초록

유비쿼터스 사회에서는 전통적으로 주도권을 갖고 있던 국가와 언론이 디지털 미디어의 발달로 정보통제 권력의 지배가 약화되어 가고 있고, 상대적으로 수동적이던 국민이 보다 능동적이고 적극적인 표현권의 주체가 되어 가고 있다. 유비쿼터스 사회에서는 고도의 컴퓨터 기술과 네트워크 구축으로 기존의 미디어 영역 간 구분을 와해시키고 「언론」과 「통신」과 「방송」의 융합을 촉진시켰다. 인터넷을 통한 다양한 여론형성과 다양한 정보교환이 국민들에게 이루어져서, 종전의 국가와 언론이 갖던 정보독점이 와해되고 있고, 국가나 언론에 소외받던 국민들이 사이버 공간을 통하여 자신들의 사상이나 의견을 제시하는 각종 홈페이지나 미니 홈피, 포털 사이트의 각종 게시판이 활성화 되어 경우에 따라서는 사이버 공간이 국가나 언론보다도 더 영향력이 강해질 수 있다.
사이버 공간의 포털 사이트, 각종 게시판, 블로그, 홈페이지, 미니홈피 등은 자기 자신의 사상이나 의견, 정보 등을 올리는 사적 공간이다. 그러나 이 사적 공간에 쓴 글이 매스미디어만큼 사회적 영향력을 갖추게 된 것이다. 이 점 때문에 사이버공간 속의 블로그, 홈페이지, 미니홈피, 게시판 등은 사적공간이지만 거기에 실린 콘텐츠에 불특정다수가 접근할 수 있는 사회적 公共廣場(public forum)이 된다.
사이버 공간을 사회적 公共廣場(Public Forum)으로 본다면, 지금까지 불완전한 권리에 머물던 액세스권과 알권리가 각종 사회문제, 정치문제, 경제문제, 환경문제, 소비자 주권문제 등 각종 현안을 해결할 수 있는 시민운동으로 구체화되는 능동적 액세스권과 알권리가 되어 전자민주주의를 구현 할 수 있게 된다. 그러므로 사이버 공간 속 公共廣場(Public Forum)에서 나타나는 많은 부작용이 있다 하더라도 국가는 원칙적으로 개입해서는 아니 된다.

영어초록

The digital media in ubiquitous society has played a leading role in the development of society. The digital media which is used by means of bilateral network makes the social culture of new paradigm by changing the structure of mass media rights. This leads to the new revolution of digital media.
So the bilateral relationship ‘state vs. mass-media and people’ changes to the trilateral relationship 'state vs. mass media vs. people. Since the weakest part ‘people’ is given the right of balanced freedom of speech, the rights of access and knowledge are achieved.
This right is a characteristic of the bilateral communication shown in the ubiquitous society, and the right appears in the cyber space where people express opinion and information in internet, blog, homepage and mini-homepage. It is the case that this social movement forms a stronger public opinion than state and mass media
The new power relationship is made by formation of public opinion and exchange of information through internet. People who have alienated from the state and mass media make this relationship.
In the ubiquitous society, with the development of internet and digital network technique, people, who take a passive position, can use the information around the world and search for the knowledge by exchanging a role of producer and consumer. Moreover, they spread their thought, opinion and claim to the world by means of the homepage, mini homepage and blog.
Due to the development of digital media, we may provide misleading information with a lot of people in the cyber space including internet, blog and mini homepage. Thus, this causes a very important issue - how we guarantee the people's right of access and the equity of knowledge right.
The right of access is an essential one. It requires people to use and get information, expresses their opinion and thought, and demands refutation and explanation of the mass media concerned. So the right of knowledge and access is the mutual relationship such as needle and thread.
The revolution of digital media suggests the new paradigm to interpret the right of knowledge and access with respect to formation of public opinion, exchange of information, and voluntary social movement.
