대한불교조계종 총무원장 선출제도에 대한 연구 －추대제와 선거제의 비교－ (A Study of Selection Systems for the President of the Jogye Order of Korean Buddhism - A Comparison of an Enthronement System with Election Systems -)

초록

총무원장은 개혁종단 출범 이전에는 중앙종회에서 추대하는 형식으로 대
부분 선출되었으나, 1994년 개혁종단이 출범하면서 간접선거로 선출하게 되
었다. 하지만 총무원장 선거인단에 의한 간선제 방식이 금권선거와 흑색선
전이라는 문제점들을 노출하면서, 불교계의 일각에서는 “종교조직에는 선거
가 불필요하며 추대제가 불교의 전통이다”라는 주장까지 제기되었다.
이에 본고는 추대제와 선거제의 비교 분석을 통한 총무원장 선거제도 개
선방안을 제시하고자 한다. 이를 위하여 현행 간접선거가 노정한 ‘금권선거’,
‘계파정치 고착과 종단화합 저해’, ‘승가의 정서와 부조화’, ‘대중의사 미반영’
이라는 문제점으로부터 ‘총무원장 선출과정의 청정성’, ‘총무원장 선출 후 종
단 화합 정도’, ‘불교의 전통적 선출방식과의 부합 여부’, ‘전체 구성원의 견
해 반영도’, 그리고 ‘실현 가능성’이라는 제도개정의 기준을 도출하였다.
추대제와 선거제를 이 다섯 가지의 기준에 의하여 비교 분석한 결과, 선
거제 특히 직선제는 전체 구성원의 견해 반영도, 불교의 전통적 선출방식과
의 부합 여부, 그리고 총무원장 선출과정의 청정성 확보를 위한 금품수수의
차단이라는 기준에 부합하였다. 반면에 추대제는 흑색선전의 차단에 효과가있어서 총무원장 선출과정의 청정성 확보를 하는데 기여할 수 있는 정도였
다. 총무원장 선출방식으로 추대제와 선거제 중 어느 방식이 적합한지를 단
적으로 말하기는 곤란하지만, 이상의 분석에 의하여 추대제보다는 선거제
특히 직선제가 제도개정의 여러 기준에 보다 부합함을 알 수 있다. 하지만
실현 가능성의 측면에서 바라본다면, 현재 종단 내 여러 문중과 계파가 총
무원장 선거제도 제ㆍ개정을 두고는 첨예한 대립을 하고 있기 때문에 직선
제로의 개정은 현실적으로 그 가능성이 낮다. 반면에 간선제를 유지하면서
운영방식만을 수정 보완하는 방안은 개정될 수 있는 가능성이 높다고 할 수 있다.

영어초록

The president of the Jogye Order was usually elected by an
approval of the Central Council of the Jogye Order, but indirect
elections have been used for the president since the reformed order
was launched in 1994. As indirect elections for the president by the
Electoral College has revealed several issues―the election involving
money and mudslinging some Buddhists argue that elections are not
necessary in religious organizations, so that enthronement system as
a tradition of Buddhism should be implemented.
In this context, this study aims to suggest improvements to
election systems for the president of the Jogye Order, through
comparing an enthronement system with election systems. To
achieve this objective, the study identifies the issues of concern
about the current indirect elections of the president; such as money
being involved in elections, fixation of faction politics and a
weakening harmonization of the order, discord with Buddhistatmosphere, and no reflection of people’s opinions. Then, the study
draws the following standards for election reform: fair election
procedure, harmonization of the order after the presidential election,
concord with Buddhist traditional election systems, reflection of all
members’ opinions, and feasibility.
According to the comparison and analysis of the enthronement
system and election systems based on those five criteria, election
systems, especially a direct election system satisfies the following
criteria: reflection of all members’ opinions, concord with Buddhist
traditional election systems, and prevention of bribery in order to keep
the election procedure clean. In comparison, an enthronement system
only contributes to secure fair election by controlling black propaganda.
It is hard to say definitely which system is more suitable for the
election of the president of the Jogye Order. However, the findings
explain that a direct election system rather than an enthronement
system meets more of the criteria to reform election systems. In
terms of feasibility, the chances of reform into a direct election
system are slim, because of sharp conflicts over establishment and
reform of election systems among many factions in the Jogye Order.
On the other hand, it is highly possible to amend and complement
administrative regulations only, while maintaining indirect systems.
