중간이자 공제이율에 대한 검토-일본의 민법개정을 참조하여- (A review on the interest rate of deduction of future profits - With reference to amendments of Japanese Civil Act -)

초록

불법행위 등에 기초한 손해배상액 산정시 장래의 일실이익과 비용지출을 현재가치에 환산하기 위하여 하는 소위 ‘중간이자 공제’는 그 이율로써 민법 제379조의 법정이율을 적용하고 있다. 그런데 최근 민법상 법정이율을 개정하려는 2건의 민법개정안이 발의되어 국회에서 논의 중이고, 양자는 내용상 일부 차이가 있지만 법정이율 변동제를 채택하고 있다. 그런데 법정이율을 개정하는 경우 중간이자 공제이율에 대한 영향에 대해서는 국내의 논의가 많지 않은 관계로, 이를 검토할 필요성이 있다고 생각하였다.
일본은 민법상 법정이율이 우리 민법과 동일하였으나, 2016년 민법개정을 통하여 법정이율을 고정제에서 변동제로 변경하고 중간이자 공제의 이율도 변동되는 법정이율에 연동되도록 하였다. 이 때문에 일본의 법정이율 관련 민법개정 논의를 검토하는 것은 법정이율을 변동제로 변경하려는 우리나라의 민법 개정과 관련하여 좋은 참고가 될 수 있고, 법정이율 변동제와 중간이자 공제이율에 대한 관계 및 영향에 대해서도 시사점을 줄 수 있을 것으로 판단하였다.
검토한 결과에 의하면 법정이율과 중간이자 공제이율은 반드시 연동되어야 하는 것은 아니지만, 중간이자 공제이율로 활용될 적절한 이율이 없는 경우에는 연동이 가능하다. 다만, 중간이자 공제이율과 법정이율이 연동되기 위해서는 그 전제로서 적정한 법정이율이 산정되어야 한다. 그러나 현재 국회에 제출된 법정이율에 관한 개정안들은 각각의 타당성과 합리성에 대해 좀 더 논의가 필요해 보이고, 학계나 실무에서도 이와 관련하여 적극적인 검토와 논의가 요구된다.
그리고 일본이 민법개정을 통하여 법정이율의 기준이율을 단기대부 평균이율을 활용하고 있는 점, 이율의 변동을 완만하게 이뤄지게 개정하여 중간이자 공제이율과 연동시킨 점 등은 우리가 법정이율을 개정할 때 고려해 볼 필요가 있다.

영어초록

The so-called "deduction of future profits" that aims to convert future benefit and expenses to present value in calculating damages based on illegal activities, etc., uses the legal interest rate of Article 379 of the Civil Act. Recently two revisions of civil act have been proposed in the National Assembly to revise the legal interest rate, and the two have adopted a system to change the legal interest rate, although there are some differences in content. However, since there is not much domestic discussion about the effect of the interest rate of deduction of future profits when the legal interest rate is revised, I thought there is a need to review it.
In Japan, the legal interest rate in civil act was the same as that of the Korean civil act, but the revision of the civil act in 2016 changed the legal interest rate from a fixed system to a variable one, and the interest rate of deduction of future profits was also linked to the legal interest rate. For this reason, it was decided that reviewing the discussion on revising the civil act concerning the legal interest rate of Japan could be a good reference in relation to the revision of the Korean civil act to change the legal rate to a variable system, and that it could also suggest the relationship and impact of the change in the legal interest rate and the interest rate of deduction of future profitsThe reviewed results show that the legal interest rate and the interest rate of deduction of future profits are not necessarily linked, but that a link is possible if there is no appropriate rate to be used as the interest rate of deduction of future profits. However, in order for the interest rate of deduction of future profits to be linked with the legal interest rate, the appropriate one must be calculated on. But the current amendments to the legal interest rate submitted to the National Assembly seem to require more discussion on the validity and rationality of each, and much review and discussion of this in relation to the academic and practical matters.
And in Japan the use of short-term loan rate as the standard rate through the revision of the civil act, and a gentle fluctuation of the legal interest rate to link with the interest rate of deduction of future profits, need to be considered when we revise the legal interest rate.
