초록

이 글은 1990년대 초중반 한국 PC통신 환경에서 발생한 검열의 형성과정과 그에 대응한 저항의 양상을 종합적으로 분석하고자 한다. 1993년 11월 발생한 천리안 ‘현대철학동호회’ 사건은 PC통신이라는 새로운 디지털 환경에서 표현의 자유와 국가 권력이 충돌한 첫 번째 중요한 사례로, 노동운동과 관련된 게시물이 국가보안법 위반으로 단속되는 과정에서 디지털 공간에 대한 국가 검열의 메커니즘이 형성되었다.
이 글은 현대철학동호회 사건의 전개 과정을 추적하며 정치적 표현에 대한 규제가 어떻게 이루어졌는지 분석했다. 아울러 20세 청년이었던 김형렬의 구속과 재판 과정을 통해 디지털 텍스트가 법적으로 어떻게 해석되고 처벌되는지, 그리고 그 과정에서 발생하는 법리적 모순과 문제점을 고찰했다. 특히 디지털 텍스트의 물질성과 미디어 특성이 종이 인쇄물과 달리 복제와 전파, 소멸과 재생성이 용이한 비물질적 존재라는 점에서 기존 법체계와의 충돌이 불가피했음을 지적했다.
1995년 설립된 정보통신윤리위원회(정통윤)의 활동은 PC통신 검열의 제도화를 상징한다. 정통윤은 표면적으로는 ‘건전한 정보 문화 조성’이라는 명분을 내세웠으나, 실질적으로는 정치적 표현과 성적 표현을 동일한 ‘유해성’ 개념으로 묶어 규제하는 이중적 전략을 구사했다. 이 글은 정통윤의 심의 과정, 조직 구성, 활동 내용을 분석하며, 음란물 규제라는 명목으로 온라인 공간에 대한 국가적 개입의 정당성을 획득하는 전략을 비판적으로 검토한다.
1997년의 격렬한 온라인 검열 논쟁은 PC통신에서 웹사이트로 확장되는 인터넷 환경 변화 속에서 정부의 규제 강화 시도와 이에 저항하는 시민사회의 다양한 대응 양상을 보여준다. 정보통신부의 전기통신사업법 시행령 개정 시도, 수사기관의 PC통신 모니터링 확대, 한총련 관련 게시물 검열 등을 둘러싼 사회적 갈등은 디지털 공간의 표현의 자유에 대한 최초의 본격적인 사회적 논쟁을 촉발했다. 이 과정에서 시민단체들의 연대와 조직적 저항은 디지털 시민권에 대한 인식을 발전시키는 중요한 계기가 되었다.
이 글은 PC통신 검열의 역사가 단순한 기술적·법적 갈등을 넘어, 디지털 텍스트의 생산과 유통, 소비를 둘러싼 문화적 정치학의 장이었음을 강조하고자 했다. 국가보안법으로 대표되는 냉전 시대의 규제 장치가 새로운 디지털 환경에 적용되는 과정에서 발생한 모순과 갈등은 한국 사회의 디지털 문화 형성에 중요한 구조적 조건으로 작용했다. 이러한 역사적 맥락을 통해 현재 한국 사회의 디지털 검열 문제와 표현의 자유를 둘러싼 쟁점들이 어떻게 형성되었는지 이해할 수 있으며, 이는 디지털 시대 시민권과 민주주의 발전을 위한 중요한 통찰을 제공한다.

This study comprehensively analyzes the formation of censorship and patterns of resistance in the Korean PC communication environment during the early to mid-1990s. The November 1993 Chollian ‘Modern Philosophy Club’ incident represents the first significant case where freedom of expression collided with state power in a new digital environment, as labor movement-related postings were regulated under the National Security Law, establishing mechanisms for state censorship in digital spaces.
The research traces the development of the Modern Philosophy Club incident, analyzing how political expression was regulated. Through the arrest and trial process of Kim Hyungryeol, a 20-year-old youth, the study examines how digital text was legally interpreted and punished, and explores the legal contradictions and issues that emerged. It particularly notes that the inevitable collision with existing legal frameworks stemmed from digital text’s materiality and media characteristics as non-material entities that facilitate easy reproduction, transmission, deletion, and regeneration, unlike printed materials.
The activities of the Information and Communication Ethics Committee (ICEC), established in 1995, symbolize the institutionalization of PC communication censorship. While the ICEC ostensibly promoted ‘healthy information culture,’ it effectively employed a dual strategy of regulating both political and sexual expression under a unified concept of ‘harmfulness’. This study critically examines the ICEC’s deliberation processes, organizational structure, and activities, analyzing the strategic justification of state intervention in online spaces under the pretext of ‘obscenity’ regulation.
The intense online censorship debates of 1997 demonstrate the government’s attempts to strengthen regulations and civil society’s various resistance strategies amid the evolving internet environment from PC communication to websites. Social conflicts surrounding the Ministry of Information and Communication’s attempts to revise the Telecommunications Business Act enforcement decree, investigative agencies’ expanded monitoring of PC communications, and censorship of postings related to the National College Student Council stirred the first substantial social debate on freedom of expression in digital space. The solidarity and organized resistance of civic groups during this process became a crucial catalyst for developing awareness of digital citizenship.
This study emphasizes that the history of PC communication censorship transcended mere technological and legal conflicts, constituting a culturalpolitical arena surrounding the production, distribution, and consumption of digital texts. The contradictions and conflicts arising from applying Cold War-era regulatory mechanisms, represented by the National Security Law, to new digital environments served as significant structural conditions in the formation of Korean digital culture. This historical context enables understanding how contemporary issues of digital censorship and freedom of expression in Korean society have developed, providing important insights for the advancement of citizenship and democracy in the digital age.
