초록

관권의 강화와 사족의 몰락이라는 향촌질서의 변화, 그리고 총액제와 공동납의 시행은 향촌사회 내부에도 큰 변화를 가져왔다. 우선 공론이 분열되었다. 吏鄕層과 大民들은 관행에 따라 鄕會라는 절차를 거치고 공론을 모아 징수를 결정했다는 것으로 자신들의 행위를 정당하다고 했지만, 소민들은 수령, 향리, 대민들이 주도하고 독점하던 향회와 ‘鄕中公論’의 정당성을 부정하였다. <民會所>를 만들어 자신들의 공론을 만들고, 그를 통해 읍폐를 개혁하고자 하였으며, 이는 관권에 의해 수용되었다. 이해관계를 달리하는 계층․계급이 서로 대립․갈등하는 장인 ‘공론장’에서 일시적이지만, 소민이 승리했다고도 볼 수 있을 것이다. 그러나 무엇보다 그에 따라 새로운 공론이 형성될 수 있는 중요한 계기가 마련되었다는 점에서 중요한 의미를 가진다. 또 <민회소>와 관이 합의하여 설치한 <査實所>, 그리고 <민회소>의 위임을 받은 사감과 사색이라는 존재도 새로운 향촌질서, 나아가 정치질서와 관련하여 중요한 의미를 가진다고 생각한다. 사실상 권력으로부터 위임을 받아 ‘공론’을 형성하던 사족과 달리 아래로부터, 혹은 ‘아래로부터’, 그리고 동시에 지방수령이라는 ‘위로부터’의 위임을 동시에 받고 있다는 점에서 새로운 질서형성이라는 점에서 커다란 의미를 가진다. 앞서 언급하였듯이 중앙집권적 정치체제 하에서는 특정 향촌사회의 작은 문제도 곧장 중앙권력까지 분쟁과 갈등의 장으로 이끌어 낼 수 있다는 점에서 문제가 해결되지 않을 경우 그를 위한 노력은 새로운 정치질서 의식이 중앙권력 차원으로까지 비화할 수 있을 것이기 때문이다. 동학농민전쟁에서 전봉준이 가지고 있던 ‘합의법’에 의한 정국운영 구상은 그러한 과정에서 아래로부터 구상된 새로운 정치질서 의식의 표현이었다고 생각한다.

영어초록

The change of country order called the reinforcement of government authority and the collapse of Confucian scholar and the implementation of the gross amount system and the joint payment brought about the big change inside the local society. First, the public opinion has been divided. Even though the government official class and big civil authority mentioned that their action deciding the payment through the procedure called local meeting according to the custom and by collecting the public opinion, small civil denied the justice of local meeting and public opinion in the local society that the local governor, local official and big civil lead and monopolize. Their public opinion is made by making <the place for meeting people>, they aimed to reform the evil customs and harmful effect through it and this has been accepted by the government authority. It may be seen that small civil won even temporary in the public sphere, the place, where the class and rank with different interests are in conflict and in discord. But, first of all, it has the important meaning in the point that the important opportunity that the new public opinion may be formed according to it has been prepared.
Again, it is thought that <the fact finding place> installed by the agreement of <the place for meeting people> and government and the existence called the authorized supervisor and the faction from < the place for meeting people> has the important meaning in relation to the local society order and further political order. In fact, it has big meaning in the point called the new formation of order in the point that from below differently from the Confucian scholar who forms the public opinion with the authorization from the power, or ‘from below’ and the authorization is received ‘from above’ called local official at the same time. As mentioned earlier, in terms of the effort for it, because the awareness of new political order may be spread to the level of central power in case the problem is not solved in the point that the small problem of specific local society in the centralized political system may be derived to the place of dispute and conflict to the central power right away. The plan for the management of political situation by ‘the Agreement Law’ that Bong Jun JEON in the Donghak Peasant War possessed is thought to be the expression of awareness of new political order planned from below in such process.
