초록

딥 링크는 인터넷 방문자에게 채널을 접근함에 있어 편리를 가져다주는 한편 저작권자의 합법적 권익을 침해하고 인터넷의 정상적인 질서를 방해하고있다. 형사사법 분야에서 저작권 침해는 딥 링크 행위를 규제하는 주요한 법적근거이지만, 중국법상 딥 링크에 대한 구체적인 규정이 없기 때문에 그 행위와판결문제 및 구체적인 경로에 대해 논란이 따른다. 이러한 문제를 해결하기 위해 전면적으로 딥 링크 행위의 기술속성과 적용모델을 파악하고 이에 대한 형벌 및 법규제정의 필요성을 분류한 후 그것을 바탕으로 저작권 침해 및 규제의정당성을 분석하여 딥 링크 행위를 정보네트워크 전송행위로 규정해야 한다.
본 논문에서는 딥 링크의 불법이용을 단독범에 해당하는 것과 공동정범으로조사하는데 단독범의 경우 딥 링크의 법적 성격을 다르게 인정하고 ‘법적권리자의 허가없이’ 인정하기 어려운 문제가 있다. 이를 바탕으로 중국법상 딥링크의 법적 성격을 통일하여 사건 재판의 기준을 동일화시키고 묵시적 허용 범죄요건을 추가하여 인터넷 환경에서 저작권자의 의사인정이 어려운 문제를 대처해야 한다. 저작권침해 공동정범에서는 주로 불법사이트에 대한 딥링크 설치를 다루는데, 현재 학학계와 실무에서는 대부분 방조범의 관점에서 일반방조범, 일방적 공범과 방조하는 행위의 정범화 관점에서 규제하고 있으나 여전히미흡한 부분이 있다. 때문에 딥링크 행위를 정범으로 규제하고 행위공동설의이론에 따라 공동범죄자의 의사연락 인정의 어려운 문제 및 불법사이트에 대한 정확한 인식범위를 명확히 해야 한다. 마지막으로, 합리적인 규제를 통해저작권 침해의 시각으로 딥 링크 행위를 규제하도록 명확한 방법을 제시하여저작권자와 인터넷을 보호해야 할 것이다.

영어초록

Deep linking, as a neutral network technology, means that the linker sets up the link through a specific paging address, so that the URL of the linked object is embedded in the linking website or web page, which also means that when the user clicks on the deep link on the linking website, he or she can directly skip the linked website, so as to obtain the content of the linked website in the linking website. Deep linking behavior in providing visitors with convenient access channels at the same time may also violate the legitimate rights and interests of copyright owners, the normal order of the Internet caused by interference. In the field of criminal justice, the crime of copyright infringement is the main legal basis for regulating deep-linking behavior, but since there are no specific provisions on deep-linking in our laws, it leads to a lot of controversy in practice over the behavioral characterization of deep-linking, the issue of incrimination and the specific path of incrimination. In order to solve this dilemma, first of all, the technical attributes and application mode of deep-linking behavior are comprehensively grasped, and the necessity of criminal regulation of deep-linking behavior is sorted out, based on which the legitimacy of regulation of copyright infringement is specifically analyzed, and the behavior of deep-linking behavior is characterized as the behavior of dissemination of information network. Through analyzing judicial cases, the illegal use of deep-linking behaviors are explored as separate crimes and joint crimes, and in the separate crimes of copyright infringement, there are mainly different determinations of the legal nature of deep-linking behaviors, difficulties in determining “without the permission of the right owner”. “Based on this, China should unify the legal nature of deep-linking so as to make the standard of adjudication consistent, add the element of implied license to cope with the difficulty of determining the will of the copyright owner under the Internet environment. In the joint crime of copyright infringement, which mainly involves setting up deep links to illegal websites, most of the current theoretical and practical circles start from the perspective of helping offenders, and regulate this type of crime from the perspectives of general helping offenders, one-sided accomplices, and the criminalization of helping behaviors, but all of them are insufficiently regulated, based on which it is justified to regulate the act of deep linking as a positive offense from a new perspective, and based on this, it is justified to follow the theory of joint behaviors to solve the issue of joint offenders. Based on this, it is justified to regulate deep-linking behavior as a positive offense from a new perspective, and on the basis of this, to follow the theory of common theory of behavior to solve the difficult problem of identifying the criminal intent contact of joint offenders as well as to clarify the scope of identifying the ”knowledge“ of the linker of the illegal website. In the end, through the reasonable regulation of deep linking behavior, a clear path can be provided for the regulation of deep linking behavior by the crime of copyright infringement, with a view to improving the protection of copyright holders and the Internet.
