초록

본 연구는 공군비행장에서 발생한 소음침해에 대한 손해배상청구 사건과 관련된 법적 쟁점의 해결을 목표로 한다. 결론은 다음과 같다.
첫째, 민법 제217조는 인접하는 부동산의 사용을 둘러싼 부동산 물권 사이의 관계를 규율하기 위해 제정된 것이니 만큼, 민법 제217조의 보호법익은 인접 부동산의 물권으로 보아야 한다.
둘째, 비록 수인한도론이 민법 제217조의 해석상 필요에 의해 창안된 이론이긴 하지만, 코즈의 ‘상호성이론’의 취지를 고려할 때, 민법 제217조뿐만 아니라 일반적인 가해행위 전부에 관한 위법성 판단 기준으로 활용될 수 있다고 본다. 하지만 상호성의 정도가 낮은 경우, 교정적 정의에 입각한 사안해결이 필요한 경우, 권리의 중핵에 대한 침해가 문제되는 경우에는 수인한도론의 적용을 제한하는 것이 타당하다.
셋째, 수인한도 초과 여부를 결정하는 기준 중 하나인 소음기준의 확정은 전형적인 조정문제이므로, 가급적 기존의 행정법규와 행정관행 및 판례 등을 존중하여 기준의 정립에 소요될 사회적 비용을 최소화해야 한다.
넷째, “주거환경악화로 인한 정신적 손해” 중 “소음으로 인한 생활상 불편이 야기한 정신적 손해”는 분쟁의 일회적 해결 필요성을 고려할 때 토지의 사용방해로 인한 재산적 법익의 침해로 보는 것이 타당하다. 따라서 이 경우에는 수인한도론의 적용이 있다. 한편 “주거환경악화로 인한 정신적 손해”가 단순한 생활상 불편을 넘어 “육체적⋅정신적 건강의 훼손”에 이를 경우에는 인격권의 침해로 새겨야 한다. 이 때 인격권의 침해로 인정받기 위해서는 수인한도를 넘는 육체적⋅정신적 건강의 훼손이 있어야 한다.

영어초록

This article aims to answer the legal questions raised in cases where the plaintiff seeks compensation for damage caused by noise created from air force bases. The conclusions are summarized as follows:
First, the purpose of Section 217 of the Civil Act is interpreted to protect property interest attached to neighboring land and buildings, thus carving personal interest to live in decent conditions out of its application.
Second, the “doctrine of tolerability,” a kind of balancing test, is devised to reasonably interpret Section 217 in particular. When viewed through the lens of Ronald Coase's concept of reciprocity, however, it should be deemed as a general test to judge illegality for all types of torts. It is important to note that the doctrine of tolerability may be inapplicable in cases where the extent of reciprocity is low, where the “corrective justice” is deemed more appropriate as the regulative idea, and where the defendant’s action in question may infringe upon the core of the plaintiff’s right.
Third, determining “intolerable” level of noise indicates a typical example of coordination problem. The social cost is minimized when the level is determined with existing regulations, administrative practices and court precedents taken into account.
Fourth, the “emotional distress from discomfort caused by the noise,” a sub-concept of the “emotional distress from degradation of residential environment,” should be categorized as an infringement on property interest, and not on interest in person. It is more so when one takes into account the need to comprehensively resolve the pertinent issues of nuisance cases. The doctrine of tolerability is applicable to the emotional distress from discomfort caused by noise. On the other hand, if the degradation of residential environment causes more than mere discomfort, resulting in “degradation of physical and mental health,” it should be deemed as an infringement on the plaintiff's interest in person on the condition that the degradation of physical and mental health is so severe as to be deemed “intolerable.”
