that the papers in this book are somewhat neglected in applying the modern administrative management theory beyond legal regulations. Governance also has the meaning of creative management, which broadens the scope of policy formation and execution by involving volunteer organizations or religious groups in the private sector in the existing bureaucracy. However, there do not seem to be any papers analyzing the discipline in this sense. A functionalist approach is also useful in administration. In the case of the United States, there are independent local governments organized according to functions such as environment, local education, and disaster and insect management. The functionalist perspective allows us to conceive of ways to organize administration according to functional characteristics from the traditional concept of regional decentralization. However, in this book, even the thesis of ‘function’ mainly discusses the function in the legal approach.
The papers in this book seem to assume that local autonomy is a necessary condition for the development of 'grassroots democracy'. However, it is worth noting that countries that adopt federalism, or “loose federalism,” are doing so simply because of geographic conditions, not by norm. Countries with large territories such as the United States, the former Soviet Union, China, South America, and Australia are examples. In terms of territory, if a small country dares to emphasize decentralization and autonomy to satisfy its ideological cause, there may be certain limitations. In the United States, for example, state governments existed before the federal government was formed. Even after independence from Britain, they maintained a loose level of confederation for 9 years without threatening existing powers. During this period, the country's overall state power was at an extremely low level. This is why the present-day federalist government was adopted as a product of compromise in 1787. Therefore, it is necessary to evaluate the necessity and performance of local autonomy and decentralization from a more realist perspective. It will also be an interesting topic to see how much the implementation of local autonomy over the past 30 years has contributed to Korean democracy. The direct election of local government heads has been implemented since 1995, and the ‘Resident Recall Act’, a symbol of direct democracy, was introduced in 2007. It is questionable how much this institutionalization has contributed to Korea's political development, including 'regional sentiment' - as it was shown in the 20th presidential election. An empirical study on the effect of the implementation of local autonomy on the change of residents' political orientation is needed.
Another normative premise on which the authors of this book consistently relies is that local autonomy is a system for the happiness and welfare of residents. In this regard, it will be necessary to empirically analyze the changes in policy demand that residents want from local governments. Perhaps most residents do not care what level of government support the new tennis courts installed in the park are. It is curious to know whether local autonomy in Korea is operated in response to the practical needs of the residents, or whether the political elite is ideologically and ideologically achieved through a top-down approach.
As it is said that ‘crisis is an opportunity’, I think that research to present a bold policy vision to cope with the various crisis situations our country is facing is also a necessary research topic in the future. An example of this is research on immigration and multicultural policies to overcome the problem of population decline due to the low birth rate. The sharing of taxation rights and the autonomous police system are symbols of local autonomy. As the central government recently transferred some of the police powers under the control of provincial and provincial governors, it seems that empirical research on the actual operation is also needed. In addition, we look forward to research on designing a local self-government system for a 'unified Korea'.
