외국의 개인정보보호법제와 감독기구에 대한 고찰－ 미국, 캐나다, 호주를 중심으로 － (A Study of Foreign Data Protection Laws and Supervisory Bodies)

초록

미국과 캐나다는 공공부문과 민간부문에 적용될 수 있는 개인정보와 관련한 법을 별도로 두고 있는 반면, 호주는 공공부문과 민간부문에서 공통적으로 적용되는 법률을 마련하고 있다. 다만 이들 국가들은 연방차원뿐만 아니라 각 州 차원에서 다수의 개인정보보호법률을 제정 및 시행하고 있다는 점에서 입법적으로 다소 복잡한 체계를 가지고 있다. 또한 미국은 캐나다나 호주와 달리 민간의 각 산업분야별로 각기 다른 법률들이 적용된다는 점에서 차이가 있다. 이러한 입법체계의 차이점은 결국 공공과 민간의 양 부문에서 개인정보가 가지는 의미와 특성을 어떻게 보느냐에 대한 관점의 차이라고 볼 수 있다. 다음으로 캐나다와 호주는 개인정보를 감독하는 독립된 전담기구를 두고 있다. 반면 미국은 개인정보를 관할하는 독립된 기구를 두지 않고, 영역별로 관련된 기관이나 정부부처가 개별적인 감독을 하고 있다. 미국의 이러한 분야별․영역별 입법 및 감독체계는 개인정보보호의 일관되고 통일적인 수행에 단점이 될 수 있다. 하지만 미국은 민간부문의 자유로운 정보유통의 보장, 해당부문의 특성 및 자율성 존중, 민간부문의 각 산업별 특성 등의 고려를 통하여 특성화되고 탄력성 있는 개인정보의 보호를 위한 법집행과 관리․감독에 더 무게를 둔 것으로 판단된다.

영어초록

The United States and Canada as a federal state has such laws on protection of personal data, which are separated from each other on each public and non-public agencies. In contrast, Australia has a law for the protection of personal data, which is jointly applicable to both public as well as private parties. In these states, even those different national laws for the protection of personal data, which of course in the context of the countries concerned shall apply in addition to federal law. For these reasons is to say that their legal systems for data protection reasonably characterize by such complexity. In addition, see the US, unlike Canada and Australia, according to the industrial sector any different laws related to the protection of personal data use. Finally, these deviations of the data protection regulatory systems in the US, Canada and Australia act accordingly, as described in the personal data and their legal protection is understood in the public and non-public bodies. Furthermore, can be set up which is permanent supervisory body, which is of course responsible for the protection of personal data and this controlled independently in Canada and Australia. By contrast, no independent supervisory body should be set up in the United States; the protection of personal data according to individual area. Here, the differing legislative or control for the protection of personal data according to the individual area in the United States on the one hand lead to prevent that data protection is constantly and consistently perform; this legal situation may still other hand, be understood in that the control system is on data protection in the United States rather based on the fact ensured, for example, the free movement of such data in the context of non-public bodies and the characteristics and nature of relevant region to be guaranteed. Finally, the regulatory system relating to data protection in the United States may indeed be used, taking into account individual industrial sector and hence also its proportionate control of appropriate and flexible design privacy related legal norms.
