초록

교도소와 구치소와 같은 교정시설은 범죄인을 격리·구금하고 교정·교화하여 사회에 복귀시키는 국가가 운영하는 교육시설이다. 교정시설은 신축한 후 통상 30-40년이 경과하고 시설이 노후화 되고 협소하거나, 현재의 교정시설 주변이 도시화의 진전 등으로 인해 지자체 지역주민들의 이전요구로 보다 외곽지역으로 신축·이전이 추진되고 있으며. 최근에는 경찰서 대용 구치시설 해소를 위해 교정시설이 신축되고 있다. 본 연구에서는 최근 10년간의 교정시설 신축 이전사례를 중심으로 그 유형을 ① 대체적으로 계획에 따라 추진된 사례, ② 지방자치단체의 적극적인 지원·협조로 순조롭게 추진된 사례, ③ 지자체 및 지역주민들이 교정시설 신축을 적극 유치한 사례, ④ 지자체 및 지역주민들의 반대로 지연･중단되고 있는 사례로 구분하여 각 사례별로 특성을 정리하고 교정시설의 바람직한 신축･이전 사업과 지역사회 상생방안을 제시하였다. 그 방안으로 지방자치단체의 적극적 협조와 지원, 지역사회 주민 친화형 상생모델 제시, 교정시설 이전을 대신한 재건축･리모델링 추진, 법원･검찰청･구치소의 통합 법조타운 조성 추진, 신축·이전 대상 교정시설의 일정연한경과제 실시, 교정시설의 중층화 및 도시미관을 고려한 사회 친화적 설계 등을 제시하였다. 최근 군비행장, 한전 발전소, 폐기물 처리시설 등과 교도소·구치소는 비선호시설로 인식되어 입지단계부터 주민 반대 등으로 사업추진에 어려움을 겪고 있는 실정이다. 우리사회에서 법원, 검찰청, 경찰서와 함께 교정시설은 반드시 필요한 형사사법시설이며 국가 주요시설이다. 따라서 교정시설의 신축·이전사업도 병원 등 의료시설이나 교육시설, 상업시설, 사회체육시설 등의 선호시설처럼 보다 효율적으로 원활하게 추진되어야 할 것이다.

영어초록

Such correctional facilities as prisons and detention centers are educational facilities operated by the government with the aim to isolate, detain, correct and reform criminals before returning them to society. Predominately, they are 30 to 40 years old and have outdated and confined facilities. As the surrounding areas of the current correctional facilities become urbanized, a growing number of local residents have demanded the relocation of the facilities, which has led to considerable efforts on the government’s part to implement the relocation of the facilities to a more isolated area at the request of local residents. In this regard, the study focused on sorting through the characteristics of the construction and relocation of correctional facilities over the past 10 years by case and proposed the desired construction and relocation projects for correctional facilities and the method of coexistence with the local community. As for characteristics by case, they include ① a case pursued by a plan, ② a case smoothly implemented through proactive support and cooperation with the local government, ③ a case proactively induced by local government and local residents and ④ a case delayed or suspended because of opposition by the local government and local residents. Recently, correctional facilities have been newly constructioned in order to resolve the problems of police detention areas. Regarding the methods, the study suggested proactive cooperation and support with the local government, local resident-friendly coexistence models, the aim of reconstruction and remodeling instead of the relocation of correctional facilities, the development of an integrated legal area including a court of law, Public Prosecutor’s Office, and Detention Center, the introduction of a particular durability period system that will be applied to correctional facilities subject to the construction and relocation, and society-friendly design that take into consideration the necessary balance between correctional facilities and urban beautification. As army airfields, KEPCO power plants, wastes treatment facilities, prisons and detention centers are recognized as unfavourable facilities, they now face an increase in hostilities in conducting a project from the initiation stage due to opposition from residents. Together with courts of law, public prosecutors’ offices and police stations, correctional facilities are considered to be a mandatory and significant part of the criminal justice system and national facilities. Accordingly, the construction and relocation of correction facilities need to be implemented more effectively in a similar way to favourable facilities such as medical facilities including hospitals, commercial facilities and community sport facilities.
