종교계 대학교의 교원 임용과 종교적 사유에 의한 차별 (Is It Legal for Religious Educational Institutions to Require the Religious Qualification of All Employees?)

초록

종교계 대학교의 교직원 임용이나 승진 등 고용관계에서 종교적 조건이 요구될 수 있는지에 대해서는 논란이 많다. 국가인권위원회가 종교교육을 담당하지 않는 대학교 교원의 임용조건으로 특정 종교인일 것을 요구한 것은 종교적 사유에 의한 차별행위라고 판단하고 이를 시정하라고 권고하였으나 이들 대학교는 이 권고를 수용하지 않았다. 이 글은 종교계 대학교의 교원임용 및 승진 등 고용관계에서 종교적 조건을 요구할 수 있는지를 미국의 법제를 참고하여 위법 여부를 검토하고 그 해결방안을 찾고 있다.
결론적으로 고용관계에서 종교적 조건을 요구할 수 있는지 여부는 첫째, 종교적 조건이 수행하는 업무와 관련되는지 여부(업무관련성), 둘째, 종교적 조건이 업무수행에 필요한 것인지 여부(필요성)에 의하여 판단하여야 하며, 다만 특정 종교의 성직자 양성을 위한 교육기관의 경우는 종교단체의 내부적 자율성에 준하는 자유가 보장되어야 한다는 점에서 종교적 조건의 요구가 가능하다고 본다. 단순히 종교적 사유에 의한 차별만을 금지하고 있는 국가인권위원회법 규정만으로는 해석상 논란도 많고 국가인권위원회의 권고에 의한 분쟁의 해결가능성도 낮으므로 이를 새로운 법률조항의 제정을 통하여 해결하여야 한다.

영어초록

A few years ago the Korean National Commission of Human Rights recommended that some religious educational institutions abolish the religious qualification required of the prospective professors who will teach secular subjects. The discrimination because of religion is strictly prohibited in Constitutional Law and the National Human Rights Commission Act. However, the universities did not accept the recommendation on the ground of freedom of contract, religious freedom and the purpose of the establishment. Without the religious mission, they contend, it is meaningless to operate and manage the universities.
In the United States, the Civil Rights Act of 1964 Title VII provides the prohibition of discrimination because of religion, but (1) the religious educational institution, (2) educational institution in whole or in substantial part owned, supported, controlled or managed by a particular religion or by a particular religious corporation, association or society are exempted from the application of the clause to prohibit the discrimination because of religion. And when religion becomes (3) a bona fide occupational qualification reasonably necessary to the normal operation of that particular business or enterprise and (4) if the curriculum of such school, college or university, educational institution or institution of learning is directed toward the propagation of a particular religion, it is not the violation of Title VII to require the employees or the prospective employees to meet religious qualification.
The standards to decide whether the religious qualification for the employment of prospective professors by the religious university is the violation of Constitutional Law or not, are (1) the relation between the religious qualification and their business to perform in the university, and (2) the necessity to require the religious qualification. For the religious school directed toward the training of the clergy or the propagation of particular religion, it is not the violation of law to require the religious qualification of all the employees. It is necessary to codify the standard of discrimination because of religion and the specific cause for the exemption in the law.
