초록

코로나 사태의 장기화는 우리의 일상 물론 사회 나아가 국가권력의 모습과 그 속성까지도 변화시키고 있다. 역사는 재난, 전쟁, 전염병 등 인간의 생명을 위협하는 거대한 위험들이 휩쓸기 이전과 이후가 어떤 식으로든 결코 같을 수 없음을 반복적으로 보여준다. 이는 사회 혹은 국가를 지배하는 권력에 있어서도 예외는 아니다. 특히 권력의 본질과 속성의 변화를 포착하고 이해하는 것은 ‘그 이후의 세계’를 예상해 보고 대비하는데 있어서 매우 중요한 의미를 갖는다.
미셀 푸코의 권력론과 생명정치론을 분석틀로 바라봤을 때, 코로나 사태 속에서 작동하고 있는 권력의 실체는 ‘생명관리권력’이라 할 수 있다. 푸코의 개념정의에 따르면, 생명관리권력은 ‘사람을 살게 만들고 죽게 내버려두는 권력’이다. 하지만 여기서의 생명은 ‘단지 살아 있다’는 사실적 층위에서의 삶이다. 즉 ‘생물로서의 삶’을 말한다. 이러한 생명권력하에서의 생존조건을 국유화되고, 인간의 삶은 오직 생존을 위한 삶으로 전락한다. ‘생물로서 인간’의 삶은 유전자 층위까지 분해되고 개인의 고유성은 상실되며, 종으로서 인간, 즉 개인이 아닌 인구로서 생명은 몰개성화 되는 동시에 자본화된다.
이러한 생명관리권력의 특성들은 코로나 사태 속에서도 확인된다. 생명관리권력은 수치화와 통계화를 통해 질병을 객관화함으로써 이러한 비정상성을 합리성의 영역으로 통합한다. 이에 따라 인구 중 병에 걸린 자와 이로 인해 죽은 자의 수는 발병률과 사망률로 표시․집계되고, 이를 연령별, 지역별, 직업별 등으로 분석한 결과는 다시 그래프로 제시된다. 결국 정상화란 정상분포(평균)곡선에서 벗어난/일탈한 비정상곡선을 다시 정상곡선과 포개지도록 만드는 작업이 된다. 이를 위해 생명관리권력은 예방의학기술을 활용하여 평균으로서의 정상성을 추구한다. 여기서 안전은 그래프상의 평균값이 되고, 그 수치가 정상성의 규범적 기준이 된다. 결국 생명관리권력 하에서는 규범이 정상화를 규정하는 것이 아니라 정상화가 규범을 창출한다. 이 과정에서 사법권력과 그 권력장치로서의 법은 주변부로 밀려나고, 그 역할과 기능은 규율권력이 부과한 명령이나 의무를 위반한 자를 처벌하는 부수적․보조적 기능을 수행하는데 머문다.
심각한 문제는 이러한 위기극복을 위해 예외적으로 허용되고 도입된 생명관리권력의 장치들이 비상사태가 종료된 이후에도 그 목적과 명분을 바꾸어가며 고착화․제도화되어, 비상사태 이전과는 다른 모습의 정상상태를 만들어낸다는 것이다.
그렇다면 생명권력과 생명정치 하에서 법의 역할과 가치는 무엇일까? 이러한 ‘비정상성의 정상화’ 상황 하에서 법은 비상조치들의 시간적․규범적 한계를 명확히 규정하고, 생명관리권력이 일방적으로 부여하는 법의 역할과 기능에 대해 저항해야 한다.

영어초록

The prolonged coronavirus outbreak is changing not only our daily life, but also the appearance and nature of state power as well as our society.
History repeatedly shows that before and after the great dangers threatening human life, such as disasters, wars, and infectious diseases, can never be the same in any way. This is no exception to the power over society or the state. In particular, capturing and understanding changes in the nature and nature of power is of great importance in anticipating and preparing for the ‘world after that’.
When looking at Michel Foucault's theory of power and the theory of biopolitics as a framework for analysis, the reality of power operating in the corona crisis can be said to be the “life management power”.
According to Foucault's definition of concept, life-management power is ‘the power that makes people alive and leaves people to die’. However, life here is a life on the level of fact that it is ‘just alive’. In other words, it refers to ‘life as a living thing’. The conditions of survival under this power of life are nationalized, and human life is reduced to life only for survival. The life of a ‘human as a living thing’ is decomposed to the gene level, the individual's personality is lost, and the human as a species, that is life as a population rather than an individual, is depersonalized and capitalized at the same time.
The characteristics of these life management powers are also confirmed amid the corona crisis. The life management power integrates these abnormalities into the realm of rationality by objectifying diseases through numerical and statisticalization. Accordingly, the number of sick people and the number of those who died due to it among the population are displayed and counted as the incidence rate and mortality rate, and the results of analyzing this by age, region, and occupation are again presented as a graph. In the end, normalization is the work of making the unsteady curve that deviates/depart from the normal distribution (mean) curve overlap the normal curve again. To this end, life management power pursues normality as an average by using preventive medicine technology. Here, safety is the average value on the graph, and that number is the normative criterion for normality. After all, under the power of life management, norms do not define normalization, but normalization creates norms.
In this process, the judicial power and the law as its power device are pushed to the periphery, and their roles and functions remain to perform ancillary and auxiliary functions to punish those who violate orders or duties imposed by the discipline power.
The serious problem is that the devices of life management power, which are exceptionally permitted and introduced for overcoming such a crisis, are fixed and institutionalized, changing their purpose and justification even after the emergency is over, creating a normal state of a different appearance from before the emergency.
Then, what is the role and value of the law under the life power and life politics? Under ‘the normalization of such abnormalities’, the law clearly defines the temporal․normative limits of emergency measures, and must resist the role and function of the law unilaterally given by life management power.
