민법안 심의록(1958년)과 메이지민법 수정안이유서(1896년, 1898년): 자료소개와 활용방안을 중심으로 (Minutes of Deliberations on Civil Code Bill(1958) and Reform Motives of the Meiji Civil Code(1896): Focusing on Introduction of Materials and How to Use Them)

초록

1958년 제정된 우리 민법전(1958년)은 일본 메이지민법(의용민법)을 참고로 하여 제정된것이다. 이러한 관계를 밝혀주는 자료로는 민법안 심의록(1958년)이 있다.
민법안 심의록의 참고입법례를 보면 재산법의 부분(제1편~제3편)에서는 일본 메이지민법의 재산편(1896년)(제1편~제3편)(심의록에서 ‘현행법’으로 표시)과 한국 민법전이 ① 그 조문 내용이 서로 동일한 것이나 ②그 입법취지가 유사한 것으로 하는 여러 조문이 있는 것을 볼 수 있다.
심의록은 이러한 조문에 대한 우리 입법자의 이유설명이 없다. 이러한 유형에 속하는 한국민법 조문의 입법자 의사는 이에 대응하는 메이지민법의 것을 참조하여 보충할 수 있다. 이러한 유형이 아닌 조문에서는 각각 해당 참고 입법례를 통하여 일본민법과 다른 입법이유를 분석하여야 할 것이다. 민법안 심의록의 가족법의 부분(제4편과 제5편)에서는 일본 메이지민법의 가족법(1898년)(제4편과 제5편)과 1945년 개정 일본민법(제4편과 제5편)을 참조한 조문이 많이 있다. 심의록의 참고입법례로 이것들만 제시된 조문도 있다. 이러한 조문에서는 각각의 상응한 입법이유를 참조하여 우리 입법이유를 보충할 수 있고, 이러한 유형이 아닌 조문에는 해당 참고 입법례의 입법이유를 분석하여야 할 것이다.
이 글에서는 먼저 심의록의 참고입법례를 통하여 한국민법과 일본 메이지민법 등의 관계를 여러 유형으로 분석해 본다(II). 이어서 일본민법의 부분(III)에서는 메이지민법의 조문의입법이유를 찾아볼 수 있는 여러 일본어로 된 자료를 소개하여 후속 연구에 도움이 되게 하였다. 향후 이 기초연구가 우리 민법 제정 당시에 참조한 일본 메이지 민법조문의 관계를 후속연구에서 각론으로 분석하여 우리 민법의 입법이유를 보완하는데 도움이 되기를 기대한다.

영어초록

The Korean Civil Code, enacted in 1958, was enacted with reference to the Japanese Meiji Civil Code(the so-called Enforced Civil Law). The Minutes of Deliberations on Civil Code Bill(1958)(Hereinafter referred to as the Minutes) is a source that reveals this relationship.
Looking at the referenced legislative examples in the Minutes, we can see that in the property law section(Part 1 to Part 3) there are several articles that ① have the same content of the articles of the Meiji Civil Code (1896) (indicated as ‘current law’ in the Minutes) and the Korean Civil Code, or ② have similar legislative motives. The Minutes do not provide an explanation of the legislator’s motives for these articles. The legislator’s motives for the articles of the Korean Civil Code that fall into this category can be supplemented by referring to those of the corresponding Meiji Civil Code. For those articles belonging to these categores, the legislative motives that differ from the Japanese Civil Code should be analyzed through the relevant referenced legislative examples.
In the section of family law(Part 4 and Part 5), there are many articles that refer to the family law of the Meiji Civil Code of Japan(1898)(Part 4 and Part 5) and the Japanese Civil Code revised in 1945(Part 4 and Part 5). There are also articles that only present these as referenced legislative examples in the Minutes. In these articles, we can supplement the legislative motives of the Korean Civil Code by referring to the respective corresponding motives, and for articles that are not of this category, we should analyze the legislative motives of the relevant referenced legislative examples.
In this article, we first analyze the relationship between the Korean Civil Code and the Japanese Meiji Civil Code in several categores through the referenced legislative examples of the Minutes(II). Next, in the section on Japanese civil law(III), we introduce several materials in Japanese that can be used to find the legislative motives for the articles of the Meiji Civil Code, which will be helpful for follow-up research. We hope that this basic research will be helpful in supplementing the legislative motives for the Korean Civil Code by analyzing in follow-up research, through analysis of every provisions in detail.
