초연결사회에서 개인정보보호법제 정비방안에 관한 연구 (A Study on the Improvement of Personal Information Protection Legislation in the Hyper-Connected Society)

초록

사물인터넷과 빅데이터의 발전으로 인하여 우리 사회는 쇼핑, 의료, 교육, 선거, 법의 집행, 범죄와 테러리즘 예방, 사이버 보안, 기업 운영과 정책 결정 등 거의 전 분야에 근원적이고 혁신적인 영향을 받고 있다. 하지만 사물인터넷의 이용을 위해서는 관련 기술의 발전은 물론 기업 문화는 물론이고 법적 제도의 변화도 요구한다. 기존 정보사회의 기술적 특성이 시간과 장소에 구애받지 않는 연결을 가능케 하면서 사람과 사람 사이의 의사소통의 시간과 공간의 압축을 지향했다면, 초연결사회는 ‘연결의 대상이 모든 사물에게까지 확대된’ 사물인터넷과 빅데이터 기술을 기반으로 사람과 사물, 사물과 사물 간의 광범위한 연결과 소통을 가능케 하고 있다고 한다. 이에 따라서 초연결사회에서는 그동안 물리적으로 존재하던 모든 것들이 네트워크로 연결되며 그동안 그 경계가 이미 희미해져 왔던 오프라인과 온라인의 경계가 드디어 무너지게 되는 것이다. 사물인터넷, M2M과 같은 개념들이 사물들과 기계들 간의 연결만을 의미했던 반면, 초연결사회의 가장 큰 특징은 인간, 사물, 기계가 모두 항상 연결되어 있다는 것이다. 결국 4차 산업, 빅데이터, 사물인터넷, 인공지능, 로봇, 자율주행차 등의 발전에 따른 초연결사회의 핵심은 정보의 공개와 공유가 핵심인 바, 이러한 공유와 공개의 대상에 개인정보가 포함되어야만 하는지, 얼마만큼 포함되어야 하는지를 검토해야 한다. 이제 초연결사회의 기술적 발전에 대한 규범적 평가와 통제에 대한 고민이 필요하다. 이러한 규범적 판단의 중요한 요인 중 하나가 인간존엄 및 개인정보자기결정권이다. 이제 중요한 것은 두려움의 대상인 정보처리를 가능한 한 투명화함으로써 기술적 발전에 관하여 ‘규범적으로’ 판단하고 예측함으로써 인간의 존엄성과 자율을 초연결사회에사도 계속해서 보호해야만 한다는 것이다. 그러므로 개인정보자기결정권의 목표는 초연결사회에서 특히 인간의 자율적 의사소통능력을 보장하는 데에 있다.

영어초록

Due to the development of the Internet and Big Data, our society is undergoing fundamental and innovative influences in almost all areas such as shopping, health care, education, elections, law enforcement, crime and terrorism prevention, cyber security, corporate operations and policy decisions. However, in order to use the Internet of things, not only the development of related technologies, but also the change of the legal system as well as the corporate culture are required. The technical characteristics of the existing information society aimed at compressing the time and space of communicating between people, enabling connection without regard to time and place. On the other hand, The hyper-connected Society enables a wide range of connections and connections between people, things, things and things based on the Internet of Things and the Big Data technology, which are ‘objects of connection extended to all objects’. Therefore, in the hyper-connected society, everything that has existed physically has been connected to the network, and the boundaries of offline and online, which have already become blurred, are finally collapsed. While the concepts such as Internet of things and M2M mean only the connection between objects and machines, the most important feature of the superconducting society is that people, objects and machines are always connected. Ultimately, the core of the hyper-connected society is the core of information sharing and sharing, which is the key to the development of the 4th industry, Big Data, Internet of things, artificial intelligence, robots and autonomous vehicles. Should be included, and how much should be included. Now, we need to worry about normative evaluation and control of technological development of early-connected society. One of the important factors in this normative judgment is human dignity and personal information self–determination. Now it is important that the dignity and autonomy of human beings should continue to be protected even in the hyper-connected society by 'normatively' judging and predicting technological development by making the processing of information, which is the subject of fear, as transparent as possible. Therefore, the goal of personal information self-determination is to ensure autonomous communication, especially in the hyper-connected society.
