초록

데이터 3법으로 데이터를 안전하게 활용하고, 디지털 뉴딜정책 구현을 위한 법적 토대를 마련하였다고 말해도 과언이 아니다. 데이터 3법을 통한 데이터 산업의 발달로 국민 개개인의 개인정보들이 다양한 서비스에서 활용 될 수 있기 때문이다. 그러나 그 활용 범위는 몹시 넓은 것이어서, 일반인이 자기 개인정보의 쓰임을 속속들이 파악하기란 쉽지 않다. 또한 개인정보 이용 기술과 관리 방안에 대한 것들이 나날이 발전하고 있지만, 악용 및 남용하는 시도 역시 증가하고 있는 추세이다. 개인정보를 목표로 하는 대규모 해킹 시도와 사이버 공격이 잦아지는 가운데, 전 세계의 국가들이 자국민들의 정보보호를 위해 애쓰고 있으며 개인정보 보호 강화 논의가 지속되고 있다. 이에 맞춰 국내에서도 최근 몇 년 사이에 개인정보보호와 관련된 법령의 제정 및 개정이 반복적으로 이루어지고 있고, 여러 가지의 입법안 및 법률개정안이 지속적으로 논의되고 있다.
데이터 3법 시행 이후 확대될 수 있는 공공데이터의 활용을 촉진하기 위해서는 정보주체가 신뢰할 수 있는 환경을 조성해야 한다. 이를 위해서는 개인정보 보호법에서 규정하고 있는 정보주체의 권리나 각 관계법에서 보장하고 있는 정보주체의 권리 등을 최대한 보장할 수 있도록 절차를 구체화하고 정보주체가 쉽게 권리를 행사할 수 있도록 정보주체의 권리를 실질화해야 한다. 또한 각 데이터들을 민간 제공 또는 가명화하여 결합하도록 하는 경우에도 정보주체의 개인정보보호는 확고하게 이루어진다는 신뢰를 주어야 한다. 이를 위해서 가명처리에 대한 관리 및 감독을 강화하고, 기준과 절차를 투명하게 유지하여야 한다. 투명성 확보와 적법절차에 따른 데이터 제공 및 활용이 되어야만 정보주체의 권리보장과 안전한 활용의 조화가 실현될 수 있을 것이다.
데이터 경제는 산업적 의미가 크다. 데이터 산업 자체로도 엄청난 부가수익을 창출할 수 있지만 혁신 산업 촉매로도 작용할 수 있기 때문이다. 따라서 이미 많은 해외의 국가들은 데이터에 관한 많은 법·제도를 수립하여 앞서가고 있다. 뒤쳐진 우리나라로서는 데이터 산업이 활성화된 해외 국가를 따라잡기 위해서 정부와 민간이 공동으로 힙을 합쳐야할 필요성이 있다. 해외의 여러 데이터 산업 활성화 정책의 성공사례를 벤치마킹하여 정부의 규제는 보다 안정적인 보안 체계를 설립해야 하고, 기업들의 자발적인 산업 활성화를 유도해야 한다. 만약 정부의 정책과 입법의 방향이 일관되게 제시되지 못한다면, 데이터 산업의 발전 및 국민의 권리 보호 모두 요원해질 가능성이 크다. 개인은 자기책임에 입각한 최종결정자 역할로서 자기결정을 행사할 수 있어야 하며, 기업은 데이터 활용을 하는 주체로서 개인의 자기결정을 존중해야 할 것이다.

영어초록

It is no exaggeration to say that the Data 3 Act safely utilizes data and provides a legal basis for implementing digital New Deal policies. This is because the development of the data industry through the Data 3 Act can utilize personal information of individual people in various services. However, the scope of its use is so wide that it is not easy for the general public to grasp the use of their personal information. In addition, while the technology and management methods of personal information use are developing day by day, attempts to abuse and abuse are also increasing. With massive hacking attempts and cyber attacks targeting personal information becoming more frequent, countries around the world are struggling to protect their own information and discussions on strengthening personal information protection are continuing. In Korea, the enactment and revision of laws related to personal information protection have been repeated in recent years, and various legislative proposals and legislative amendments have been continuously discussed.
In order to promote the utilization of public data that can be expanded after the implementation of the Data 3 Act, the information subject must create a reliable environment. To this end, the procedures should be specified so that the rights of the information subject prescribed in the Personal Information Protection Act or the rights of the information subject guaranteed by each related law can be guaranteed as much as possible, and the rights of the information subject should be materialized so that the information subject can easily exercise the rights. Also, even if each data is provided or pseudonymized, it should give confidence that the protection of personal information of the information subject is firmly done. To this end, management and supervision of a pseudonym processing should be strengthened, and standards and procedures should be kept transparent. Only when the data is provided and utilized according to the transparency and due process, the harmony between the rights of the information subject and the safe use can be realized.
The data economy has a great industrial significance, as the data industry itself can generate huge additional revenue, but it can also serve as an innovation industry catalyst. Therefore, many foreign countries have already established many laws and systems on data and are leading. For the lagging country, it is necessary for the government and the private sector to jointly combine the heaps to catch up with the overseas countries where the data industry is activated. By benchmarking the success stories of various data industry activation policies abroad, government regulations should establish a more stable security system and encourage companies to revitalize their industries voluntarily. If the direction of government policy and legislation is not consistently presented, it is highly likely that the development of the data industry and the protection of the rights of the people will become a problem. Individuals should be able to exercise self- determination as the final decision maker based on self-responsibility, and companies should respect individual self-determination as the subject of data utilization.
