초록

한국에도 다문화주의라는 단어가 형성된지도 10여년이 넘어가고, 이제 이들이 서서히 한국의 품안으로 들어오는 시점이 다가왔다. 물론 그 2세들의 문제도 포함된다. 그러므로 이들을 단순히 손님으로 맞을 것인가, 아니면 국가구성원으로 맞이할 것인가하는 문제에 부딪히게 된다. 한 나라의 국가구성원이 되기 위하여서는 국적은 반드시 필요한 것인가? 국가구성원은 국민만으로 이루어지는 것일까? 현재 한국에 정주하고 있는 외국인은 국민은 아니지만 이곳에 오랫동안 정주하는 시민으로써 수용하는 것은 아니되는 것일까? 즉 시민권(Citizenship) 내지 시민주권을 인정할 수는 없는 것일까? 외국인을 국가구성원으로 인정할 때에 어디까지 인정할 것이며, 이 제도를 남용 내지 위장하여 악용하는 사례는 없을까 등을 고려하여 입법을 하여야 하는 것이다.
이와 같이 법은 선의의 입법취지를 넘어 이러한 전략적 행동을 충분히 감안하여 디자인되어야 한다. 이것이 메커니즘 이론에서 법과 제도를 보는 시각이다. 게임이론이 상대방의 최선의 대응을 감안하여 최선의 전략을 선택하는 것이라면, 메카니즘 이론은 지원 또는 규제 대상 일반의 최선의 전략적 대응을 고려하여 최적의 규칙을 정하는 것이다. 이러한 문제는 입법의 최적화에 해당하는 문제일 것이다.
그러면, 이와 같이 입법의 최적화와 관련하여, 국가구성원과 국적과의 관계는 어떠한 범위 내에서 형성하고 고려하여야 할까? 이하에서는 이러한 부분들을 일본 판례를 중심으로 분석하여 보고자 한다.
이러한 문제들과 관련하여 먼저 이웃나라 일본의 국적법과 국가구성원과의 관계가 형성되어 가는 과정을 살펴보고자 한다. 일본에 있어서 국가구성원은 어떠한 자격이 있어야 구성원이 될 수 있는가?한편 최근에 개정된 일본의 국적법은 혼인여부와 관계없이 일본인 남성과 외국인 여성 사이에서 태어난 아기도 일본인 친부가 출생 사실을 인정하면 일본 국적을 취득하도록 하는 등 국적 취득을 완화하여 그들의 국가구성원으로 포용하고 있다. 즉 다음의 판결(平成19(行ツ)164 国籍確認請求事件/平成20年06月04日 最高裁判所大法廷 判決 破棄自判 東京高等裁判所)로 인하여 2008년(平成20年) 12월 12일 국적법(법률 제88호) 제3조가 개정되었다.
이와 같은 부분들을 참고로 하여 일본의 국가구성원과 일본국적법을 연계시켜 위 판결에서 일본의 국적 취득 과정을 입법부와 사법부의 역할은 어디까지 인정할 수 있으며, 그 한계는 무엇인가를 중심으로 하여, 국가구성원과 국적(II), 입법부작위와 위헌(III), 해석의 범위-사법부의 역할 한계-(IV)를 집중적으로 조명하고자 한다.
아울러 다문화 시대에서 연륜을 쌓아가는 한국의 국가구성원은 어떻게 형성하여 가야 할 것인가, 즉 주권의 다양성을 추구하여 평등한 시민주권으로의 한국이 지향하여야 할 방향을 모색하고자 한다.

영어초록

In Korea, the term multi-culturalism has been around for over 10 years, and have steadily begun to really carve in. Nevertheless, there is evident problem regarding the 2nd generations, and debate whether to treat them simply as customers, or as a member of the nation. To become a member of the nation, is having a nationality a necessity? Are national members all composed of the nationals? Can't foreigners who have stayed in Korea for a long time be accepted as a citizen if not a national? In other words, can't their citizenship or citizen sovereignty be recognized? The extent to accommodating foreigners as members of the nation, as well as the possibility of abusing or exploiting the system through disguises must be considered during the process of lawmaking.
As such, lawmaking should exceed the concept of good faith, and be designed so that it sufficiently takes into account the strategic actions. This is the perspective of the theory of mechanism. If the game theory allows one to select the best strategy taking into consideration the expected counter-party's best corresponding actions, the mechanism theory allows one to determine the most appropriate rule by considering the expected best strategic correspondence for subjects related with support or regulations. Such problems probably corresponds to the optimization of lawmaking.
If this is the case, regarding the optimization of lawmaking, what should be the boundary for forming the relationship between national members and nationality? In the following, we analyze the Japanese case to understand this issue.
We first investigate the process of relationship formation between the nationality law and the national members of our neighboring country, Japan. In Japan, what is the prerequisite to become a national member?The recent revision in Japanese nationality law allows the children born between a Japanese male and foreign female, regardless of marriage just so that the Japanese biological father acknowledges the birth verification, to acquire Japanese nationality. This shows that the strictness of acquiring the nationality is weakening and that they are being more acceptive in regards to foreigners. Put differently, the ruling of 2007, Nationality Verification Request Case No.164 (2008 June 4th) Superior Court Rule, reversing and rendering judgment for the lawsuit of Tokyo High Court the nationality law(legislation no.88) article 3 has been revised as of 2008 December 12th.
Taking this part into account, we intend to concentrically clarify the National Members and Nationality(II), Legislative Branch and Violations(III), Interpretation scope - Limitations on the Role of the Judiciary(IV) based on the extent of which the legislative branch and the judiciary branch can recognize the Japanese nationality acquisition process as well as its limitations.
In addition, in the midst of levelling up the multi-cultural experiences, how the Korean national members should be formed and directed will be discussed. In other words, as a citizen sovereignty, Korea's directions for the pursuit of sovereign diversity has to be explored.
