국가연구개발사업의 인간대상연구 현황, 과제 관리 기준과 생명윤리에 관한 고찰 (A study on national R&D projects involving human participants and Bioethics policies)

초록

본 연구는 현재 이루어지고 있는 국가연구개발사업의 인간대상연구현황 조사를 통해 국가연구개발사업의 과제 관리 기준의 필요성과 생명에 관한 연구윤리를 말하고자 한다.
엘리오 스그레챠는 “인간은 인간만이 가진 유일무이한 존엄성 때문에, 인격의 존엄성에 대한 존경에 바탕을 둔 윤리 규범은 각각의 연구단계와 그것에서 얻어지는 결과들의 적용 모두를 조명하고 규제해야 한다. 따라서 인류의 고통을 덜어주고 개인 및 사회에게 해를 주는 학대나 이익 추구를 방지하기 위해 과학 연구를 규제하고 지원하며 증진하는 일은 국가와 사회의 의무”라고 하였다.
2005년 1월 1일부터 시행된 「생명윤리 및 안전에 관한 법률」(이하‘생명윤리법’)은 2013년 2월 2일부터 전부 개정되어 인간 및 인체유래물에 관한 모든 연구에 관해서 법률의 적용을 받도록 했다. 생명윤리법이 인간대상연구의 완전한 윤리적 기준이 될 수 없지만, 인간대상연구의 상당한 연구 내용을 규제하고 있다.
국가연구개발사업은 미래성장동력인 연구과제에 대규모의 인력과 자원이 투입되어 이루어지는 연구 개발 과정이다. 현재 국가연구개발사업에서 이루어지고 있는 인간대상연구의 현황은 제대로 파악되지 않고 있다. 이에 본 연구는 생명윤리법이 적용되는 2014년도에 이루어진 국가연구개발과제 중에서 인간대상연구 현황을 파악했다.
2014년도 국가연구개발과제 58,607건을 전수 조사한 결과 총 1,244건의 연구 과제가 인간대상연구였다. 인간대상연구의 과제관리기준을 보기 위해 국가연구과제사업 관련 연구 관리기준을 찾아보면, 전체 175개의 연구 관리기준 중 35개 항목에서 연구윤리 내용을 언급하고 있었다. 그 내용은 연구부정행위와 관련있었다. 연구자 교육과정을 살펴본 결과 생명윤리에 관련된 내용은 부족한 것으로 조사되었다. 인간대상연구의 연구대상자들의 권리를 보장하고 위험을 최소화하기 위해서는 생명윤리법에서 제시한 인간대상연구에 관한 관리기준 수립과 교육이 필요하다.
이러한 조사를 토대로 추후 인간을 대상으로 하는 국가연구개발과제의 과제 관리 기준의 수립 및 충분한 생명윤리 분야 교육 기회제공에대한 필요성을 제시한다.

영어초록

The study seeks to examining the necessity of establishing the guiding rules of national Research and Development projects and Bioethics by analyze the Human subjects research of currently underway in the National R&D Projects.
Elio Sgreccia is referred to as “The Human person’ Because of his unique dignity, the ethical norm, founded on respect for the dignity of the person, should illuminate and discipline both the research stage and the application of the results obtained from it. It is in fact the duty of the state and the community to encourage, finance, and regulate scientific research for the relief of human suffering and to prevent abuses and profiteering at the expense of individuals and the community.” Bioethics and Safety Act(referred to as Bioethics Law here after) enacted on January 1, 2005, was largely amended on February 2, 2013, and expanded to be applied to all the studies involving human and human biological materials. Bioethics Law plays a key role of an ethical standard for human subjects research and it also regulates significant parts of human subjects research.
Korean national research and development projects are the process that invest a large volume of resources that are regarded as a driving engine for future growth. As for now, however, the current status of human subjects research that are conducted as part of national research and development projects, is not properly examined. Against this backdrop, this study aims to examine the status of the guidelines for research involving human subjects within the national research and development projects in 2014.
Out of 58,607 grants of national research and development projects in 2014, a total of 1,244 were found to be human subjects research. When we reviewed the grants management guidelines of researches related to national research and development projects to find out the guiding rules for human subjects research, out of the total of 175 rules regulating research, 35 rules referred to research ethics only. The contents were mostly about general research misconduct. To protect the rights of study participants and minimize the risk, the grant management rules/policies on the researches involving human as regulated in Bioethics Law should be established. And the education programs for researchers on human research are a vital factors to be fulfilled. In terms of educational curriculum for researchers, the contents on bioethics were found to be greatly insufficient.
As a conclusion, this paper will present demanding needs for establishing the guiding rules for future national research and development projects involving human and the necessity of sufficient educational opportunities on bioethics.
