송사형(訟事型) 우화소설의 한 가지 독법 : <서옥기(鼠獄記)>의 재판 공방 양상과 향유 지점 (A Way of Reading a Lawsuit-type Fable Novel: Aspects of Trial Battles and Points of Enjoyment in Seo-ok-gi)

초록

본 논문에서는 송사형(訟事型) 우화소설 <서옥기(鼠獄記)>가 무고(誣告)와 공술, 반박의 구성과 내용을 흥미롭게 읽도록 구성된 점에 주목하여 공방의 양상과 향유 지점을 살펴보았다.
먼저 작품에서는 총 세 차례 공방이 벌어진다. 1․2차 공방은 유력한 범인인 쥐의 명분 확보와 상실 과정을 보여준다. 쥐는 창고 및 창고 근처에서부터 상대 동식물을 지목하고 이유를 제시하며, 둘씩 짝지어서 지목함으로써 재판에서 자신의 명분을 확보하려 한다. 그러나 쥐는 공방 중후반부터 둘 이상씩 묶어 반박하고, 억지와 하소연이 늘어나며, 신성한 동물을 지목한 뒤 논점 일탈과 자책으로 일관함으로써 자멸한다. 3차 공방에서는 상대 동물에 대한 마구잡이 지목과 무의미한 비하로 파국을 초래한다.
재판 과정에서 공방은 철저하게 동식물의 속성에 기반하며, 속성을 정확하게 파악한 상태에서 이루어진다. 상대 동식물은 자신의 속성을 있는 그대로 서술함으로써 결백을 주장한다. 쥐는 상대 속성을 교묘하게 비틀어 해석하여 서술함으로써 상대를 부정적으로 느끼게끔 유도한지만, 그 의도가 적나라하여 도리어 설득력을 잃고 만다.
작자는 의도치 않게 공방이 길게 진행되는 상황을 재미삼아 그림으로써 재판관의 신속한 판단과 판결의 중요성을 환기한 것 같다. 독자는 재판 과정의 추이, 공술과 반박 양상, 동식물 속성 파악의 적절성 등에 흥미를 느끼며 작품을 읽었을 수 있다. 이 또한 송사형 우화소설을 읽는 흥미로운 한 가지 방법일 수 있다.

영어초록

This study investigated the aspects of battles and the points of enjoyment, paying attention to Lawsuit-type Fable Novel Seo-ok-gi's composition of false accusations, testimonies, and refutations and composition of contents for fascinating reading.
First, in the work, three battles take place in total. 1st and 2nd battles show the process in which Prime Suspect, Mouse secures and loses a cause. The mouse would secure its cause in the trial by spotting the other animals and plants from and around the warehouse, presenting reasons and pointing them out as culprits in pairs. However, the mouse makes refutations, binding two and more at a time from the middle and last parts of the battles, shows gradually more persistence and complaint, spots sacred animals and then destroys itself, going through the deviation from the point and self-blaming. In the 3rd battle, it ends up collapsing with indiscriminately spotting the other animals and plants and meaninglessly depreciating them.
In the trial process, the battles are thoroughly based on the attributes of the animals and plants, and they are held after an accurate understanding of the attributes. The other animals and plants insist on their innocence by describing their attributes as they are. Mouse induces the judges to feel negative about the opponents by describing their attributes through skillfully twisted interpretations; however, its intent is so explicit that it loses its persuasive power.
It seems that the author inadvertently aroused the importance of the judges' fast judgment and ruling by drawing the situations in which the battles take place for a long time for fun. The readers might read the work, excited by the progress of the trial process, the aspects of testimonies and refutations, and the appropriateness of the understanding of the attributes of animals and plants. This too may be one interesting way of reading a lawsuit-type fable novel.
