우리나라 개인정보 관리수준 진단제도의 개선방안 연구: 개인정보보호 거버넌스관점을 중심으로 (A Study on the Improvement of Personal Information Management Level Diagnosis System in South Korea: Focusing on the Governance Perspective for Personal Information Protection)

초록

제4차 산업혁명시대에서 사용되는 다양한 기술과 서비스를 바탕으로 지능형 정부를 구현하며, 국민을 위한 다양한 공공환경을 제공하고 있다. 그러나, 그 과정에서 국민의 개인정보가 오남용, 악용 등이 되는 개인정보 침해사고가 발생하고 있어, 안전한 서비스환경을 위한 개인정보보호정책이 필요하다. 이에 따라 2020년「개인정보 보호법」이 개정되어 개인정보보호위원회가 총괄부처로서의 역할을 하게 되었는데, 앞으로 주무부처로서의 역할 및 이해관계자간의 협력을 바탕으로 한 개인정보보호정책을 추진해 나가야 할 것이다.
따라서, 본 연구에서는 2008년부터 추진된 개인정보 관리수준 진단제도를 중심으로 개인정보보호를 위한 협력적 네트워크 거버넌스를 구현할 수 있는 방안을 제시하고자 한다. 이를 위해국내외 30개 유사한 평가제도에 관한 문헌검토를 하여, 대상기관규모(수), 법률규정, 평가절차, 평가기준 등을 비교요소로 차이분석을 하였으며, 개인정보보호 실무자 및 관계 전문가를 대상으로 FGI/Delphi분석을 하였다.
본 연구의 분석결과를 바탕으로, 개인정보보호위원회, 한국인터넷진흥원, 개인정보 관리수준진단위원회, 대상 공공기관과의 역할과 관계를 재정비할 뿐만 아니라, 제도적 확장성을 고려한 관계부처 및 상급기관, 진단심사원, 관계기관(위탁업체), 모니터링단, 정보주체(이용자) 등의 참여를 가져오는 개인정보보호를 위한 협력적 네트워크 거버넌스를 제안하고자 한다.

영어초록

Based on various technologies and services used in the era of the 4th industrial revolution, intelligent government is realized and various public environments are provided for the people. However, in the process, infringement incidents such as misuse and abuse of the people's personal information are occuring, so a personal information protection policy for a safe service environment is required. Accordingly, in 2020, the「Personal Information Protection Act」 was amended and the Personal Information Protection Committee took on the role of the overall ministry. In the future, it is necessary to promote a privacy policy based on the role of the competent ministry and cooperation between stakeholders.
Therefore, this study intends to suggest a method to implement cooperative network governance for personal information protection, focused on the personal information management level diagnosis system that has been promoted since 2008. In this study, the literature review was conduced on 30 similar evaluation systems in domestic and abroad and was compared the 4 factors such as target institution size, legal regulations, evaluation procedures, and evaluation standards. In addition, FGI/Delphi analysis was conducted for personal information protection practitioners and related experts.
Based on the analysis results of this study, the roles and relationships with the Personal Information Protection Committee, Korea Internet & Security Agency, Personal Information Management Level Diagnosis Committee, and target public institutions are reorganized. In addition, it should be proposed the cooperative network governance for the protection of personal information, in consideration of institutional scalability, to brings participation of related ministries and higher institutions, diagnostic examiners, related institutions (consigned companies), monitoring groups, and information subjects (users).
