북한 투자기업의 분쟁해결방안 연구: 북한법을 중심으로 (Research on dispute resolution of foreign investment enterprises in North Korea：based on the law of North Korea)

초록

북한은 1984년 합영법 제정 이후 지금까지 외국인투자 유치를 위해 노력하고 있다. 지난 34년간 수많은 북한투자사례가 있었고, 그 과정에서 다수의 분쟁이 발생했다. 이 논문은 북한 투자로 인해 분쟁이 발생했을 경우에 북한법상 어떤 분쟁해결수단이 있는지, 그 각각의 장단점은 무엇인지, 향후 북한에 투자할 기업이 고려해야 할 사항은 무엇인지를 살펴보았다.
실태조사에 의하면, 최근까지 북한 내에서 민사분쟁이 발생하였을 경우에는 대부분 소송외적 방법으로 해결되었다. 북한 내에도 민사재판이 있지만 가사사건이 큰 비중을 차지하고 민사분쟁은 비중이 낮다. 이런 상황에서 북한지역에 투자하려는 외부 투자자는 분쟁발생시 합리적인 해결방안이 있는지 의문을 갖게 될 것인바, 합리적인 분쟁해결제도를 구축하는 것은 북한투자의 승패에 중대한 영향을 미칠 것이다.
이 논문에서는 외국인투자기업 관련한 실제 분쟁사례를 살펴보고, 개별 사례에 적합한 북한법상 분쟁해결제도를 검토하였다. 이어서 분쟁해결제도의 장래를 전망하였다. 연구결과, 북한에서 대북투자와 관련한 분쟁이 다양하게 발생하고 있고, 북한법상 허용되는 분쟁해결 제도는 다양하고 각 제도별로 장단점이 있음을 알게 되었다. 따라서 분쟁의 성격과 규모에 따라 적합한 분쟁해결방법을 찾아야 한다. 향후 분쟁유형별 사례를 하나씩 축적해가면 예측 가능성과 투명성이 높아질 것이다. 분쟁해결제도가 합리적 수준에서 정착되면 북한에 대한 외국인투자도 활기를 띠게 될 것이다. 북한 내 분쟁해결제도는 북한의 제도이지만 북한에 투자하는 것은 외국인투자자이므로 분쟁해결제도의 형성과 운영에는 투자당사자들의 의견도 고려해야 한다. 또한 장차 남한도 북한에 투자할 것인바, 남북한 사법공조와 법조 인력의 교류에도 관심을 가져야 할 것이다.

영어초록

As of 1984, when North Korea enacted the Equity Joint Venture Law, North Korea has been endeavoring to attract foreign investment. For the last 34 years, there has been numerous investment cases in North Korea, and during those processes, many disputes have occurred. This paper is about the dispute resolution options North Korea has based on its law when an foreign investment dispute arises, the advantages and disadvantages of each resolution method, and what future investment enterprises who wish to invest in North Korea should consider. Survey results show that until recently whenever a civil case arose in North Korea, most of them were solved through non-judicial methods. Although there are civil courts in North Korea, domestic cases are mostly dealt, thus leaving little room for civil cases. In such situations, foreign investors will wonder whether there is a reasonable way of resolving disputes in North Korea. Building a reasonable dispute resolution method will be critical for the outcome of investing in North Korea.
This paper will go over real dispute cases of foreign investors and the respective suitable dispute resolution methods based on North Korean law. Furthermore, this paper notes the future of North Korea dispute resolution. Results indicate that there are many foreign investment disputes occurring in North Korea and that the dispute resolution methods allowed by North Korea law are numerous with their respective pros and cons. Thus, one needs to find the appropriate method for each differing disputes based on their characteristics and scale. If we accumulate data on categorized future disputes, it will become more predictable and transparent. When the resolution methods are set at a reasonable level, foreign investment in North Korea will flourish. Although it is up to North Korea to decide on the resolution methods, since the foreign investors are the one who are investing, North Korea should also consider the investors’ opinions. Also, since South Korea will soon start to invest in North Korea, it should take special interest in mutual exchanges of judicial assistance and legal entities.
