개인정보보호 수행체계 법제의 개선방향에 관한 연구 (A Study on Improvement Direction of the Personal Information Protection Governance Legislation)

초록

정보통신기술(ICT)과 인공지능(AI) 기술이 발달되고 융합되면서 4차 산업혁명을 탄생시켰고, '초연결', '초지능', '초융합'을 특징으로 하는 지능정보화 시대에서 개인정보의 보호와 활용의 문제는 현대 사회의 새로운 패러다임을 불러오고 있다. 지능정보사회에서는 정보의 이용이 비약적으로 증대되어 개인정보의 가치는 더욱 높아질 것이다. 이러한 개인정보의 보호와 안전한 활용을 위해서는 실효성 있는 법제도와 수행체계의 정립이 필요하다.
효과적인 개인정보보호의 수행체계를 정립하기 위해서는 필수적인 전제로 요구되는 것이 개인정보보호기관의 존재이다. 그 역할을 효과적으로 수행하기 위해서 개인정보보호기관은 세부적인 기능과 권한을 갖춰야 하고 독립성이 보장되어야 한다. 세계 각국에서도 개인정보보호기관을 두고 기능과 권한, 독립성을 보장하고 있다.
한국에서도 「개인정보 보호법」의 개정을 통해 법제를 정비하고 수행체계의 실효성을 확보하고자 하였다. 중복규제의 정비를 통해 입법체계를 일원화하였고, 개인정보보호위원회의 기능과 권한을 강화시켜 독립성을 확보하였다.
그러나 여전히 개인정보보호를 위한 법제와 수행체계에 미비점이 존재하고 이를 보완해야 할 필요성이 있다. 일부 영역에서는 중복규정이 존재한다, 「신용정보법」의 개인정보보호에 관한 규정을 살펴보면 상당 부분 「개인정보 보호법」의 규정으로 통합되었지만 「개인정보 보호법」과 유사한 내용을 가진 규정이 여전히 남아있어 법제의 정비가 필요하다. 그리고 개인정보보호위원회의 위원구성을 대통령이 아닌 국회가 위원의 임명에 우선적인 결정 권한을 갖도록 하는 것은 위원회의 정치적 독립성을 해칠 우려가 있다. 따라서 보호위원회의 위원을 구성함에 있어 대통령이 지명권한을 가지고 국회는 견제와 균형의 관점에서 승인권한을 가지도록 하는 것이 위원회의 정치적 독립성을 보장하는 방법일 것이다. 나아가 개인정보보호위원회가 전문성을 확보하기 위해서는 한국인터넷진흥원의 개인정보보호 기능을 수행하는 조직을 분리하여 소관기관으로 ‘한국개인정보보호원 등’ 지원조직을 설립할 필요가 있다.
개인정보의 활용과 보호에 관한 새로운 균형이 요구되고 있는 시점에서 개인정보보호를 위한 법제와 수행체계의 미비점은 면밀히 검토되어야 한다. 이에 본 연구가 개인정보의 보호와 안전한 활용을 위해 법제와 수행체계를 정립하는 데 참고자료가 될 수 있기를 기대해본다.

영어초록

The 4th industrial revolution emerged from the development and convergence of information and communication technology (ICT) and artificial intelligence (AI) technology. The era of intelligent informatization is characterized by "hyper-connectivity", "super-intelligence", and 'super-convergence", and the issue of protecting and utilizing personal information is bringing a new paradigm in modern society in the era. In the intelligent information society, information will be used exponentially more, and the value of personal information will further increase. The establishment of an effective legal system and an implementation system is needed for the protection and safe use of such personal information.
The existence of a personal information protection agency is an essential premise to establish an effective personal information protection system. The personal information protection agency must have detailed functions and authorities, and its independence must be guaranteed to allow it to effectively perform its role. Many countries in the world have personal information protection agencies, and they ensure the functions, authorities, and independence of their agencies.
South Korea also tried to reform the legal system and secure the effectiveness of the execution system by amending the Personal Information Protection Act. It unified the legislative system by reorganizing redundant regulations and secured independence by strengthening the function and authority of the Personal Information Protection Committee.
However, the legislation and execution systems for protecting personal information are still insufficient, and it is needed to supplement them. Redundant regulations exist in some areas. Although a large portion of regulations on personal information protection under the "Credit Information Act" has been integrated into the provisions of the "Personal Information Protection Act", it still has provisions covering similar contents to the "Personal Information Protection Act". Therefore, it is necessary to improve legislation. Moreover, the National Assembly, not the president, has superior power in appointing the members of the Personal Information Protection Committee, and it poses a risk of harming the committee's political independence. Consequently, it would be a way to ensure the committee's political independence in terms of checks and balances that the president has the right to appoint the members of the Personal Information Protection Commission and the National Assembly has the authority to approve these members. Furthermore, in order for the Personal Information Protection Committee to secure expertise, it is necessary to establish a support organization such as the Korea Personal Information Protection Agency as a competent institution by separating the organization that performs the personal information protection function of the Korea Internet & Security Agency.
Deficiencies in the legislation and performance systems for personal information protection must be carefully reviewed as it is required to find a new balance between the use and protection of personal information. Therefore, it is hoped that the results of this study can serve as a reference for establishing legislation and implementation systems for protecting and safely using personal information.
