초록

베트남의 2013년 헌법 개정과정과 개정된 내용을 보면, 베트남 정치․경제체제의 현재와 미래를 내다보게 해준다. 헌법 조문의 내용 분석을 통해 보면, 베트남 정치․경제체제의 기본틀은 변하지 않고 유지되고 있다. 2013년 헌법에서 국가와 사회에 대한 공산당의 영도집단으로서의 위상은 유지되었고, 국가 경제에서 국유경제부문의 주도적 역할도 존속하게 되었다. 이런 점에서 2013년 헌법 개정과정에서 개혁은 진전되지 않았다고 평가할 수 있다. 그러나, 헌법 개정과정에서 몇 가지 긍정적으로 평가할 만한 진전된 내용과 이를 초래한 요인들을 다음과 같이 들 수 있다.
첫째, 2013년 헌법은 인권 규정을 강화한 것이 중요한 특징이다. 그것은 ‘인권’ 용어를 헌법의 장 제목에 처음으로 삽입하고, 이와 관련된 조항을 앞으로 배치하여 강조하였고, 조문에 있어서도 인권에 관한 비교적 상세한 규정을 담았다.
둘째, 2013년 헌법이 정치체제상 가지는 의미는 헌법기관의 책임성을 강화하였다는 점이다. 더욱이, 공산당과 당원이 국민에 대해 책임감을 가져야 하고, 국민들의 감독을 받으며, 국민을 위해 복무해야 한다는 규정을 명문화함으로써 공산당의 책임성을 강화하였다. 정치체제의 변화와 관련하여 보다 더 긍정적 평가는 헌법 개정과정에서 활성화된 정치과정에 둘 수 있다. 헌법 개정 논의과정에서 제기된 현 체제에 반대하는 의견들을 볼 때 체제 변화에 대한 압력은 앞으로 계속 증가할 것으로 보인다.
셋째, 경제부문에서는, 국유경제부문이 국가 경제에서 주도적 역할을 수행한다는 규정을 존치하면서 시장 법칙에 따른다는 타협적 규정은 이제 국유경제의 주도성이 명목상 규정에 불과하게 되었다는 것을 표방하는 것이다. 현재와 같은 경제개혁이 진전되면서, 향후 국유경제의 주도성은 주요 의제로 되지 않을 것이며, 경제 현실이 국유경제의 주도성을 부인할 것이다.
결론적으로, 베트남의 2013년 헌법은 그 기본틀에서 1992년 헌법을 따르고 있기에 정치․경제체제상 근본적 변화를 보이지는 않으나, 헌법 조문상의 변화와 헌법 개정과정에서의 다양한 의견의 개진과 활발한 참여는 향후 장기적으로 베트남 체제 변동의 씨앗이 되리라는 전망을 갖게 해준다.

영어초록

The process of amendment and its contents of the Vietnam’s 2013 Constitution provides a perspective on the present and future of the Vietnamese political and economic system. In analyzing the contents of the Constitution, the basic framework of Vietnam's political and economic system remains unchanged. In the 2013 Constitution, the Communist Party's status as a leader of the state and society is maintained, and the leading role of the state-owned economy in the national economy is remained. In this sense, it can be said that reform did not progress in the revised 2013 Constitution. However, some positive assessments of the constitutional amendment process and the factors that led to it can be mentioned below.
First, the 2013 Constitution is an important feature of strengthening human rights regulations. It first inserted the term "human rights" into a chapter’s title of the Constitution, stressed the provision of relevant provisions and contained relatively detailed provisions on human rights in its text.
Second, the meaning of the 2013 Constitution on the political system is that it has strengthened the accountability of constitutional institutions. Moreover, the Communist Party's accountability has been strengthened by stipulating that the Communist Party and its members must be responsible to the people, supervised by the people, and serve the people. More positive evaluations regarding changes in the political regime can be placed in the political process activated during the constitutional reform. The opposition to the current political regime raised during the constitutional amendment discussions suggests that pressure to change the regime will continue to rise.
Third, in the economic sector, the compromised rule that follows the laws of the market, while maintaining the stipulation that the state-owned economic sector plays a leading role in the national economy, indicates that the initiative of the state-owned economy is now nominal. As the current economic reforms progress, the initiative of the state-owned economy will not be the main agenda in the future, and the economic reality will deny the leadership of the state-owned economy.
In conclusion, since the 2013 Constitution follows the 1992 Constitution in its framework, there is no fundamental change in the politico-economic system. However it is expected that the dynamics and changes in the process of the constitutional amendment will be the seeds for changing the political regime in the long term in Vietnam.
