유학 윤리사상의 현대적 변환에 대한 한 구상 (An Idea on the Modern Conversion of Confucian Ethics)

초록

오륜으로 대표되는 유학의 윤리가 현대의 생활에 맞지 않아 총체적인 수정을 필요로 하지만, 논자는 그런 부분적 수정보다도 근본적으로 그 오륜을 대체할 이론을 유학에서 새롭게 찾아보고자 한다.
윤리행위를 위한 준비에 해당하는 수양에 있어, 과거 성리학자들이 철저히 행하던 ‘경공부敬工夫’는 본래적 자신을 회복하는 장점을 지녔다. 그렇지만 소통에 의한 타인과의 원활한 유대와 질서 수립이라는 윤리의 목적을 감안하면, 자신에 충실하면서도 타인과의 소통에 적합한 ‘성실한 마음가짐’을 갖는 데에 앞으로는 더 열중해야 할 것이다.
주체적 개인윤리의 문제에서, 공자가 애인愛人이라는 인仁의 본성을 ‘추기급인推己及人’하는 서恕의 방법으로 실현코자 한 사상은 오늘날에도 계승할 만한 윤리행위의 출발점이 될 수 있다. 다만 그 인의 구현으로서 서에 대해서는 막연한 동정심인 맹자의 ‘측은지심惻隱之心’이기보다는 ‘호의적好意的 배려 配慮’라는 이타利他 지향의 의지(善意志)로 이해하여 실행토록 해야 할 것이다. 그렇게 하면 호의적 배려로부터 ‘타인의 인격 존중’에 기초한 공경과 겸양의 예禮가 나오고, 그 배려에 대한 부당한 거역과 냉대에서는 ‘수오羞惡’로 인한 행위의 가부 정당성으로서 의義가 또 도출된다는 설명이 가능해진다. 따라서 인을 바탕으로 한 그 개인윤리 덕목들의 새로운 수립이 마침내 과거의 오륜을 대체하고서도 그 주체적 덕성 윤리의 근본 의도를 실현하는 결과에 이른다.
객관적 사회윤리의 문제에서는 먼저 예의 새로운 개정이나 보완이 필요한데, 그 개정과 보완은 시의성과 관습화의 추세 등을 고려해 합리적으로 해야 할 것이다.
그 다음, 객관적인 의義의 설정이 문제이다. 그 문제의 접근은 의가 원리화된 ‘의리義理의 용법’에 배어있는 사유의 검토로써 가능하다. 첫째 친근의 정감에 의한 의리의 용법은 의가 엄격히 공정公正한 성격을 띠어야 함을 보여준다. 그 공정성은 천리天理로 나타내는 논리적 타당성과, 실사實事에서 구시求是하는 실증적 엄정성을 지녀야 한다. 둘째, 유학은 위아설爲我說의 이기를 겸애兼愛보다도 더 배척한다. 박시제중과 통하는 ‘공익公益’을 곧 의와 의리로 간주하는 사상이 유학이다. 셋째, 애인으로서의 인의 구현은 본래 덕치 등의 방법으로 세계 인류의 범위로 행해지길(平天下) 목표로 했던 만큼, 그 세계인류 범위로 확대된 ‘박애博愛 정신’의 발휘이다. 박애의 실천이 곧 인을 구현하는 의리이다. 넷째, 박시제중의 공익은 실상 화和의 수단이며, 화는 이런 윤리행위의 종국 목표가 된다. 공익에 의한 공생지향의화는 결국 민주주의 정신과도 통하는 ‘공화共和’가 아닐 수 없다. 이상을 종합하면, 유학에는 근원적으로 공정‧박애‧공익‧공화라는 의, 곧 ‘정의라고 번역될 사유’가 있음을 깨닫게 된다.
이런 것들을 깨닫는 데서 유학의 윤리사상은 그 현대적 유용성을 확인하게 된다. 이상의 개인윤리와 사회윤리에 대한 새로운 이론은 또한 유학 윤리사상의 신실학新實學으로서 그 현대적 변환에 해당한다는 것이 논자의 판단이다.

영어초록

Confucian ethics represented by the five moral disciplines should generally be revised for they are not suited to modern lives. This writer, however, would like to suggest a radical and new substitute for the five moral disciplines rather than partial revisions of Confucian ethics.
Neo-Confucian scholars in the past devoted themselves to the practice of seriousness as a way of the cultivation and the recovery of self. However, considering that the aim of ethics lies in realizing, through communication, harmonious relationship with others and eventually establishing social order, we may conclude that it is not enough to recover one'sown self. It is also necessary to cultivate ‘faithful mind’ that is required for the communication with others.
Dealing with subjective individual ethics, Confucius tried to fulfill the nature of benevolence through forgiveness of others. Confucius' attempt as such may be considered even today as the starting point of ethical deeds, provided that to fulfill benevolence through forgiveness is understood not as Mencius’ ‘natural and innate sympathy’ but as ‘favorable consideration intended toward others’. Such a favorable consideration would lead to the courteous attitudes of respect and humbleness toward others.However, if one's kind consideration is unduly ignored and rejected, one may both feel shame at oneself and hatred for others. As these feelings of shame and hatred make one to reflect on whether one's deed is right or not, they are ultimately related to the sense of righteousness.
Therefore, the establishment of a new ethical system based on benevolence can be substituted for the five moral disciplines. As for the establishment of objective social ethics, the first requirement is to revise and supplement reasonably the concept of propriety with respect to the trend of times and customs. As for the establishment of the objective concept of righteousness, we can begin with the examination implied in the usages of ‘righteousness and principle’. The first usage is that righteousness is characterized by rigorous fairness. Here fairness should have the implications of not only logical validity represented by ‘the principle of Heaven’ but also positive and empirical exactness as is shown in Silsagusi. (the pursuit of truth on the basis of actua facts) The second usage implies that Confucianism rejects selfish interest and prefers ‘the public good’. The third usage is that ‘righteousness and principle’ is to realize benevolence through the practice of humanity. Originally, the realization of benevolence through the practice of humanity was a way of the virtuous governance of the whole people in the world.The fourth usage implies that ‘the public good’ is in fact a way of harmonizing the public which is the ultimate aim of ethical deeds. As the harmonization of the public pursues the public good and co-existence, it cannot be different from the democratic ideal of the ‘republic’.
In conclusion, it may safely be said that the righteousness or justice in Confucianism can be fundamentally be interpreted as fairness, humanity, the public good and the republic.
By reconsidering some core ideas of Confucianism as such, we have confirmed their usefulness even today. This writer thinks that new interpretations on the individual and social ethics of Confucianism as mentioned above correspond to the modern conversion of Confucianism as a new practical learning.
