大韓帝國期 海稅 관할권을 둘러싼 갈등과 內藏院의 海稅 관할권 장악 (The Complication of the Jurisdiction of Maritime Tax and Capturing of the Jurisdiction of Maritime Tax of the Office of Crown Properities in the Period of the Great Han Empire)

초록

갑오개혁을 계기로 여러 기관에 분산 관리되었던 어염선세는 度支部를 중심으로 정비되었으나, 개화파 정권이 붕괴된 후 해세 관할권은 황실기구인 宮內府(1901년), 內藏院(1903년)으로 이속되었다. 해세 관할기구가 변화되는 과정에서 탁지부ㆍ궁내부와 내장원 사이에는 해세 관할권을 둘러싼 갈등이 빈번하게 발생하였다.
개화파 정권은 국가 재정을 통합 관리하기 위해 재정기구를 일원화하고 예산제도를 수립하고자 하였으나, 국고․은행이 제대로 설립되지 못하면서 국가 재원의 관할권이 재정기관이 아닌 다른 행정기관에 이속되는 양상이 나타났다. 그리고 대한제국기 국가 재정이 내장원으로 집중되면서 국가 재정은 탁지부와 내장원으로 크게 이원화되어 운영되었다. 국가 재원에 대한 관할권이 일원화되지 못하고, 재정기관 이외의 다른 행정기관까지 재원 관할권을 장악함에 따라 각 기관이 재원의 조사 과정에서 관할 범위를 벗어난 다른 영역을 침범하면서 해세 관할권을 둘러싼 갈등이 발생하였다.
한편 역둔토ㆍ해세 등 잡세와 관련된 稅目은 국가 법령으로 정비되지 못하고, 관할기관이 작성한 장정에 기초하여 관리되었다. 이 경우 관할 기관의 입장에 따라 과세 대상의 범위가 확대ㆍ축소될 수 있었다. 내장원은 둔토 관리를 위해 둔토 범위를 규정하면서 그 범위를 최대한 확대하여 염세의 과세대상인 염전까지도 포함시켰다. 이로 인해 염전을 해세의 대상으로 파악한 해세 관할기관과 둔토의 대상으로 파악한 내장원 사이에 염세 관할권을 둘러싼 갈등이 발생하였다.
이러한 갈등은 내장원을 중심으로 해세 관할기관이 일원화됨으로써 해소될 수 있었다. 그러나 갈등의 해소가 금고 제도의 확립이나 잡세와 관련된 세제 전반의 정비라는 국가 차원의 제도적 정비로 나아가지 못한 채 특정 기관에 국가 재원을 집중하는 방식으로 이루어졌다는 점에서 한계가 있었다. 그 결과 내장원은 염세와 해세를 구분하여 둔토의 대상으로 鹽井稅와 해세의 대상으로 鹽釜稅ㆍ鹽石頭稅를 각각 부과하는 문제가 발생하였다.

As of kabo reform, the salt, fisheries and ship tax that diversely managemented were reorganized by the ministry of finance. But since the breakdown of the progressive party regime, the jurisdiction of maritime tax was transferred to the ministry of royal household(1901), the office of crown properties(1903). In this process the jurisdiction of maritime tax frequently caused complications among the ministry of finance, the ministry of royal household and the office of crown properties.
The progressive party regime intend to unite financial appratus and estabilish budgeting process for the managing of public finance. But the jurisdiction of public finance was transferred to the other administrative organizations since public bank was not established. And public finance were dualy managed by the ministry of finance, the office of crown properties since the public finance was concentrated to the office of crown properties in the period of the great han empire. Complication of the jurisdiction of maritime tax was occurred for the jurisdiction of public finance was not centralized, the other administrative organizations captured the jurisdiction of public finance and ivaded out of the jurisdiction.
The public lands, the maritime tax in tax categories that related on miscellaneous tax were managed based on the ‘changjong’ that made by competent authorities. In this case the range of tax categories became to change on the positon of competent authorities. The office of crown properties provided the range of military lands for the management and enlarged of the range include the salt field for the salt well tax. Thus the complication of the jurisdiction of maritime tax was occurred between competent authorities of the maritime tax and the office of crown properties.
This complication was disentangled by competent authorities of the maritime tax were centralized in the office of crown properties. But disentanglement of complication has limits that national organization maintenance and public finance system was not established that centralized in specific authority. As the result the office of crown properties raised the problems that imposed the salt well tax for the military lands, the salt boiling container tax, the salt straw bag tax for maritime tax seperately.
