한일 서벌턴의 도박중독과 국가권력의 미필적 고의 (A study on the problem of gambling addiction in the Korean-Japanese subaltern and the willful negligence of national power)

초록

本稿では早くもパチンコをはじめとする様々なギャンブルを合法化した日本の試行錯誤を参考に、ギャンブル依存症になってしまったサバルタンの問題における国家権力の未必的故意及びその予防策について韓日比較の観点から考察してみた。 まず、彼らのギャンブルにはまる時期が韓日両国ともに主に未成年期、あるいは20代のころであることや、最近韓国では違法なネットギャンブルにはまってしまった青少年が大幅に増えたことを確認できた。 筆者は、いくら当選確率の低い合法的なギャンブルであっても、それがギャンブルである以上、一攫千金を謳って国民のギャンブル入門をほう助し、違法なギャンブルにはまってしまうきっかけを提供した国家権力の未必的故意を指摘せざるを得ない。ギャンブル依存症になったことについてすべてを自己責任とするのは至極不当であり、国家は30歳以下の未成年者および若年層に対するギャンブル依存症の予防に責任をもって介入すべきである。 その具体的な対策としては、まず、30歳以下の全国民に対し、これからはスマホを購入するとき、違法なネットギャンブルサイトへの接続を遮断する機能を持つアプリを義務的に、あるいは同意を得た上でインストールさせる一方、もし本人が接続を試みた際、家族および関連の公共機関に自動的に通報するシステムを導入することを提案する。次に、ギャンブル依存症の経験を持つ人々の事例を紹介するユーチューブ動画や短い分量の冊子を一条校等に配布し、読後感大会などを開催する仕組みを作り、ギャンブル依存症の危険性を分かってもらう機会を与えることを提案する。最期に、小学校、中学、高校の教師にネットギャンブルを拡散する学生および違法なギャンブルサイトを通報することを義務づけるとともに報奨金を支給することを提案する。

영어초록

This paper considered the national responsibility and countermeasures for the problem of gambling addiction from both Korean and Japanese perspectives, using the lessons learned from Japan's gambling such as pachinko.
First, we confirmed that gambling addiction causes a butterfly effect that also causes crime or suicide of parties with problems of debt and intermittent explosive disorder. It was also found that gamblers become addicts easily when they are underage or in their 20’s. It was confirmed that the number of juvenile crimes committed by adolescents who have become addicted to illegal online gambling has increased significantly in South Korea. I have to point out the inevitable intention of the nation, which helped the people to get started with gambling and provided an opportunity to get hooked on illegal gambling. The government should take responsibility for intervening in the prevention of gambling addiction for minors and young people under the age of 30.
As a countermeasure, first, when a person under the age of 30 purchases a smart-phone, he should be obliged to install an application that has a function to block the connection to an illegal internet gambling site. I also propose the introduction of the system that automatically notifies family members and related public institutions when the person tries to connect to an illegal internet gambling site.
Also, an interview booklet for gambling addicts should be produced and distributed to schools at each level and a book review contest should be held.
Third, elementary, middle, and high school's teachers should be required to report illegal gambling sites that spread online gambling, and I propose rewarding teachers for such reports.
