I. 서 론
국제상업회의소(ICC) 은행위원회가 2002년 10월 30일 신용장 거래에서 서류심사를 위한 국제표준은행관행(International Standard Banking Practice for the Examination of Documents under Documentary Credit : ISBP)을 승인하여 2003년 2월 3일 ICC 출판물 번호 645호로 발행하여 현재 전 세계적으로 사용되고 있다. ISBP는 신용장통일규칙(UCP 500)을 개정하는 것이 아니라 신용장통일규칙을 어떻게 실무에서 적용하여야 하는지를 설명하는 것이다. http://www.kcab.or.kr/journal/308_5.htm.
즉 신용장과 관련된 국제규칙과 국제관행은 각국에서 적용되고 있는 국내법보다 우선할 수는 없지만 신용장과 관련된 분쟁으로 소송이 제기되었을 때 법원은 자국 국내법과 상충되지 않는다면 신용장통일규칙, ICC Opinion 또는 ISBP를 반영하여 판결을 내리는 경우가 대부분이다. ICC에서 제정한 각종 규정의 광범위한 사용은 신용장에서 요구하고 있는 서류 작성과 심사의 국제적인 통일성을 높이고 제시된 서류에 하자가 발생할 비율을 크게 줄이게 될 것이다. ICC가 ISBP를 제정하게 된 배경 역시 이와 같은 맥락이라 할 수 있다.
신용장통일규칙 제5차 개정(UCP 500)이 있은 이후 ICC 은행위원회에는 신용장 거래와 관련한 많은 질문이 들어와 이에 따른 ICC의 공식의견(opinion)을 발표하였으며, 2000년 이후에는 신용장 거래로 인한 분쟁을 예방하고 이해를 높이기 위하여 600개 이상의 교육사례(educational queries)가 발표되었다.
