초록

헌법 제31조 제4항은 대학의 자율성은 법률이 정하는 바에 의하여 보장된다고 규정하고 있다. 우리 헌법재판소는 대학은 학문연구와 교육이라는 본래적 과제를 수행하기 위하여 연구와 교육에 관한 사항을 대학 스스로 규칙을 통하여 규율하고 통제하여야 하며 이를 위해 대학에는 자치입법권이 부여되고 있다고 하였다. 대학은 자신의 의사결정기구를 통하여 대학운영과 관련된 사항들을 규칙으로 제정할 수 있는 고유한 권한을 가져야 하고 대학의 장 선출방식도 이러한 자치입권에 포함된다. 대학자치행정은 헌법 제22조의 학문의 자유라는 보호영역과 밀접한 연관성을 가지는 개개의 영역을 자신의 책임 아래에서 어떠한 국가적 간섭 없이 유지하고 달성할 수 있다는 것을 의미하며 이는 대학자치의 핵심적 영역에 해당한다. 대학이 세계의 유수한 대학으로 발돋움하기 위한 첫 단계는 대학교를 대표하는 총장의 선출을 잘하는 것이다. 총장 선출과 관련하여 큰 문제로 지적되는 부분은 총장의 선출방식의 비민주성과 대학구성원과의 의사소통 부재라고 할 수 있다. 따라서 대학의 자치권에 근거를 두고 총장 선출방식에 대한 고찰을 통하여 대학발전에 이바지할 수 있는 비교법적 검토를 통해 시사점을 얻고자 한다. 특히 대학의 자율화와 민주화의 발전방향에 비추어 보더라도 총장의 선출방식이 교수･학생･직원 등 학내 여러 구성원이 참가할 수 있도록 참여민주주의를 확대하는 방향으로 나가야 한다. 특히 최근 가속화되고 있는 디지털 전환시대에 새로운 디지털 환경을 적극 활용한다면 대학의 자치와 민주주의를 실현하고 대학을 대표하는 총장에게 보다 많은 민주적 정당성을 부여하는 방식을 채택할 수 있다.

영어초록

Article 31 (4) of the Constitution stipulates that the autonomy of universities is guaranteed as prescribed by law. The Constitutional Court said that universities must regulate and control research and education matters through their own rules in order to perform the original tasks of academic research and education, and to this end, universities are given the right to self-government regulation. Universities must have their own authority to establish rules on matters related to university operation through their own decision-making bodies, and the method of electing presidents of universities is also included in this autonomous admission. University autonomy administration means that individual areas closely related to the protection of academic freedom under Article 22 of the Constitution can be maintained and achieved without any national interference under one's responsibility, which is a core area of university autonomy. The first step for universities to become the world's leading universities is to elect a president who represents them well. Regarding the election of the president, it can be said that the major problem is the undemocratic method of the president's election and the lack of communication with university members. Therefore, based on the autonomy of the university, I would like to obtain implications through a comparative legal review that can contribute to the development of the university through a review of the presidential election method. In particular, even in light of the development of university autonomy and democratization, the president's election method should be expanded to expand participatory democracy so that various members of the university, including professors, students, and employees, can participate. In particular, if the new digital environment is actively utilized in the recent accelerating digital transformation era, it can adopt a method that realizes university autonomy and democracy and gives more democratic legitimacy to the president representing the university.
