17개 광역지방자치단체의 사회복지사 등의 처우 및 지위향상에 관한 조례분석 (Analysis of the Ordinance on the Treatment and Status Improvement of Social Welfare Workers, etc. in 17 Metropolitan Governments)

초록

본 연구는 17개 광역지방자치단체의 사회복지사 등의 처우 및 지위향상에 관한 조례내용을 사회적 할당, 사회적 급여, 전달체계, 재정양식에 따라 분석하여 지방자치단체간의 어떠한 차이가 있고, 상위법인 「사회복지사 등의 처우 및 지위향상을 위한 법률」에 따라 사회복지사 등의 적정 인건비에 관해 지방자치단체별로 보수수준과 지급실태를 중심으로 3년 마다 조사 공표하도록 하는 개정된 사항이 얼마나 반영이 되었는지를 분석하였다. 이를 통하여 17개 광역지방자치단체의 조례에서 사회복지사 등의 처우가 개선될 수 있는 유익한 수익적 조치가 포함될 수 있도록 개선방안을 제시하는데 목적이 있다.
연구결과는 다음과 같다.
첫째, 사회적 할당은 충청북도를 제외하고 16개 광역지방자치단체가 사회복지사업에 종사하는 사회복지사 등으로 표현하였다.
둘째, 사회적 급여는 처우개선과 지원계획에 대해서는 대부분 강행규정이었고, 신분보장, 인권옹호, 신변안전보호에 대해서는 임의규정, 노력규정, 강행+노력규정, 강행규정 등 지자체별로 다양하게 나타났다. 도지사와 시장의 책무에 대해서는 17개 광역지방자치단체가 노력규정, 지원센터와 권익옹호지원센터는 각각 부산광역시 및 경상남도와 제주특별자치도에 임의규정을, 안전한 근무환경에 관해서는 6곳만 노력규정이었다.
셋째, 전달체계는 지원계획에 대해서는 경상북도와 대구광역시를 제외하고는 모두 강행규정, 실태조사는 경기도, 경상남도, 제주특별자치도를 제외하고 모두 강행규정, 위원회에 대해서는 명칭만 다를 뿐 17개 광역지방자치단체가 모두 운영 중에 있었다.
넷째, 재정양식은 책무는 제주특별자치도를 제외하고 노력규정, 실태조사는 충청북도를 제외하고 모두 임의규정, 처우개선사업은 과반수가 임의규정, 인권 및 권리 옹호, 신변안전과 인권보장, 신변보호 등에서 임의규정과 강행규정이 혼재되어 있다. 또한 지원사업은 전라북도만 강행규정이었고, 지원센터, 안전한 근무환경 조성, 수당과 여비, 포상, 보조금 교부, 종합계획 등에 대해서는 임의규정이었고, 17개 광역시가 상이한 모습을 보였다.
개선방안을 제시하면 다음과 같다.
첫째, 사회적 할당은 충청북도의 경우를 참고하여 16개 광역지방자치단체가 수정해야 한다.
둘째, 사회적 급여는 임의규정을 강행규정화하고, 지원사업 부분에 모든 규정을 갖고 있는 광주광역시의 조례를 기준으로 삼아 개정하여야 한다.
셋째, 전달체계는 종합계획에 대해서 경상북도와 대구광역시가 강행규정을 새롭게 추가하여야 하고, 실태조사에 대해서는 경기도, 경상남도, 제주특별자치도가 강행규정화할 필요가 있다.
넷째, 재정양식은 책무에 대해서는 노력규정을 확대하여 강행규정화하고, 실태조사는 상위법인 「사회복지사 등의 처우 및 지위향상을 위한 법률」에 맞게 강행규정화해야 한다. 특히 제주특별자치도를 기준으로 인건비의 적정수준과 보수수준을 새롭게 담아야 하고, 신분보장에 대해서는 전라북도의 경우를 참고하여 강행규정화해야 한다.

영어초록

This study analyzed the contents of the ordinance on the treatment and status improvement of social workers in 17 metropolitan governments according to social allocation, social provision, delivery system, mode of finance. According to the upper corporation 「ACT ON THE IMPROVEMENT OF TREATMENT AND STATUS OF SOCIAL WORKERS, ETC」, the revised matters that require local governments to investigate and publish proper labor costs of social workers every three years based on remuneration level and payment status were analyzed. Through this, the purpose of the ordinance of 17 metropolitan and provincial governments is to present measures to improve the treatment of social workers, etc. so that beneficial and profitable measures can be included.
The results of the study are as follows.
First, the social allocation was expressed by 16 metropolitan and provincial governments, except for Chungcheongbuk-do, as social workers engaged in social welfare projects.
Second, the social provision was mostly enforced regulations on treatment improvement and support plans, and various local governments such as dispositive regulations, effort regulations, imperative + effort regulations, and imperative regulations on identity security, human rights protection, and personal safety protection. 17 metropolitan governments regulated efforts for governors and mayors, while support centers and rights support centers provided dispositive regulations to Busan Metropolitan City, Gyeongsangnam-do Province and Jeju Special Self-Governing Province, and only six for a safe working environment.
Third, the delivery system has the form of imperative regulations for all support plans except Gyeongsangbuk-do and Daegu Metropolitan City, while the fact-finding survey has the form of imperative regulations for all except Gyeonggi-do, Gyeongsangnam-do, and Jeju Special Self-Governing Province. As for the committee, It's just a different name and all 17 metropolitan and provincial governments were in operation.
Fourth, the mode of finance is in the form of effort regulations except for Jeju Special Self-Governing Province, actual investigations are all in the form of dispositive regulations except Chungcheongbuk-do, and dispositive and imperative regulations are mixed by a majority of them. In addition, the support project was in the form of a imperative regulation only in Jeollabuk-do, and it was in the form of dispositive regulations for support centers, safe working environment creation, travel expenses, rewards, subsidies, comprehensive plans, etc. Moreover, 17 metropolitan cities showed different appearances.
Suggesting improvement measures is as follows.
First, the social allocation should be modified by 16 metropolitan and provincial governments in consideration of the case of Chungcheongbuk-do.
Second, the social provision should be imperative regulated by dispositive regulations and amended based on the ordinance of Gwangju Metropolitan City, which has all the regulations in the part of the support project Third, the delivery system should be newly added by Gyeongsangbuk-do and Daegu Metropolitan City in the form of imperative regulations for the comprehensive plan, and Gyeonggi-do, Gyeongsangnam-do, and Jeju Special Self-Governing Provinces need to be imperative regulated by dispositive regulations for the survey.
Fourth, the mode of finance should be imperative regulated by expanding the regulation of efforts for its responsibilities, and the fact-finding survey should be imperative regulated in accordance with 「ACT ON THE IMPROVEMENT OF TREATMENT AND STATUS OF SOCIAL WORKERS, ETC」 of the higher law. In particular, the appropriate level of labor costs and the level of remuneration should be newly included based on Jeju Special Self-Governing Province, and the regulation of the security of identity should be made in consideration of Jeollabuk-do's case.
